Naimah granted leave to challenge LHDN's RM313.8mil tax claim

SHAH ALAM : The High Court here has granted leave to Naimah Khalid, the widow of former finance minister Daim Zainuddin, to commence judicial review proceedings to challenge the Inland Revenue Board's (IRB) tax claim of RM313.8 million.
Her counsel S Saravana Kumar said the court was satisfied that his client's application for leave had merit.
Speaking outside the courtroom, Saravana Kumar said Justice Shahnaz Sulaiman held that Naimah's application was neither frivolous nor vexatious, and that it raised legal questions warranting a substantive hearing.
Federal counsel Sheryn Yong appeared on behalf of the Attorney-General's Chambers.
On Oct 18, 2024, the same court dismissed Naimah's application for a temporary stay of the order requiring her to settle RM313.82 million in income tax arrears to the LHDN.
The court had ruled that there were no exceptional circumstances to justify the stay and affirmed that LHDN was empowered under the Income Tax Act 1967 to enforce collection.
However, on Oct 28, 2024, the Court of Appeal unanimously allowed Naimah's application for a temporary stay of the payment order.

National Youth Day Celebration To Showcase Elements Of ASEAN

Vikneswaran KUALA LUMPUR, June 7 (Bernama) -- The National Youth Day (HBN) celebration on June 13-15 will be unique as it will showcase elements of ASEAN, in line with Malaysia's Chairmanship of ASEAN 2025. The HBN Secretariat said the programme for the celebration at Dataran Merdeka includes the ASEAN Pavillion and ASEAN Concert to create the spirit of the ASEAN community and strengthen the culture of ASEAN countries among the youth. "The role of youth is seen as vital to strengthening ASEAN's regional network, particularly future collaborations in the fields of economy, leadership, education, technological innovation and social. In fact, youth can also act as junior ambassadors who can elevate the country's image globally,' it said in a statement. Themed "Yakin Boleh' (Believe You Can), the highlight of the 61st HBN celebration will be attended by Prime Minister Datuk Seri Anwar Ibrahim, who will officiate the event and present the 2025 National Premier Youth Award (APBN) on June 14. "The theme illustrates the confidence, capability and competitiveness of the youth in facing challenges, including that of the current digital era. MACC to file application to forfeit Ilham Tower

(Website pic) PETALING JAYA : The Malaysian Anti-Corruption Commission will file an application to forfeit the Ilham Tower in Kuala Lumpur next week, says its chief, Azam Baki. Azam said the forfeiture application would be filed under Section 55 or 56 of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (Amla), Utusan Malaysia reported. Section 56 of Amla provides for the forfeiture of property where there is no prosecution, if a High Court judge is satisfied that the asset was the subject-matter or evidence relating to the commission of an offence under the Act, the proceeds of an unlawful activity, or the instrumentalities of an offence. MACC first seized the 274m-tall tower owned by the late Daim Zainuddin and his family under the MACC Act in December 2023. It previously said it could seize the tower for up to 18 months pending investigations. Yesterday, it announced it had seized the tower again, this time under Amla. Daim's widow, Naimah Khalid, plans to challenge the seizure in court. Last month, MACC opened eight new investigation papers into 'high-value' assets linked to Daim and his family members after receiving new information from overseas.
