Ed funding overhaul nears final steps despite concerns about secondary school boost

Key provisions of a plan to overhaul New Mexico's per-student formula for financing public K-12 education are raising concerns even as the proposal nears the finish line.
State lawmakers already have allocated $4.4 billion for education spending — the single biggest piece of New Mexico's proposed budget for fiscal year 2026.
House Bill 63, the result of two years of inquiry by the Legislative Education Study Committee, would make some changes to how the state divvies that money by student, offering up targeted funds for English learners and altering the state's method for identifying students in poverty.
It also lays out extra funding for most middle and high school students; while, the proposal sailed through the Senate Education Committee with unanimous support Monday, whether it will secure the additional money for secondary students remains uncertain.
'In House Appropriations and Finance, in the budget-making process, the increase to the secondary factor — the large increase that we had — didn't make it into the budget,' the bill's sponsor, Rep. Andrés Romero, D-Albuquerque, told the committee.
Charter schools also voiced concerns about a potential loss of funds because of the bill's changes.
New Mexico's education funding formula, known as the State Equalization Guarantee, provides money to schools based on the number of students they serve, with each student currently worth about $6,000 per year.
But the formula also factors in certain student attributes — such as grade level, special education services, family income level and participation in fine arts or other specialty programs — in calculating the total dollar amount a student will bring to their school as a way to account for additional and sometimes more expensive needs.
House Bill 63 proposes a few big changes to the State Equalization Guarantee.
First, it would calculate schools' "at-risk" funding — a special pot of money intended to address the needs of students in groups considered at risk of failing — based on the Family Income Index, a measure established by the Legislature in 2021 to better estimate the number of students living in poverty at each public school.
That change, Romero said, would provide a 'better way to really pinpoint' which schools generated those funds and how they're using them to better support students.
Second, HB 63 would create a new financial factor in the funding formula, creating a stand-alone credit to support 'identified services to assist English learners to attain English language proficiency.'
English learners were previously included as one of several factors in the 'at-risk' category.
The original version of the bill proposed a third major change: An increase in state spending for middle and high schools, intended to target the downturn in proficiency and attendance that typically comes during those years.
Changes in the House Appropriations and Finance Committee, however, struck those increases for all but sixth grade. Additional dollars for seventh through 12th graders did not make it into the committee's budget proposal.
Lawmakers haven't given up on extra funding for secondary students, though.
"We're working with the [Senate] Finance Committee about putting that funding back into the budget over on this side," said Sen. Bill Soules, D-Las Cruces.
Another sticking point for the bill: Charter schools worry about proposed technical changes that would allow them to generate their own at-risk index based on their number of students in poverty, rather than using figures from their home school district.
On the whole, that's not a bad thing, said Matt Pahl, executive director of Public Charter Schools of New Mexico.
"This has been something charter schools have been wanting for a number of years — the ability to generate our own at-risk index," Pahl told the committee.
However, the change could provide a charter school with more or less at-risk funding — depending on how different it is from its home district.
The bill currently includes an extra $5 million cushion, intended to keep state education funds for charter schools steady for one year, even if the updated funding formula would call for decreases.
Romero, who represents much of Albuquerque's South Valley, noted some charter schools in his area could benefit from the change because they serve a higher population of at-risk students than Albuquerque Public Schools overall.
Jason Morgan, principal of the Academy for Technology and the Classics in Santa Fe, said the district-chartered school would see a drop of about $200,000. Morgan asked lawmakers to consider extending what's known as the "hold harmless" period — when current funding levels would be maintained — to three years.
"A one-year hold harmless means we're going to be preparing for that now. A three-year hold harmless gives us a minute to breathe," Morgan said.
Romero said he's open to making that change and plans to prioritize it throughout the interim period between legislative sessions, though it ultimately will depend on the will of the state's financial committees.

California LGBTQ+ Groups condemn Trump's ‘dangerous' crackdown on L.A. immigration protesters

