
Chinese national in Sibu jailed 5 years, fined RM20,000 for fatal crash that killed Sabah State Court director

SIBU (June 10): The Magistrates' Court here today sentenced a Chinese national to five years imprisonment and fined him RM20,000 in default three months' jail for dangerous driving that resulted in the death of former Sabah State Court director Marutin Pagan.
Magistrate Rosli Ahmad convicted Sun Xue Song, 42, on his own guilty plea to an amended charge under Section 41(1) of the Road Transport Act 1987, which carries a maximum jail term of 10 years and a fine of up to RM50,000 upon conviction.
Rosli also ordered for Sun's jail sentence to run from the date of his arrest on March 30 and disqualified him from holding a driving licence for five years.
Sun committed the offence on March 30 at around 1pm at the Kanowit roundabout here.
According to the facts of the case, Sun, who was driving a Proton X70, deliberately ignored the give-way road markings leading to the roundabout as he proceeded to drive dangerously before colliding with a Toyota Fortuner.
Marutin, 56, and three other passengers were travelling in the Toyota Fortuner driven by his daughter, which was heading towards the Sibu exit.
Sun's act of dangerous driving resulted in a collision between the two vehicles, which caused the Toyota Fortuner to roll several times before ending up on its side off the roundabout.
Marutin, who sustained several injuries due to the incident, was taken to Kanowit Hospital where he later died.
A post-mortem result determined his cause of death as head and chest injuries due to a road traffic crash.
In mitigation, Sun, represented by defence counsel Terence Tiong, requested the court to consider his clean record, full cooperation with authorities, genuine remorse, financial assistance to the victim's family, dependents' plight, and the unintentional nature of the tragedy.
Tiong said Sun is supporting his seven-year-old son and 70-year-old mother, who rely entirely on his income, care, and support for their survival and well-being.
The first-time offender with no previous convictions in Malaysia or his home country had given RM70,000 to Marutin's widow as a bereavement payment to express deep remorse and sorrow.
Tiong said Sun had also entered a guilty plea at the earliest opportunity.
He added another mitigating factor was that the scene of the accident at Jalan Kanowit-Durin is known as an accident-prone area.
In her submission, deputy public prosecutor Cynthia Emmelda Jerry requested the court to consider the degree of culpability where Sun had deliberately ignored the road markings before dangerously driving into the roundabout.
She also submitted that the sentence to be imposed must have a deterrent effect on other potential road users as well as for public interest.

Newborn killed by stray dogs

Dad refuses to post bail for rapist son
A FATHER refused to bail his 16-year-old son after he was charged in the Magistrate's Courts in Batu Pahat, Johor, with raping his 15-year-old girlfriend, Berita Harian reported. The man, in his 40s, refused to post the RM1,500 bail after his son pleaded guilty in court because he wanted to teach the boy a lesson. The teenager, who works as a helper at a food stall, pleaded guilty to having sexual intercourse with the underage girl at a house between 4pm and 5pm on June 2. It was reported that his 41-year-old mother had returned home early from work and found the girl's slippers outside the house. Following police investigations, the boy and the girl admitted to having had sex 16 to 18 times. Broken windscreen: The damaged front of the express bus that crashed into a trailer. — Photo courtesy of IPD Maran KUANTAN: Twenty-eight people, including 13 students from Universiti Malaysia Pahang Al-Sultan Abdullah (UMPSA), escaped unhurt after the express bus they were travelling in crashed into the rear of a trailer at KM161.5 of the East Coast Expressway. Maran police chief Supt Wong Kim Wai said the incident occurred around 1am yesterday while the bus was en route from Terminal Bersepadu Selatan in Kuala Lumpur to Terminal Sentral Kuantan. 'The bus was in the left lane when it is believed to have collided with a trailer travelling in the same direction. 'Fortunately, all 28 passengers, including the drivers of both vehicles and the trailer attendant, were not injured,' he said in a statement, Bernama reported. Supt Wong said the passengers on the bus were transferred to another vehicle to resume their journey to Kuantan. The case is being investigated under Section 43(1) of the Road Transport Act 1987. Meanwhile, UMPSA vice-chancellor Prof Dr Yatimah Alias confirmed that 13 university students were on board the bus. She said all students safely arrived at the Gambang UMPSA campus around 4am yesterday via a replacement bus. 'With the support of the Student Representative Council and the Student Affairs and Alumni Department, the students were received at the Gambang UMPSA mosque and provided with food, emotional support and temporary accommodation, especially the seven students from the Pekan campus,' she said.
