Supreme Court sets 3-month clock for Telangana Speaker to act on defecting MLAs

The Supreme Court on Thursday directed the Speaker of the Telangana Legislative Assembly to decide within three months on disqualification petitions against ten BRS MLAs who joined the ruling Congress party after the 2023 Assembly elections.The case stems from a delay of over seven months in acting on disqualification pleas, prompting the Court to step in. The top court warned that leaving such cases unresolved defeats the very purpose of the anti-defection law, famously observing: 'Operation successful, patient dead.'advertisementThe case comes after some MLAs, nicluding Tellam Venkata Rao, Kadiyam Srihari, and Danam Nagender, were elected on BRS tickets but later shifted to the Congress.
BRS leaders KT Rama Rao, Padi Kaushik Reddy, and Kuna Pandu Vivekanand, along with BJP MLA Alleti Maheshwar Reddy, challenged the Speaker's inaction in the Telangana High Court.While a single-judge bench of the High Court directed the Speaker to fix a schedule for hearing the disqualification pleas within four weeks, the Division Bench later set aside that order, stating the Speaker could take a "reasonable time".The petitioners then approached the Supreme Court, which has now set aside the Division Bench's order and reinstated the Single Bench's direction, further tightening the timeline.The bench of CJI DY Chandrachud and Justice AG Masih observed that Parliament entrusted disqualification powers to Speakers to avoid delays in courts, but ironically, Speakers themselves are now delaying proceedings.The Court pointed out that no notice had been issued on the disqualification pleas for over seven months — a delay it said cannot be considered 'expeditious' by any stretch, Live Law reported.It noted that Speakers act as quasi-judicial authorities under the Tenth Schedule and do not enjoy constitutional immunity while doing so. The Court also reminded that in Kihoto Hollohan, a landmark judgement, judicial review of the Speaker's decisions was permitted in a limited manner, especially when there is inaction.The Court also barred the MLAs from trying to delay proceedings further and said adverse inference may be drawn if they attempt to do so.The Court urged Parliament to review whether entrusting disqualification decisions to the Speaker continues to serve the purpose of curbing political defections. Speaking at a public rally in Varanasi's Banauli village, Modi underscored that India is on track to become the world's third-largest economy amid growing international uncertainty. 'In such times, countries are focusing solely on their own interests. India, too, must remain alert to its own economic priorities,' Modi said, invoking a renewed push for Swadeshi. 'At a time when the world is going through uncertainty, let us take a pledge to sell only Swadeshi goods from our shops and markets. Promoting made in India goods will be the truest service to the country.' The remarks come days after Trump announced a 25 per cent import tariff on Indian goods, effective August 7, and warned of further penalties for India's ongoing purchase of Russian crude oil and military equipment. In a post on Truth Social, Trump said: 'They (Russia and India) can take their dead economies down together, for all I care.' After Trump's statement, India's response was measured. Commerce Minister Piyush Goyal told Parliament on Thursday that India remains the world's fastest-growing major economy and is widely expected to emerge as the third-largest globally in the near future. In his speech Saturday, Modi framed the global economic instability as a moment of opportunity for India. 'The feeling of Swadeshi in every action will define our future,' he said. 'This will also be a true tribute to Mahatma Gandhi. Only through collective effort can we fulfil the dream of a developed India.' He urged citizens to become conscious consumers and adopt the 'Vocal for Local' mantra. 'Whatever we buy, we should ask ourselves – has an Indian toiled to make this? If it has been made by the sweat of our people, with their skills, that product is Swadeshi for us.' The prime minister also called on all political parties to unite behind the goal of national economic advancement. 'If we want India to become the third-largest economy, every political party and every leader, keeping aside their hesitations, must work in the nation's interest and awaken the spirit of Swadeshi among the people,' he said.

Deputy Chief Minister Mallu Bhatti Vikramarka claimed that the 'secret meeting' between BRS working president K.T. Rama Rao and Andhra Pradesh IT Minister Nara Lokesh was a conspiracy of the BRS to extend full support to the Banakacherla project. Mr. Vikramarka issued a stern warning over what he called a conspiracy by BRS, BJP and TDP to compromise Telangana's interests in the name of the Banakacherla and Polavaram projects. He was speaking at a public meeting held in Kollapur constituency marking the launch of new electricity substations, the distribution of ration cards and allocation of Indiramma housing pattas. He questioned why the BRS government remained silent on Banakacherla for a decade. 'Only after Chief Minister Revanth Reddy and Irrigation Minister Uttam Kumar Reddy intervened in Delhi, was the proposal halted,' he said. Referring to A.P. IT Minister Nara Lokesh's comments that Telangana was wasting the flood water, he rebutted that flood water was available for A.P. only because Telangana's upstream projects were never completed. 'Only after securing our rightful needs will Telangana consider any discussion on Banakacherla,' he asserted. Mr. Vikramarka criticised former CM KCR for discarding the Pranahita-Chevella project and instead opting for the Kaleshwaram project. 'KCR spent ₹1.2 lakh crore on Kaleshwaram, which ultimately failed. Pranahita-Chevella could have been completed with just ₹38,000 crore,' he said, accusing BRS of redesigning projects merely to loot the treasury. Tourism and Excise Minister Jupally Krishna Rao and Nagarkurnool MP Mallu Ravi were among present.

Days after US President Donald Trump announced that a tariff of 25%, plus an unspecified penalty because of energy imports from Russia, would be imposed on Indian exports, Prime Minister Narendra Modi has said the world economy is going through a period of uncertainty and made a push for 'swadeshi' (made in India) products Addressing a rally in his constituency Varanasi on Saturday, PM Modi said India has to focus on its economic priorities and every citizen should resolve to buy 'swadeshi'. "Today, the world economy is going through many ups and downs. There is an atmosphere of uncertainty. In such a situation, every country is focusing on its own interests. India is also going to become the third-largest economy in the world and, therefore, has to be alert to its economic interests. Our farmers, our industries, employment for our young people, their interests - all of these are paramount for us. The government is making every effort in this direction," the Prime Minister said. "But, as citizens of the country, we also have some responsibilities... This is something not just Modi but everyone should keep saying. Anyone who wants to make India the third-largest economy in the world, any political party, any leader, should speak in the country's interest and instil in people that they need to resolve to buy 'swadeshi'... When we decide to buy anything, there should be only one measure: We are going to buy those things which an Indian has sweated to make. Anything that has been made by the people of India, using the skill of the people of India, by the sweat of the people of India, is 'swadeshi' for us. We will have to adopt the 'vocal for local' mantra," he explained. 'True Service' Calling for 'Make in India' products to be given an impetus, he urged people to resolve that all new things that they buy are 'swadeshi'. "And today, I would like to make a special request to my brothers and sisters from the business world, to shopkeepers, that when the when the world is going through such uncertainty, then even we will sell only local products. The 25% tariff was announced by Donald Trump on Wednesday - following it up with a jibe that India and Russia are "dead economies" - and the government has said it is studying the implications of the move and will take all necessary steps to safeguard India's national interest. Speaking in Parliament on Thursday, Commerce Minister Piyush Goyal had also said negotiations for a bilateral trade agreement are on. "The implications of the recent developments are being examined by the government. The Ministry of Commerce and Industry is engaged with all stakeholders, including exporters and industry, for taking feedback on their assessment of the situation. The government attaches the utmost importance to protecting and promoting the welfare of our farmers, workers, entrepreneurs, exporters, MSMEs and all sections of industry. We will take all necessary steps to secure and advance our national interest," the minister said.