California's LGBTQ+ groups are standing in solidarity with immigrants and protestors as Donald Trump cracks down on community backlash to recent ICE raids in Los Angeles. At least 118 immigrants were arrested in LA between Friday and Saturday, ICE said in a Saturday post on X, sparking massive protests outside several government buildings in the city's downtown area. Trump has since usurped California's sovereignty by deploying the National Guard without Democratic Gov. Gavin Newsom's request — the first time since 1965 that a president has bypassed a governor's authority to deploy the troops. "Donald Trump's decision to seize control of the California National Guard and launch sweeping immigration raids is a dangerous and deliberate escalation, intended to terrorize communities across our state," Equality California Executive Director Tony Hoang said in a statement. "These actions are rooted in political theater and will ignite more fear in already vulnerable communities. They are sowing chaos and tearing families apart." Up to 3 percent of non-citizens living in the United States — about 640,000 people — are LGBTQ, according to a report from the Williams Institute. This includes as many as 288,000 undocumented immigrants who are at heightened risk under Trump's mass deportation plan. A separate study from the center found that at least 11,400 LGBTQ+ people had sought asylum in the U.S. between 2012 and 2017, with nearly all claims (98.4 percent) resulting in a positive determination of credible fear. "LGBTQ+ immigrants are especially vulnerable at this moment," Hoang continued. "Many have fled violence and persecution only to be met with federally-sanctioned cruelty here in the United States. These raids risk separating loving families, re-traumatizing asylum seekers, and driving LGBTQ+ people further into the shadows — where access to safety, health care, and legal protection is even more limited." Los Angeles is a sanctuary city for immigrants as well as LGBTQ+ people, meaning law enforcement is not allowed to use its resources to enforce deportations or raids. In the case of LGBTQ+ people, they are not allowed to facilitate prosecution against queer youth who travel to the city to receive gender-affirming care. Newsom has since announced that he will be filing a lawsuit against the Trump Administration Monday if the president does not recognize the state's sovereignty by withdrawing the National Guard and returning its control to him. He also said in response to White House "border czar" Tom Homan's threats of arrest for supposedly interfering with immigration agents' duties, "Tom, arrest me. Let's go." The Los Angeles LGBT Center said in a statement that its Legal Services team "has legal clinics available in both English and Spanish to help LGBTQ+ immigrants protect themselves and their families in times of crisis." They also provide assistance with asylum applications, work permit applications, name/gender marker changes, and more both in person and virtually. "These raids are a cruel reminder that safety and dignity are still not guaranteed for all," the group said in a statement. "The Center stands with people of Los Angeles, including immigrant rights groups and our elected officials in condemning these attacks on our community. The Osceola County Sheriff's Office's executive director has been fired following Sheriff Marcos Lopez's arrest on state racketeering charges, after having served him for years as his top advisor during his election campaigns and later as part of his administration. The Sheriff's Office confirmed Nirva Rodriguez's termination days after her employee profile was scrubbed from its website and following questions from news outlets about her status with the agency. On Monday, the agency refused to answer inquiries about her firing and that of Ruben De Jesus, who was described as being a 'civilian employee' after also having worked on Lopez's campaigns. In a statement shared with the Orlando Sentinel, Rodriguez said her firing 'is a separate matter' from Lopez's arrest and suspension. She added: 'I have no knowledge of the allegations against the former sheriff and I am not involved in that investigation.' Rather than explain their ousters and De Jesus' role there, an agency spokesperson told a Sentinel reporter to instead file a public records request. A message seeking comment from De Jesus — a special deputy and a former board member of the agency's Police Athletic League, according to his Linkedin profile — was not immediately returned. While De Jesus held a lower profile following Lopez's election in 2020 and his reelection last year, Rodriguez's ubiquitous presence in the community both in person and online was a hallmark of Lopez's administration, especially on its Spanish-language social media accounts. There, she co-hosted a weekly live show with Lopez called 'Aquí No, Charlatanes' — which means 'Not Here, Charlatans' in English — a roundup that highlighted the agency's initiatives and arrests and is named after a moniker Lopez used to refer to alleged criminals. She would also appear in weekly segments with Lopez on WIPR in Puerto Rico called 'Los Más Buscados,' or 'The Most Wanted,' featuring suspects being sought by law enforcement. 'I am deeply grateful for the opportunity to have served the citizens of Osceola County, and I am proud of the good work that was accomplished during my time at the agency,' Rodriguez's statement said of her time in the Sheriff's office. 'I feel blessed to have been a part of the time and to have had the chance to make a positive impact in the community. I appreciate the experience and wish the agency and its employees all the best in their future endeavors.' Neither Rodriguez nor De Jesus have been accused of wrongdoing in Lopez's case, but the decision to fire them is a sign that the office is cleaning house of Lopez's allies under interim Sheriff Christopher Blackmon, the Central Florida region chief at Florida Highway Patrol appointed by Gov. Ron DeSantis following Lopez's arrest. No other firings have been announced while the Orlando Sentinel awaits fulfillment of its request for separation notices at the agency. Meanwhile, Lopez remains suspended from office while he awaits trial. A charging document released by Florida Attorney General James Uthmeier accuses Lopez and at least four others of operating an illegal gambling empire in Osceola and Lake counties. Lopez, prosecutors said, made as much as $700,000 in cash from the scheme, which began months after he announced his run for sheriff in 2019 until just recently. That's expected to be detailed in a 255-page affidavit referenced in court Friday by the Office of Statewide Prosecution which remains under seal. Lopez was arrested by federal agents Thursday and, as of Monday, remains in the Lake County Jail on a $1 million bond. He pleaded not guilty to the state charges. Further charges and co-defendants, Uthmeier said, are pending and could include federal crimes.
