
Workers' rights: Union members tend to become spectators while leaders take decisions

As thousands of workers yesterday marked May Day, a labour expert says the Labour Relations Act (LRA) has affected working conditions.
This has been strengthened by labour federations Cosatu and Saftu being united in opposition to the value-added tax (VAT) hike and amendments to labour laws.
Prof Lucien van der Walt, of Rhodes University's economics and governance department, lauded the LRA as the first legislation in the country's history to provide all workers 'access to a formal industrial relations machinery.'

This, said Van der Walt, included protected strikes and other measures from which unions benefited.
'Until the late 1970s, such legislation excluded black African workers, who were confined to a separate, labour-repressive system,' he said.
'The changes in the 1980s facilitated massive union growth, with Cosatu membership growing from 450 000 in 1985 to well over two million in the 2000s.'
'Downsize'
However, Van der Walt said the downside of the LRA was that 'it – like its predecessor, the Industrial Conciliation Act – is based around time-consuming and bureaucratic processes'.
'For workers to have a protected strike, other avenues provided to resolve the issues must be exhausted,' he said.

'Unions get entangled in lengthy and complicated procedures. This affects how unions work, with members left out.
'Rather than driving and controlling, members tend to become spectators, with organisers and leaders focusing on the legal system, rather than on worker mobilisation and education.
'Organisers and leaders also get more power through their know-how and often make decisions without direction from members.

'So, over time, the LRA has fostered a much more top-down, passive approach to trade unionism,' he added.
Employment equity
Employment equity (EE) – currently a bone of contention between the right and left of SA's political spectrum – 'has had a major effect'.
'The SA workforce was historically highly shaped by race and sex. Essentially, white workers dominated many skilled and better-paying jobs, including government,' said Van der Walt.
'Women of all races were locked out of many occupations.
'EE measures have shifted this situation, most notably in government, which is by far the biggest single employer.

'There have also been changes in the private sector. There has been enormous pressure to have what has been deemed a more representative workforce. 'But EE has had little effect on people living with disabilities.'
Van der Walt said EE limitations included:
Measures expressed in law and policy, not intended to act as a simple quota system reserving jobs by race or sex; and
Fostering racial tensions among workers through conflicts over jobs and promotions.
'The reality that EE is simply unable to address broader problems of widespread low-wage work, job insecurity and unemployment,' he said.
'Conflicts over EE would be less serious if there were more jobs and better jobs. There would be less competition for a small number of skilled, well-paid jobs and less stress for people who lost jobs.
'But EE, by its nature, is focused on the redistribution of fairly small numbers of well-paid and skilled jobs.'
'Anti-worker labour laws'
In his May Day message, Saftu secretary-general Zwelinzima Vavi said workers across the labour movement were 'united in opposition to the VAT increase and anti-worker labour laws'.
'Comrades, we meet at a moment of profound danger, with the working class under siege. Brutal austerity is ripping apart our communities. Corporate profiteering is driving hunger and homelessness,' said Vavi.
'The bosses and their government are not stopping at VAT. They are unleashing a direct assault on worker rights through vicious labour law amendments and a draft code of good practice on dismissal.
'These are not technical changes, but are rather a blatant declaration of war on the working class. Saftu calls for mass resistance against these betrayals,' he added.
Cosatu said it remained opposed to proposed amendments to labour law, which followed extensive engagements between labour and business at the National Economic Development and Labour Council, with similar public hearings held in parliament.
According to Cosatu national spokesperson, Matthew Parks, changes to the law included 'adapting employment equity targets to take into account regional demographic diversity and to adopt more focused targets for sectors falling woefully behind employment equity'.

