Kerala HC defers negotiation initiated by State with MSC on compensation for damage due to sinking of container ship
The interim order was passed on a public interest litigation (PIL) filed by T.N. Prathapan, former MP and the chairperson of Kerala Fishermen Coordination Committee, and others seeking a directive to the Union and State governments, among others, to release interim financial assistance to fishers and others affected by the ship's sinking and subsequent environmental concerns.

The other demands included constitution of a high-level expert committee to assess the damage caused to the marine environment and the coast, directive to the Indian Coast Guard, State government and the Kerala State Pollution Control Board to clear all waste, debris and chemicals from the ship and to clean up the marine environment.
While taking note of the affidavit filed by the State government informing that a committee had been formed to determine the compensation for the damage caused by the sinking, restoration of the coastal and marine environment, removal of wreckage and the economic losses caused to the fishers, the court questioned whether the out-of-court negotiations, particularly when a legal course of action under the Admiralty Act is still open, would result in a binding agreement. It further questioned whether it could have transparency, the extent of the damage assessed, and also whether the court's jurisdiction would be affected. Once the State has proposed to move the court, it would be appropriate that the avenue of negotiation is deferred.
On its part, the State government said the Special Secretary (Department of Environment) was appointed as the Principal Impact Assessment Officer and that it has been decided to take steps under the Environment Protection Act.
Meeting convened
In addition, the Minister for Fisheries convened a meeting with all stakeholders, and the Fisheries department has forwarded the loss assessment report to the Special Secretary.
Moreover, the Director General of Shipping has directed the State to submit an interim claim. The State also said that it has decided to file an admiralty suit against the company, including the arrest of a sister vessel of MSC.

The Kerala High Court has sought a report from the District Judiciary Registrar of the High Court regarding the pendency of criminal trials in the State owing to the delay in appointing scientific officers and other staff in forensic science laboratories. The Bench consisting of Chief Justice Nitin Jamdar and Justice C. Jayachandran issued the order while considering a petition filed by Kerala State Legal Services Authority (KeLSA) seeking a directive to the State government and the Kerala Public Service Commission (KPSC) to recruit adequate number of scientific assistants in the forensic labs. The KeLSA alleged that the vacancies and the failure to appoint scientific assistants in the labs adversely impacted the conduct of trials, particularly in Protection of Children from Sexual Offences (POCSO) and Narcotic Drugs and Psychotropic Substances (NDPS) cases. The KeLSA also referred to delays in appointing special public prosecutors in POCSO courts. The PSC's counsel said that there were procedural requirements and inherent time lag involved in appointments. Stating that continued inaction would affect Kerala's criminal justice system, the court directed the government and the PSC to coordinate and ensure that the vacancies are filled without delay.

In a rare political coincidence, leaders from opposing parties, divided by ideologies and allegiances but united by pending criminal cases, found themselves listed for hearings in three separate trials — all on the same day. Shipwrecks off Kerala coast: Will file admiralty suit in a week or two, state govt tells high court
Kochi: State govt has informed high court that an admiralty suit will be filed within one or two weeks, seeking compensation for the environmental and economic losses resulting from recent shipwreck incidents off Kerala coast. These submissions were made in response to public interest litigations filed by former MP T N Prathapan and others, seeking a comprehensive compensation and rehabilitation package for fishermen and other stakeholders affected by the recent shipwrecks. While considering the petitions, the bench of Chief Justice Nitin Jamdar and Justice Basant Balaji observed that some other suits have already been filed in connection with compensation claims arising from the same incidents. The advocate general clarified that those suits were filed by the owners of goods that were lost aboard the vessel. He added that there remains some uncertainty regarding the ownership of the cargo vessel MSC ELSA 3, as the vessel's managers have claimed it was under the operation of another registered entity. He stated that the ship is a containership registered under the ownership of ELSA 3 Maritime Inc. The bench, however, reminded the state that the ongoing data collection should not delay the filing of the admiralty suit. The court accordingly adjourned the petitions to July 15. Charles George, one of the petitioners, alleged that the shipping company had terminated the contract with a salvage agency and appointed a new one, which, he argued, could affect the progress of salvage operations. The company responded that the change was made for valid reasons and would not impact the ongoing operations. The court directed the director general of shipping to examine the issue and respond to the petitioner's concern by the next posting date.
