According to People magazine, Justin Baldoni filed a letter to address the judge in the U.S. District Court, Southern District of New York, where he requested an order for Blake Lively to identify her medical and mental health care providers.

'Without prejudice' suggests that Blake Lively refuses to 'disclose the information and documents needed to disprove that she suffered any emotional distress' as well as maintain the right to refile her claims at an unknown time in this or some other court after the discovery window has closed. In the document filed by Baldoni, he specifically mentioned that Ms. Lively cannot have it both ways.
