
Delay in appointing scientific officers, staff in forensic science labs: Kerala HC seeks report
The Bench consisting of Chief Justice Nitin Jamdar and Justice C. Jayachandran issued the order while considering a petition filed by Kerala State Legal Services Authority (KeLSA) seeking a directive to the State government and the Kerala Public Service Commission (KPSC) to recruit adequate number of scientific assistants in the forensic labs. The KeLSA alleged that the vacancies and the failure to appoint scientific assistants in the labs adversely impacted the conduct of trials, particularly in Protection of Children from Sexual Offences (POCSO) and Narcotic Drugs and Psychotropic Substances (NDPS) cases.
The KeLSA also referred to delays in appointing special public prosecutors in POCSO courts. The PSC's counsel said that there were procedural requirements and inherent time lag involved in appointments.
Stating that continued inaction would affect Kerala's criminal justice system, the court directed the government and the PSC to coordinate and ensure that the vacancies are filled without delay.

Shimla: The Una special court under the Protection of Children from Sexual Offences (POCSO) Act has sentenced Kewal Krishan, 43, to 25 years of rigorous imprisonment and imposed a fine of Rs 50,000 for the repeated rape of his 13-year-old motherless niece in 2023. Additionally, the convict received one year of imprisonment and a fine of Rs 5,000 for threatening the survivor. "In the case in hand, the victim was the niece of the convict and was under the age of 16 at the time of the incident. Thus, the convict was supposed to protect her, but instead of protecting her, he ravished her. Hence, if leniency is shown to such an offender, it will give the wrong message to society," reads the judgment pronounced by special judge Naresh Kumar on July 3. However, the special judge mentioned that considering all facts and circumstances on record, it cannot be said that the present case fell in the category of the rarest of rare cases, and as such, the penalty of death is not called for. The survivor submitted that for four months, when her father was not home, her uncle raped her and threatened her not to reveal the abuse.

ADGP's advisory to keep women police officers off security duty kicks up row
Chennai: Activists and women professionals slammed additional director-general of police (law and order) S Davidson Devasirvatham's recent advisory to not deploy women officers for security duty. While they said it was discriminatory, the state police issued a clarification on Saturday saying the instructions were meant to speed up the investigation of Pocso cases and not to discriminate against women officers. A joint statement signed by 43 women professionals from different walks of life, including retired IPS officer Thilagavathi and advocate Sudha Ramalingam, condemned the ADGP's advisory and called it discriminatory in nature and urged its retraction. On June 30, while addressing an internal meeting, ADGP Devasirvatham instructed his subordinate officials not to deploy women officers for security duties of importance and, instead, asked them to assess how many women police personnel, armed reserve personnel, and special police teams would be required in security duty well in advance.
