Safety advocates urge passage of hands-free cellphone law
A call to action was made by a group of roadway safety advocates

AUSTIN, Texas - A Round Rock mom who lost her daughter to a distracted driver has joined an effort to create a statewide, hands-free phone law.
The call to action was made at the state capitol by a group of roadway safety advocates.
What they're saying
"Having to be on your phone all the time in the car is an addiction, just like drugs. It's a growing epidemic," said Karin Zaltsman who lost her daughter in a San Antonio crash.
Attempts to address that epidemic started more than 10 years ago. Several cities across Texas had ordinances restricting or outright banning cellphone use while driving. Austin was one of them.
But at the state capitol, those local efforts, which were described as patch work and government overreach, were scaled back to a ban on texting while driving. The only total ban is in school zones during school hours.
"The current statewide texting bill, enacted in 2017, is a step in the right direction, but it's limited in what it prohibits," said Kara Thorp with AAA Texas.
The backstory
SB 47 would amend the current law by restricting cell phone use in vehicles to only hands-free devices. It's called the Allie's Way Act.
"We could make history with this bill," said Jamie White.
Jamie White is involved in the reform effort because of what happened to her daughter, 2-year-old Allie. She was killed in a Round Rock parking lot back in 2019 while walking with her father.
"My husband was actually trying to pull her out of the way. This driver was so distracted that the kids in the back of her car were even screaming at her to get off the phone before she ran over my daughter in front of my husband," said White.
Under current Texas law, a distracted driving charge is not limited to texting. There are several actions done while traveling behind the wheel that could cause a citation:
Texting while driving
Being sleepy.
Eating and drinking.
Putting on makeup/ brushing hair.
Reaching for an object or a pet.
Adjusting the radio.
Talking to a passenger.
"Nationally, distracted driving kills over 3,300 people, or about nine people per day, including 400 Texans. In 2023. It also caused serious injury to 2,800 Texans.It's worth noting, however, that these numbers are likely significantly higher in reality, because when police are filling out their crash reports, it's unlikely that a driver is going to admit to being on their cell phone," said Thorp.
The Allie's Way Act could make enforcement less subjective, according to safety advocates like Jamie White.
"This is senseless. So, this bill would save lives. It would produce the consequences needed because Allie's killer got nothing. Walked away, killed my child and walked away Scot-free. Something needs to happen," said White.
What's next
Twenty-nine states have "Hands-Free Laws" on the books.
The Allie's Way Act was filed by Senator Judith Zaffirini (D) Laredo, and is currently awaiting a hearing in the Senate State Affairs committee.

