The Delhi High Court Monday sought a response from the city police in a plea by student activist Asif Iqbal Tanha challenging the framing of charges against him in a 2019 FIR lodged over violence that allegedly erupted over protests against the Citizenship Amendment Bill at the time.
Justice Sanjeev Narula, issuing notice, posted the matter for consideration next on October 13.
Two other accused in the case — activist Sharjeel Imam and Jamia student Chandan Kumar — have also challenged the framing of charges against them by a trial court, with their petitions also pending before the Delhi High Court. The high court is due to consider all these pleas on October 13.
While framing charges against the accused, the trial court, in an order on May 7, observed, 'Accused Sharjeel Imam was not only an instigator, he was also one of the kingpins of a larger conspiracy to incite violence.'
Imam and Tanha were charged under sections related to abetment, criminal conspiracy, being part of an unlawful assembly, and rioting with a deadly weapon of the Indian Penal Code (IPC), and sections of the Prevention of Damage to Public Property Act, among others.
According to the chargesheet filed in this case, 41 vehicles, including government vehicles, were damaged and set ablaze by a mob of hundreds in New Friends Colony. It also stated that 10 police officers were injured, including a station house officer (SHO) who sustained grievous injuries.
Fourteen people have been discharged in the case, while charges have been framed against nine others.

New Delhi, Aug 2 (UNI) The Delhi High Court has upheld the conviction of three Delhi Police personnel in a 2013 sexual harassment case including a woman and her minor niece, directing the convicts to surrender before the trial court within five days. The Court ruled that no leniency will be granted given the nature of the offence and the fact that the convicts were law enforcement officers who violated the very law they were meant to uphold. The three convicts, Jaidev, Jagmal, and Suraj Bhan alias Monu were found guilty under various sections of the Indian Penal Code (IPC) and the Protection of Children from Sexual Offences (POCSO) Act. The Court noted that the incident occurred in May 2013 and involved repeated misconduct by the convicts, who were also neighbours of the complainant. The High Court observed that the convicts, despite being public servants, had persistently engaged in inappropriate behaviour, including making vulgar gestures, sexually explicit remarks, and, in one instance, indecent exposure in the presence of the complainant and her niece. The Court rejected claims for leniency based on the age, health conditions, or family responsibilities, citing the seriousness of the offences and their prolonged nature. The judgment showcased that the case did not merit a rehabilitative approach due to the aggravating circumstances, including the convicts' positions in the police force and the repeated nature of the acts. The Court further noted that other FIRs had been registered by the complainant in subsequent years, indicating ongoing harassment and misconduct. Citing Supreme Court precedents, the High Court highlighted that sentencing must be proportionate to the gravity of the crime and serve as a deterrent, especially when the perpetrators hold positions of authority. The Court concluded that a punitive approach was necessary to restore public confidence in the justice system. GUNTUR: The Second Additional District Court on Friday has sentenced Gaviriboyina Sivashankar to life imprisonment and imposed a fine of Rs 3,000 for the brutal murder of his wife Sharada in Agathavarappadu village of Pedakakani mandal in 2015. As per police, Sharada (26) was married to Sivashankar, an Indian Army employee, in May 2009. During a visit home on leave, Sivashankar, allegedly under pressure from his family, made accusations against Sharada. Although a compromise came out, Sharada began living with her parents. Disputes over financial aid followed, during which the man's family allegedly instigated him to kill her. On July 26, 2015, Sivashankar stabbed his wife Sharada. Based on her father's complaint, a case was filed under relevant IPC sections and the Dowry Prohibition Act. Judge Y Nagaraja convicted Sivashankar after reviewing the evidence, while proceedings against his co-accused mother Subbamma were closed due to her death.

Minor's sexual assault case: HC upholds charges against suspended Delhi govt official

The Delhi High Court has refused to quash the charges framed against suspended Delhi government official Premoday Khakha, who allegedly raped a minor girl several times. The High Court also upheld the charges of causing miscarriage of the minor girl and disappearance of evidence framed against the official's wife, Seema Rani. It further refused to set aside the charge against his two children and wife under Section 21 of the POCSO Act for failure to report the offence despite having knowledge. "This court is of the considered opinion that there is no perversity or legal infirmity in the order passed by the sessions court framing charges against petitioner Premoday Khakha for offences under Sections 376(2)(f), 376(3), 323, and 354 of the IPC, and Sections 6 and 8 of the POCSO Act," Justice Swarana Kana Sharma said in the judgment passed on July 15 and made available on July 28. Premoday was charged for the alleged offences of raping a girl while being a relative or in a position of trust or authority towards her, and raping a girl under 16 years of age and causing hurt. The court also rejected Premoday's contention that the charges against him should be quashed or that he should be discharged on the ground of his alleged inability to impregnate the prosecutrix due to his prior vasectomy. The accused had raised the argument that even if the girl's allegations are taken at face value, she could not have become pregnant since he had undergone a vasectomy procedure in 2005, rendering him allegedly incapable of reproduction. "In this regard, the sessions court has rightly observed that the mere fact of having undergone vasectomy does not conclusively establish that the accused was incapable of committing penetrative sexual assault or of impregnating the prosecutrix. "It has been correctly noted that vasectomy, as a medical procedure, is not infallible, and there are medically documented cases of conception occurring despite a male partner having undergone such a procedure," the High Court said. Premoday has been accused of allegedly raping a minor girl, the daughter of a person known to him, several times between November 2020 and January 2021. He is currently in judicial custody after his arrest in August 2023. The official's wife Seema Rani allegedly gave the girl medicines to terminate her pregnancy. She is also in judicial custody. The High Court passed the order while dismissing the pleas by Premoday, Seema, their son Harsh Prateek and daughter Prateeksha challenging framing of charges against them by the trial court. The High Court said the trial court order did not suffer from legal infirmity or perversity. While upholding the charges against Seema and their two children, the court said they failed to report the incident to the authorities despite having knowledge. "The material available on record, including the categorical statements of the prosecutrix and the surrounding circumstances, sufficiently indicate that the said accused persons were aware of the commission of the offence and failed to report the same to the concerned authorities," it said. The husband-wife duo was arrested in August 2023 after the survivor recorded her statement before a magistrate at a hospital. Their children were granted anticipatory bail by the Supreme Court in January 2024. The case was registered under provisions of the POCSO Act and Indian Penal Code.
