Ex-Kedah council officer guilty of misconduct over title misuse, rules court

The Court of Appeal today dismissed an appeal by Fakrurzy Aroff over his dismissal by the Padang Terap district council in Kedah four years ago.
PUTRAJAYA : The Court of Appeal has upheld the dismissal of a former assistant enforcement officer from a Kedah district council over multiple misconduct charges, including the unauthorised use of a state title.
A three-member bench, chaired by Justice S Nantha Balan, said the High Court judge did not fall into any error in dismissing a judicial review filed by Fakrurzy Aroff against the disciplinary board of the Padang Terap district council.
'Having looked at the appeal record and considered the submissions, we find no merit in the allegation of procedural impropriety or breach of the rules of natural justice,' said Nantha Balan.
The judge said the appellant had responded in writing to the charges of misconduct made against him and also appeared in person before the disciplinary committee prior to a decision being made.
Nantha Balan also noted that the appellant had not asked the council for discovery of documents and did not state that he wanted to call witnesses.
'In law, the right to be heard does not mean a right to an oral hearing of an adversarial nature as this is an internal disciplinary proceeding within the council,' he said, adding that Fakrurzy fell woefully short of the evidence required to exculpate himself of the charges.
Nantha Balan said the panel was satisfied that the High Court had correctly examined the case for the process that was employed and was right not to review the substance of the decision as that was within the province of the council's disciplinary body.
Highlighting the unauthorised use of the title Pingat Perkhidmatan Setia, the judge said the punishment of dismissal imposed by the disciplinary committee decision was fair, reasonable and proportionate given that it touched on the appellant's integrity.
'We find no reason to interfere with the High Court's decision to dismiss the judicial review,' he said in his broad grounds.
Also on the panel hearing the appeal were Justices Collin Lawrence Sequerah and Ahmad Kamal Shahid.
The bench also ordered Fakrurzy, 38, to pay the council RM10,000 in costs.
The facts of the case revealed that Fakrurzy, a contract worker, was on probation when he was dismissed from employment on Aug 22, 2021.
The first charge is related to his conduct in not issuing the uniform and accessories to a council staff member and the second for making a false claim amounting to RM32.05.
He was also charged with the use of a title although it was not stated in his service book.
A fourth charge was related to Fakrurzy's application for a bank loan, in which he described himself as a 'permanent' member of the council's staff although he was only a contract employee.
The misconduct took place between Jan 27 and March 31, 2021.
Fakrurzy responded to notices to show cause. However, the council decided to commence disciplinary action and the charges framed against him were made known on July 18, 2021.
He was asked to make a written representation to exculpate himself. Dissatisfied with the reply, the council decided to terminate his employment.
Fakrurzy then filed a judicial review at the High Court in Alor Setar, which was dismissed on Dec 14, 2022.
Lawyers Karim Lim, M Murgan and Clifford Ong represented the council while Siau Suen Min and Nurul Husna Halim appeared for Fakrurzy.

KLANG, June 7 — 'The incident happened very fast; the boat we were on capsized and filled with water before sinking,' recounted Chang Yan Qin Alvin, 17, who survived the overturned boat incident that claimed three lives in the waters of Tanjung Harapan yesterday. Chang is one of six individuals aboard the boat who survived, while two other victims are still missing. According to Chang, the tragedy occurred when the boat they were in, which was undergoing a test run, made an U-turn about 30 minutes after departing from the Royal Selangor Yacht Club (RSYC). 'The incident happened very quickly when the relatively fast-moving boat suddenly overturned, and in less than 10 seconds, water had entered all compartments of the boat. 'The situation inside the boat became chaotic, but I saved myself by trying to swim out before managing to sit on top of the overturned boat,' he said when met by reporters at the search and rescue location, Selangor Maritime Headquarters, in Tanjung Harapan today. Chang said he could only scream for help after realising other passengers were not visible and after about five minutes of holding on to the boat, another boat approached and rescued him. He said the fishermen in the boat then helped contact the authorities for assistance. 'I understand that this was the second test run for the boat, and before this, the boat was found to be in overall good condition,' he said, expressing sadness over the heartbreaking tragedy. In the incident around 5pm, three individuals, including a child, died, while a married couple is still missing. The victims are three-year-old Darren Gan, Cheu Son Hin, 50, and Fong Yong Sen, 29, while the missing victims have been identified as Gan Hon Tat, 32, and his wife Careen Man, 29, both from Klang Utama. — Bernama

KUALA LUMPUR, June 7 — The Malaysian Immigration Department (JIM) has denied issuing any statement regarding guidelines for the distribution of 'Qurban' (sacrificial) meat at mosques in conjunction with the Hari Raya Aidiladha celebration. JIM Deputy Director-General (Management) Ismail Mokhtar said the department was aware of the statement, dated June 5, 2025, that had gone viral. 'For the record, the statement is false and has never been issued by JIM,' he said in a statement here today. He also advised the public to always refer to the department's official channels for accurate and authentic information. 'JIM takes the dissemination of false information seriously, especially when it can lead to public confusion. Any unauthorised use of the department's official emblem and name is an offence and may be subject to legal action,' he added. The fake statement, dated June 5, 2025, that went viral, used the name of Immigration Director-General Datuk Zakaria Shaaban. Among the things claimed in the statement was that only foreign nationals with valid work permits and visas, or those with United Nations High Commissioner for Refugees (UNHCR) cards, were allowed to receive Qurban meat at mosques. It also said that illegal immigrants who collected the meat would face immediate action. — Bernama
