Three accused of kidnapping Palestinian computer expert get a lesser charge
This was after the Attorney-General's Chambers (AG-C) accepted their representation last week.
On the first day of a five-day trial today, Kuala Lumpur prosecution director Datuk Badius Zaman Ahmad informed High Court judge K. Muniandy that the charges under Section 325 of the Penal Code will be levelled on the first accused Edi Ko'im Said, ninth accused Muhammad Al Hatim Mohd Fauzi and 14th accused Mohd Azwan Jamaludin instead of the original Section 3 of the Kidnapping Act.
The representations were sent to the AG-C last month.
Section 365 reads kidnapping or abduction with intent, secretly and wrongfully, to confine a person, which provides for a jail term of up to seven years and a fine. Section 3 of the Act defines abduction, wrongful restraint or wrongful confinement for ransom, which carries the death penalty or life imprisonment.
The lawyers representing the accused - Lingswaran Singh, Goh Kim Lian and Adi Zulkarnain Zulkafli - confirmed that their clients were agreeable to the charge under Section 325.
Badius told the court that the representation of several of the remaining accused was still being considered by the AG-C.
As for the anti-money laundering charges, deputy public prosecutor Noor Zalizan Lazarous said the AG-C did not receive any representation from accused Nidarahayu Zainal, Raibafie Amdan and Tengku Arif Bongsu Tengku Hamid.
Muniandy then ruled that the alternative charges against the trio be read out to them on Thursday, as well as to hear the decision of the representation sent by other accused to the AG-C. If the representation of the accused is rejected, the trial will proceed.
The judge vacated the trial for tomorrow and Wednesday.
All accused were charged with the kidnapping of Omar Z.M. Al-Belbaisy to force him to deactivate computer software and hack into mobile phones in September 2022.
The 13 male accused are Mohamad Norakmal Hassan, Dody Junaidi, Tengku Arif Bongsu, Mohamad Naziree Mustapha, Faizull Hardey Mohd Isa, Muhammad Iqmal Abdul Rahis, Mohamad Sufian Saly, Mohd Zaidi Mohd Zain, Tengku Hazarul Ismail Tengku Hamid, Mohd Azwan Jamaludin, Raibafie Amdan, Muhammad Al Hatim Mohd Fauzi and Edy Ko'im.
The sole female accused is Nidarahayu, who is married to Raibafie. They are aged between 26 and 59.
Also on the prosecution were deputy public prosecutors Mohd Sabri Othman, Izalina Abdullah, Zaileen Nadia Zubir, Shahrizat Amadan, Zulhilmi Latif, Izzat Amir Idham and Shukor Abu Bakar.
The other lawyers acting for the accused were Muhammad Amin Abdullah, Wan Muhd Ariff Ameer Wan Normazlan and Goh Cia Yee.
In November last year, Muniandy granted each accused a RM50,000 bail with two sureties and imposed several additional conditions.
In 2022, they were charged with kidnapping Omar at Jalan Mayang here on Sept 28 with the intention to force him to deactivate computer software and hack into mobile phones.

Mum loses final appeal in defamation case filed by sons
PUTRAJAYA: A mother who defamed her two sons, both with the title 'Datuk' and are successful businessmen, has lost her final appeal against the decision that found her liable and ordered her to pay RM200,000 in damages, FMT reported. A three-member Court of Appeal bench chaired by Justice Azimah Omar said the High Court did not err in upholding a Sessions Court ruling that V.T. Menaka had lowered the reputation of M. Natarajen and M. Satishkumar, through a video posted on Facebook. "There is no appealable error that warrants appellate intervention. "Unfortunately, the sons had to take their mother to court," she said, adding that the plaintiffs had proved all the elements of libel. She said the 30-minute Tamil-language video, accompanied by a derogatory caption, had harmed the reputation of Menaka's sons. She said the appellant's defence of justification and fair comment is also not applicable. The other judges on the bench are Justices Wong Kian Kheong and Ismail Brahim. The court also ordered Menaka, 67, to pay RM20,000 in costs to her sons. Lawyer M. Manoharan, who represented Natarajen, 42, and Satishkumar, 41, said Menaka was classified as bankrupt after she had failed to pay the judgment sum and costs of RM10,750 as rdered by the Seremban Sessions Court in 2023. Menaka was ordered to pay RM100,000 in damages each to the sons. "She filed this appeal after obtaining consent from the Insolvency Department," he said. Lawyer Asmawi Ismail appeared for Menaka. In the posting made on Sept 19, 2020, Menaka claimed that her sons were 'big time' criminals, had forged her signature to remove her as a director of their family company Linsun Group of Companies Malaysia and wanted to kill her with a pistol.

