
Mum loses final appeal in defamation case filed by sons
A three-member Court of Appeal bench chaired by Justice Azimah Omar said the High Court did not err in upholding a Sessions Court ruling that V.T. Menaka had lowered the reputation of M. Natarajen and M. Satishkumar, through a video posted on Facebook.
"There is no appealable error that warrants appellate intervention.
"Unfortunately, the sons had to take their mother to court," she said, adding that the plaintiffs had proved all the elements of libel.
She said the 30-minute Tamil-language video, accompanied by a derogatory caption, had harmed the reputation of Menaka's sons.
She said the appellant's defence of justification and fair comment is also not applicable.
The other judges on the bench are Justices Wong Kian Kheong and Ismail Brahim.
The court also ordered Menaka, 67, to pay RM20,000 in costs to her sons.
Lawyer M. Manoharan, who represented Natarajen, 42, and Satishkumar, 41, said Menaka was classified as bankrupt after she had failed to pay the judgment sum and costs of RM10,750 as rdered by the Seremban Sessions Court in 2023.
Menaka was ordered to pay RM100,000 in damages each to the sons.
"She filed this appeal after obtaining consent from the Insolvency Department," he said.
Lawyer Asmawi Ismail appeared for Menaka.
In the posting made on Sept 19, 2020, Menaka claimed that her sons were 'big time' criminals, had forged her signature to remove her as a director of their family company Linsun Group of Companies Malaysia and wanted to kill her with a pistol.

The projects build on the group's mini-hydropower project in Indonesia, which was acquired in August 2023 and also powered by run-of-river technology known for minimal environmental impact. Postponing SST expansion would jeopardise fiscal stability, says Anwar
KUALA LUMPUR: Any proposal to defer the expansion of the Sales and Service Tax (SST) would result in the government falling short of its revenue targets, said Prime Minister Datuk Seri Anwar Ibrahim. Anwar, who is also Finance Minister, said such a move would negatively impact the government's fiscal position and its ability to meet its responsibilities to the people. "The revision of the sales tax rate and the expansion of the SST scope, which took effect on July 1, is expected to generate additional revenue of RM5 billion over the six months of 2025 and RM10 billion for the full year of 2026," he said in a written parliamentary reply. He was responding to Lim Guan Eng (PH–Bagan), who had asked whether the SST expansion could be postponed until issues related to tariffs and the current economic slowdown are addressed. Lim also requested a breakdown of the additional tax revenue expected, specifically the share borne by citizens versus non-citizens. In reply, Anwar said it was not possible to accurately determine such a breakdown, as the national revenue collection system does not categorise contributions based on the taxpayer's citizenship. He said that the government was acutely aware of public concern over the rising cost of living. "Nonetheless, the government must also ensure that Malaysia's fiscal space remains sustainable, in order to finance its social and development obligations so that the benefits can continue to be channelled to the rakyat. "It is widely acknowledged that taxation is the most crucial source of revenue for any country. However, Malaysia currently has one of the lowest tax-to-GDP ratios in the region, at around 12 per cent, compared to the 15 per cent recommended by the World Bank to ensure the long-term sustainability of economic development," he said. The revised SST rates under Budget 2025 took effect on July 1. According to the Finance Ministry, the measure aims to bolster the country's fiscal position by increasing revenue and broadening the tax base. Under the updated structure, selected non-essential and luxury goods are taxed at rates between five and 10 per cent. Staple items such as sardines, tuna and mackerel (kembung) remain exempt, while premium imported seafood such as salmon, cod and king crab are subject to a five per cent SST. Local fruits are also exempt from the sales tax, whereas imported fruits incur a five per cent rate.

Businessman loses RM2.2 million in separate Facebook investment scams
KUANTAN: A businessman lost over RM2.2 million in separate scams just months apart this year, after falling for fake investment schemes advertised on Facebook. Pahang police chief Datuk Seri Yahaya Othman said that in May, the 45-year-old man was lured by a scheme and contacted an individual via WhatsApp. He then made 18 transactions totaling RM1.86 million to six bank accounts between May 14 and July 15, 2025. 'The victim received a return of over RM20,000, which convinced him to continue investing. However, last Tuesday, he was asked to make an additional RM88,000 payment for a 'fast withdrawal' process. 'He refused, and checks via the Semak Mule portal revealed the bank accounts involved had criminal records,' he said in a statement today. Yahaya added that previously, the victim fell for a similar scam, losing RM440,000 through 13 transactions between February and May this year. 'In this case, he did not receive any returns and was instead asked to pay a 20 percent 'tax' to withdraw the funds. He refused after suspecting it was a scam. 'As a result, the businessman lost over RM2.2 million, comprising his savings and money borrowed from friends,' he said. He added that the victim lodged a police report at the Maran police headquarters yesterday, and the case is being investigated under Section 420 of the Penal Code for cheating. - Bernama
