Philippines: Can Duterte serve as mayor of Davao while in detention?

Khaleej Times21-05-2025

Former Philippine president Rodrigo Duterte has been overwhelmingly elected to serve as mayor of his hometown. But there is a big legal and moral dilemma as he is currently detained at the International Criminal Court (ICC) in The Hague over alleged crimes against humanity.
In an interview with online news magazine Davao Today, constitutionalist Tony La Viña explained 'there are three steps that Duterte must take before he can officially serve as Davao's mayor.'
First, Duterte must be proclaimed the winner of the Davao City election. This has been fulfilled. 'His presence is not required for such a proclamation,' La Viña, who is also a professor of law, noted.
Second, which is yet to be done, is the question of where can Duterte take his oath, and who will administer it?
La Viña said 'the oath taking must be done on Philippine soil.' This means, Duterte has to take an oath at the Philippine Embassy in the Netherlands and before a government official with authority. 'The official can be the ambassador or any other official – like a barangay captain from Davao or his daughter (Sara), who is vice president,' added La Viña.
Now, the question is: Will the ICC or the Marcos government allow Duterte to leave detention and do the oath-taking? La Viña noted 'the Philippine government must agree to this, and the ICC must also allow it. Practically, therefore, the answer is no. Why would President Marcos allow it? And why would the ICC permit it, establishing a negative precedent for other detainees?'
Duterte was arrested and brought to The Hague, Netherlands, on March 11 to face the ICC for allegations of crimes against humanity committed during his administration's anti-narcotics campaign.
Duterte could become the first Asian former head of state to go on trial at the ICC. Although the Philippines – under Duterte administration – officially withdrew from the international court, the ICC maintains it has jurisdiction to prosecute alleged crimes committed before Duterte withdrew the Philippines from its founding treaty in 2019. Cases include alleged killings by a "death squad" in Davao while Duterte was mayor before he became the president in 2016.
The third step for Duterte is to assume office in Davao's City Hall. La Viña told Davao Today even if Duterte succeeds in taking his oath, the third step, which is to assume office in Davao's City Hall, is impossible.
'Even if he does succeed in taking his oath, which he must do in six months after the election, he cannot assume office, as that requires physical presence in Davao City,' said La Viña, who is also a professor of law, philosophy, politics and governance in several universities in the Philippines.
La Viña asked: 'How will he sign the papers that signify that he will now assume office? That he will make decisions, like the budget? How can he do that when he is in The Hague'?
What happens then?
If Duterte will not be able to pass the second and third steps, La Viña said 'it will be the elected vice mayor, who is Duterte's son, Sebastian, who will assume the role of acting mayor. If Duterte will not be able to take his oath within six months after his proclamation, Sebastian will be declared as the mayor of Davao.
Following the order of succession in the Philippine local government, the elected city councillor with the highest number of votes in the recent election will assume the vice mayoral post. The top councillor in the election is the neophyte grandson and namesake of Duterte, Rodrigo 'Rigo' II.

Trump to attend Nato summit, White House confirms

The White House on Tuesday said US President Donald Trump would attend the Nato summit this month, amid his administration's efforts to end the war in Ukraine and have alliance members increase their defence spending. The high-profile meetings, which will be held in The Hague from June 24-25, will come shortly after Mr Trump is set to attend the Group of Seven leaders' summit in Canada, where allies are also expected to discuss a peace deal that would end Russia's war in Ukraine. White House press secretary Karoline Leavitt said the President "remains positive at the progress" in the talks. "The President does not want to see this war prolonged," she told reporters. "He wants the fighting to stop, he wants people to stop dying, and he wants this to be solved at the negotiating table." On Monday, delegates from Russia and Ukraine met briefly in Istanbul for a new round of talks. The day before, Kyiv unleashed a surprise drone offensive that hit Russian heavy bombers and surveillance planes Mr Trump took office this year on a promise to swiftly end the war in Ukraine and end US military aid to Kyiv. He has also advanced an "America First" approach to foreign policy, questioning continued US membership in Nato. He has pushed for members of the alliance to spend larger rates of their gross domestic products on defence, saying European states, which are geographically closer to Ukraine, should do more to support Kyiv. At the same time, Mr Trump has resisted calls, including from his own Republican Party, to impose additional sanctions on Russia as pressure to agree to a ceasefire. "The President has spoken about his position on sanctions on Russia," Ms Leavitt said. "He has smartly kept this as a tool in his toolbox, if necessary."

Verreynne charged up as Proteas eye WTC Final glory

'I just remember being in that dressing-room and feeling just how calm everyone was. Yes, there was tension. Yes, there was pressure. But there was just this great feeling that 'we can do this', and I could see it around the room,' he recalled. The belief within the team translated into results over time as the Proteas only grew stronger over the course of the WTC cycle, winning seven Tests on the trot to seal their spot in the main event. Verreynne, in particular, came into his own with timely performances - often in tough situations. His match-shaping century in Mirpur, gritty knocks down the order, and an unbeaten 105 in Gqeberha are all examples of his selfless approach and situational awareness, and Verreynne is not driven, in his own words, by headlines, but by character. 'My job at six or seven is not always about scoring big runs. Sometimes it's a quick 40 to set a target, or a fighting 30, batting with the bowlers. It is always very nice to contribute to the team and make an impact on the game.' 'To me, character is about a few things. Never giving up. Getting it done. Showing fight.' Verreynne and the Proteas gear up for an interesting fight in testing conditions as they look to grab hold of their first ICC event title in over two decades against an Australian side that is known to step up when the conditions are the toughest.

Pakistan to play in Colombo when India hosts Women's World Cup

Pakistan will play all their women's 50-over World Cup matches in Sri Lanka's capital Colombo when India hosts this year's tournament, the International Cricket Council (ICC) said on Monday. Politically-estranged India and Pakistan, who have not played a bilateral series since 2013, will play their matches in neutral venues when either country hosts an ICC event, the sport's global governing body announced in December. "The venues for the knockouts are dependent on Pakistan qualifying as two alternative venues have been identified for one semifinal and the final," the ICC said. "Colombo will be the venue for the first semifinal and the final only if Pakistan qualify for those stages." Bengaluru, where the tournament will start with India playing in the opening match, will host the final on November 2 if Pakistan are knocked out earlier in the tournament, the ICC added. Bengaluru will also stage the second semifinal on October 30, a day after the first semifinal in Colombo or Guwahati. Visakhapatnam and Indore are the two other host cities for the eight-team tournament. India played all their matches in Dubai when Pakistan hosted the men's Champions Trophy this year, including the final which they won. Both the Indian Premier League (IPL) and the Pakistan Super League were suspended last month amid clashes between the two countries following an attack targeting tourists that killed 26 people in Kashmir in April. Matches resumed after a ceasefire was announced. The neutral venue arrangement between the countries will also be in place for the men's T20 World Cup in 2026, which India will co-host with Sri Lanka, and the women's T20 World Cup in 2028 in Pakistan.