Pendang police bust ‘Dika Bayu' cable theft gang
PENDANG: Police have dismantled the 'Dika Bayu' gang, known for stealing telecommunication substation cables, following the arrest of seven men in their 20s across Pendang and Sungai Petani since July 10. Pendang police chief Supt Rodzi Hassan said the first three suspects were caught cutting cables at a substation near Pokok Tai, Bukit Jenun. Further investigations led to the arrest of another suspect at a homestay in Taman Sinar Intan, Sungai Petani, where cable theft tools were seized. 'On July 13, two more gang members were arrested along Jalan Aman Jaya in Sungai Petani, along with a suspected 'fencer' who bought stolen copper,' Rodzi said in a press conference. The gang, all locals, allegedly rented boarding houses and vehicles to conduct thefts, funding their drug habits. 'They used Google Maps to scout substations and disguised themselves with safety gear to avoid suspicion,' Rodzi added. All suspects tested positive for amphetamine and methamphetamine and have prior theft and drug-related records. They are remanded until July 19 under Section 379 of the Penal Code. Police believe the arrests resolve 22 cable theft cases in Pendang since January, with losses estimated at RM145,000. The gang also operated in Sik, Yan, Alor Setar, and Penaga. - Bernama

GOF raids illegal Batu Gajah factory, seizes RM10mil worth of metal
BATU GAJAH: An illegal factory processing aluminium goods and scheduled waste in the Pengkalan Industrial Area near Pusing was raided on Wednesday (July 16), resulting in the seizure of 1,221.3 tonnes of metal worth approximately RM10mil, Sinar Harian reports. The Malay language daily reported that the raid, which took place at around 7:30pm Wednesday, was led by the General Operations Force (GOF) in collaboration with the Perak Environment Department (DOE) and the Batu Gajah District Council. Northern Brigade GOF deputy commander Asst Comm Shamsul Baharin Aman said that during the operation, a large amount of aluminium metal, as well as various machines and equipment believed to be used for illegal processing, were discovered. "This premises was conducting aluminium processing activities without a valid licence or permit under the Environmental Quality Act 1974. "In this raid, a 37-year-old local man, who claimed to be the factory manager, was arrested for further investigation," he told Sinar Harian at a press conference here on Thursday (July 17). He added that in addition to the aluminium metal, various equipment, including a lorry, was seized, with the total value reaching RM11.81mil. He noted that initial investigations revealed that the factory operator is believed to have been in operation for the past two years, with the assistance of 10 workers. "Each processed aluminium metal product would be shipped overseas through appointed agents. "The factory's estimated monthly profit is around RM20,000. We suspect there are elements of smuggling of raw materials brought in from abroad before being processed and re-exported," he said. Meanwhile, the Perak DOE director Datuk Dr Mohammad Ezanni Mat Salleh said that one of the main materials processed included industrial waste categorised under code SW422, which is a mixture of metals and chemical solvents known as a form of scheduled waste that is prohibited from being processed without a valid licence. "During the inspection, we observed burning with tyre pyrolysis oil, which is extremely serious when burned as it causes a noticeable odour if not properly controlled in the air," he said. The case is being investigated under provisions of the Environmental Quality Act 1974; Section 6 of the Secondhand Dealers Act 1946 and the Trade, Business and Industrial By-Laws 2017.
