Nurse tells inquest of treatment she gave prisoner before his death

A prison nurse who treated a First Nations man the morning he died in a central Victorian prison has broken down in tears at his coronial inquest.

Gunditjmara and Wiradjuri man Clinton Austin, 38, was found unresponsive in his cell at Loddon Prison, near Castlemaine, on September 11 in 2022.
The Coroners Court of Victoria on Friday heard nurse Ebony Kearns did not test Mr Austin's vital signs and did not make further observations after he presented to a prison clinic complaining of vomiting and diarrhoea the morning he died.
Ms Kearns told the inquest this was because she believed he was "OK" considering his appearance and the nature of his complaints.
"I should have been more thorough, regardless of [the] outcome," she told the court.
The inquest also heard an expert report found Mr Austin's condition had warranted further observations, including heart and respiratory rate monitoring.
Mr Austin was serving a three-and-a-half-year jail term for aggravated burglary and had been eligible for parole for almost one year before he died.
He had an acquired brain injury from a car accident in 2018 and lived with schizophrenia.
The coronial inquest resumed months after evidence was given in March and April.
The inquest heard Ms Kearns could have rescheduled other appointments and administrative work to monitor Mr Austin's symptoms.
A lawyer representing Mr Austin's family cross-examined Ms Kearns in relation to two statements she gave about her care of Mr Austin the day he died.
One statement was completed for an internal prison database.
The other statement, which was submitted to the inquest, was signed in March 2023, several months after Mr Austin's death.
The court heard this statement was written with the assistance of lawyers and heavily edited.
Ms Kearns was asked by a lawyer representing Mr Austin's family why it was signed in March.
"I was quite fearful of this entire process," Ms Kearns said.
The court also heard Ms Kearns completed a mandatory cultural competency training module online each year.
But while she found that training "useful", it took about 20 to 30 minutes to complete and was often repeated.
"Something in person would be better," she said.
At the beginning of the inquest, Coroner Ingrid Giles ruled a doctor's report suggesting Mr Austin could have died from either sepsis or heart failure would be included as evidence.
The report, written by addiction medicine specialist Nico Clark, was commissioned by lawyers representing the Austin family and submitted after the deadline.
Lawyers for prison healthcare provider, GEO Healthcare, and mental health provider, Forensicare, said the findings were outside Dr Clark's area of expertise.
They said the late service denied procedural fairness.
More evidence will be heard from September 1-12, not including September 11, the day Mr Austin died.
Inquest hearings from April heard Mr Austin was an NDIS participant but fell through a gap in disability support services before his death.

When the driver allegedly failed to stop, police initiated a pursuit but terminated it a short-time later due to safety concerns. Police allege the BMW later collided with a Mitsubishi SUV on the Great Western Hwy at St Marys, before crashing into a nearby medical centre. The alleged driver – a 16-year-old boy – was arrested at the scene with the assistance of the Dog Squad after attempting to hide in the centre. He was treated at the scene by paramedics before being taken to hospital under police guard. The teen was later charged with police pursuit not stop drive dangerously, take/drive conveyance without consent of owner, and never licenced person drive vehicle on road. He to appear before children's court on Saturday. The driver of the Mitsubishi – a 39-year-old woman – was also treated at the scene, but was not taken to hospital. The Traffic and Highway Patrol Command have since established a crime scene with Strike Force Puma to investigate the incident. Images of the medical centre obtained by 7News showed extensive destruction, including a broken sign and debris strewn across the floor.

Former Labor leader Mark Latham has confirmed, in a 13-page sworn affidavit, that he did defecate on his ex-lover, Nathalie Matthews, and that she called him 'master' during sex, but he insists it was all her idea. In a graphic account of the couple's relationship filed in NSW Local Court, the NSW MP strongly denies all of Ms Matthews' allegations of mistreatment in their relationship, insisting that some of the more unusual sexual acts they engaged in were at her request. Confirming for the first time that her original claim in an AVO application that he defecated on her prior to sex had occurred, he insists he was simply following orders. 'She asked me to s*** on her in the bathroom once because it turned her on,' he wrote. 'I did that but said we wouldn't be doing it again. 'She said she would like to s*** on me and I said that would never happen and it never did.' In the affidavit, which was first obtained by The Sunday Telegraph, Mr Latham asserts that the couple's 'consensual subservience' was at the behest of his younger girlfriend. 'As a reflection of this desire, she insisted on calling me 'master' and that I use this nomenclature,' Mr Latham writes in the affidavit. 'When having sex, she would invariably demand from me, 'Call me Mark's slut,' or 'Call me Master's slut,' knowing this would bring her to orgasm multiple times,' he wrote. 'She was a highly powered sexual woman who knew what she liked and how to get it.' He claims this role play allowed her to 'orgasm multiple times'. Ms Matthews has been contacted for comment on this claim. Mr Latham has previously slammed the media as 'peeping toms' amid revelations his former partner booked him two sex workers to celebrate his 64th birthday and asked for the escorts to refer to the NSW MP as 'master'. In her own application for an AVO in the NSW Local Court, Ms Matthews claims Mr Latham pressed her 'to engage in sexual acts with others' and demanded she call him 'master' – claims Mr Latham strongly denies. A group of neo-Nazi protesters who marched through the Melbourne CBD have been condemned by Victorian Premier Jacinta Allan as 'cowards' and 'goons', as she vowed to introduce stronger powers for police. About 100 people dressed in black face coverings from the National Socialist Network - a far-right neo-Nazi group - marched through the Bourke Street mall at 12.40am on Saturday. As the group made its way along Bourke Street several police cars drove alongside the protesters. In videos posted to social media, members of the protest group, led by white supremacist leader Thomas Sewell, can be seen waving the Australian and National Socialist Network flags and holding banners stating: 'White man fight back'. A 26-year-old man who confronted the group was allegedly assaulted and was taken to hospital with non-life threatening injuries. According to police, the group walked to Flagstaff Gardens where they dispersed at about 1.25am. A police spokesman said no arrests were made throughout the protest, and added that 'police had a strong presence to maintain community safety and to prevent any breach of the peace'. 'Victoria Police respects the right to protest, however, there is absolutely no place for such anti-Semitic, racist or hate-based behaviour in our society and police will not tolerate such activity.' Victorian Premier Jacinta Allan condemned the march in a statement, saying: 'Nazis don't belong in this country and they know it. That's why they hide behind masks in the dark.' She also thanked officers for maintaining 'public order', and said police needed 'more powers, and we're giving it to them'. 'Our criminal Anti-Vilification laws come into effect next month,' the premier said in a statement. 'We will introduce powers for police to unmask cowards at protests after that. 'This behaviour is unacceptable and does not align with the values of an inclusive, tolerant and multicultural state,' he said.