Texas GOP seeks to ‘domesticate' rogue Dems for breaking quorum through nationwide civil arrest warrants
Texas Republicans, Attorney General Ken Paxton and House Speaker Dustin Burrows are seeking nationwide civil arrest warrants for the Texas House Democrats who broke quorum when they fled the state for Illinois and California. In the latest escalation of the redistricting debate taking national politics by storm, Paxton and Burrows are seeking to "domesticate" civil arrest warrants in Illinois and California for the Texas Democrats who fled the Lone Star State to block a Republican-led redistricting plan that could protect Republicans' slim U.S. House majority. "We are pursuing every legal remedy at our disposal to hold these rogue legislators accountable," Paxton said in a statement. "Texas deserves representatives who do their jobs instead of running away at the behest of their billionaire handlers. If there's one thing Texans can't stand more than losers, it's cowards." Burrows emphasized that "all options are on the table" to ensure House members return home to Texas to "fulfill their constitutional obligations." "The State has no choice but to pursue additional legal remedies to compel their return from other states. Our full focus is on stopping this dereliction of duty and restoring quorum in the Texas House as soon as possible so we may return our time, attention and resources where they most matter—on the critical issues of the special session call," the Republican House Speaker said. Burrows issued arrest warrants on Aug. 4 for the Democrats who fled Texas, under Article III, Section 10 of the Texas Constitution and Rule 5, Section 8, of the Rules of the Texas House of Representatives. According to the attorney general's office, it allows for "[a]ll absentees for whom no sufficient excuse is made may, by order of a majority of those present, be sent for and arrested, wherever they may be found." More than a week later, as Democrats have yet to return, Paxton and Burrows are seeking to implement their warrants in Illinois and California, through the Full Faith and Credit Clause of the U.S. Constitution. While the Texas Republicans argue that other states are obligated to adhere to official acts by the state of Texas, both Govs. J.B. Pritzker of Illinois and Gavin Newsom of California have come out in support of the rogue Texas Democrats, as their home states float their own redistricting plans to balance the scales if Texas Republicans are successful. The Democrats will not be detained and escorted back to Texas unless a state court in Illinois and California accepts Texas' civil arrest warrants. Once lawmakers leave the state, they are beyond the legal jurisdiction of Texas authorities who can compel their return, according to GovFacts, a nonpartisan educational resource that explains U.S. government legalities. However, if they were to return to Texas, the Texas Constitution would allow legislative leaders to "physically compel the attendance" of missing members through civil arrest warrants, allowing law enforcement to find the missing Democrats and return them to the Capitol. Paxton has also filed a lawsuit with the Texas Supreme Court, requesting that 13 House Democrats' seats are declared vacant because they fled the state to avoid the Trump-backed redistricting vote. The conservative attorney general also filed a lawsuit against former U.S. Rep. Beto O'Rourke, D-Texas, for allegedly conspiring to aid and abet Democrats' effort to break the quorum. According to the Courthouse News Service, Republican Tarrant County Judge Megan Fay issued a temporary restraining order against O'Rourke and his Super PAC, Powered by People, hours after the suit was filed "to stop using funds to pay for Democrats' travel expenses and conduct fundraising to pay for such expenses in the future." When reached for comment, a Pritzker spokesperson pointed to his past comments, addressing the threat of nationwide civil arrests, in which he said Illinois law enforcement will protect "everybody" in Illinois. And a Newsom spokesperson flagged his X posts, trolling the Texas Republicans and urging them to "come and take" democracy. O'Rourke did not immediately respond to Fox News Digital's request for comment.

Democrat lawmaker arrested for shoplifting again
A Democrat lawmaker recently turned himself in after being caught shoplifting for a second time at a Target store in Bethel, Connecticut. The New York Post reported that Connecticut state Rep. Raghib Allie-Brennan, a Democrat, is currently facing charges after turning himself in to police officials on July 28. The outlet noted that an arrest warrant for the 33-year-old Democrat lawmaker had been issued following the second shoplifting incident. In an arrest affidavit obtained by The New York Post, a Target security guard said they observed Allie-Brennan 'concealing items into the Goodfellow bag that he had selected.' The affidavit accused the Democrat lawmaker of attempting to steal $54.55 in unpaid goods. Allie-Brennan was previously arrested in June after police officials reviewed security footage that showed the Connecticut lawmaker trying to leave the Bethel Target location with $26.69 in unpaid items. The Democrat lawmaker admitted to the June incident; however, he blamed the shoplifting incident on being in a 'rush' to bring items to his hospitalized grandmother. In a July statement on Facebook, Allie-Brennan said, 'This week, I appeared in court and applied for Accelerated Rehabilitation, a program for first-time offenders that, if granted, can lead to dismissal of the charge after meeting court conditions. 'I am taking responsibility for all of my actions and participating in a program to address my behavior seriously and constructively,' the Democrat lawmaker added. 'I know I've let people down, and I'm not proud of that. But I also believe in owning mistakes and doing the work to make them right. I remain committed to accountability, growth, and continuing to serve my community with integrity.' According to The New York Post, Allie-Brennan told the outlet that both shoplifting charges are being addressed under the Accelerated Rehabilitation program. 'While we fully support Representative Allie-Brennan's due process and the presumption of innocence that all of us enjoy under our Constitutions, it is regrettable that, once again, a Democrat member of the Connecticut General Assembly has found themselves in handcuffs and subject to criminal prosecution.' Proto added, 'In light of these allegations, Representative Allie-Brennan should step down from his position.' Connecticut House Speaker Matt Ritter, a Democrat, also issued a statement regarding the Connecticut lawmaker's legal issues. Ritter explained that he had talked with Allie-Brennan about the shoplifting charges and expressed his concerns to the Democrat lawmaker. 'Raghib will take some personal time away from the legislature over the next month to deal with the legal, political and personal ramifications,' Ritter stated.