AI must serve labour, not subjugate it, G20 labour group says
Graphic: John McCann/M&G Labour 20, the G20's employment track, has called for the reclassification of workers in the digital economy, where many are labelled as 'independent contractors', which it said enables exploitation and strips workers of core rights. 'Platform workers are being misclassified, denied basic protections and subjected to inhumane working conditions by companies that exploit regulatory gaps. We believe that this is not innovation but is exploitation wrapped in code,' it said in a communiqué. 'We call for international standards to ensure cross-border accountability, worker data sovereignty and fair taxation of platform giants. Technology must serve labour, not subjugate it.' G20 working groups have made similar recommendations ahead of the November summit of heads of state, with the South Africa, which holds the current Workers in the digital economy are effectively outside the law, Cosatu head of policy Lebogang Meelis told the Mail and Guardian. 'People working in the digital economy who are classified as independent contractors are not recognised as workers. As such, they are not covered by labour legislation and this leaves them vulnerable to severe exploitation,' she said. These workers can't join trade unions, have no protection from unfair dismissals and are excluded from unemployment insurance and collective bargaining. 'They are not afforded a process to try and protect them from retrenchment and minimise the negative impact,' Meelis said. Fedusa general secretary Riefdah Ajam described the 'independent contractor' label as 'a deliberate tactic used by capital and employers to strip them of basic rights'. Contractors, she said, 'are required to work full days and answer to supervisors — whether human or algorithmic', yet are denied basics like UIF, paid leave and the right to unionise. 'The platforms that use this model get away with avoiding responsibility and, ultimately, being non-compliant with the labour laws and other rights as provisioned for in the Constitution and other statutes,' Ajam added, warning that if unions don't push back, a rights-based labour system could soon be a thing of the past. Labour 20 called on governments to implement mandatory due diligence and public oversight of all digital labour platforms operating within their borders. The summit rejected 'digital colonialism', declaring that the infrastructure of the digital economy 'must be public, universal and democratic'. 'We further demand algorithmic transparency, where workers have access to the data that governs their performance and livelihoods. No worker should be at the mercy of a faceless system they cannot question,' it said in its communiqué. Fedusa wants tough regulations that force platforms to disclose how they treat workers, what algorithms they use and where their profits go. The union also backs penalties for non-compliance and calls for stronger local ownership of the digital economy. 'We can't outsource our future to companies who see us as a market but never as equal partners. This is about sovereignty, dignity and economic justice,' Ajam said. With more than 60% of workers globally 'trapped in informal and precarious employment', Labour 20 called for 'a comprehensive agenda for formalisation'. Recommendations included labour law reform, strengthened inspections, ratification of International Labour Organisation conventions and inclusive social protection. 'Trade unions must be at the centre of this shift. We affirm that informal workers are workers. Their rights are not negotiable,' said the communiqué. Governments and employers, it said, must end delays and move decisively toward institutionalising decent work. Meelis said Cosatu had secured a win through negotiations at the National Economic Development and Labour Council with the government agreeing to allow atypical workers — including actors and digital platform workers — to join unions and engage in collective bargaining. However, Meelis said the deployment of AI risks deepening inequality. 'In the short term, more women risk losing their jobs than men — particularly because the initial impact of AI will be the replacement of administrative jobs, which are predominantly held by women workers.' 'If we are to address inequality and not exacerbate it, digital transformation must not outpace social integration,' Meelis added. 'If someone works regularly for a platform, follows set conditions and depends on that income, they should be presumed an employee until proven otherwise. That's how fairness can be restored.' South Africa's labour laws haven't caught up with the gig economy, Ajam said. 'We need them amended so that platform workers are clearly included.' She also criticised new terms like 'dependent contractors' as potential loopholes for further abuse. 'Any new category must carry full protections.' Ajam wants the International Labour Organisation to adopt a binding convention on platform work. 'It should cover fair pay, set working hours, access to benefits, transparency around algorithms and the right to organise.' The communiqué also noted that 'workers are facing spiralling inequality, stubborn unemployment, rising authoritarianism, deepening climate devastation and collapsing public services'. 'In the Global South, these crises are compounded by debt, weak state capacity and the brutal legacies of colonial exploitation. Our call is simple and unwavering: the working class will not pay for the failure of a system rigged against them.' Labour 20 said workers' futures should not be 'sacrificed at the altar of profit and geopolitical power', urging a 'reclaiming and rebuilding' of multilateralism and a reversal of the declining labour share of income. 'Workers are not commodities nor statistics. We are the architects of society, and any global recovery that excludes them is a blueprint for deeper inequality,' the communiqué said.

Cosatu: Tariffs will lead to a jobs bloodbath

They say the 30-percent tariffs the US imposed on South African exports will devastate the sector and job losses are inevitable. Cosatu says it is extremely concerned by the impact of the 30% tariff announced by the United States on all South African exports bar minerals, to the world's largest economy. The trade union federation says it fears the devastation this will wreak upon farm workers in the citrus industry from the Western Cape to Limpopo, to motor manufacturing workers from the Eastern Cape to Gauteng.

Prasa revises fare structure after public outcry

Image: Picture: David Ritchie The Passenger Rail Agency of South Africa (Prasa) has made significant changes to its fare structure in response to intense objections from trade unions, commuter groups, and civil society organisations, just before the planned fare increase. This follows days of escalating pressure, with the United Commuters Voice (UCV) announcing that the new fares will now offer more affordable rates for working-class commuters, ensuring better access to public transport. The Congress of South African Trade Unions (Cosatu) was among those that voiced concern ahead of the increase, calling for fare adjustments to be tied to inflation and warning that steep hikes would alienate commuters still reeling from the high cost of living. 'While Cosatu welcomes the huge improvements Prasa has made to its infrastructure as well as the rollout of the new trains, the federation believes the proposed ticket price hike is high and will be burdensome to commuters who are already battling to cope,' said Tony Ehrenreich, Cosatu deputy parliamentary coordinator. The federation argued that Prasa should use this period to rebuild public trust by positioning itself as the primary transport option for the working class. 'To achieve this, the federation urges Prasa to limit the fare increase to the prevailing inflation rate,' it said. The new Prasa fares that came into effect on Friday. Image: Prasa It also cautioned that a sharp increase could reinforce negative perceptions from the past when Prasa was known for mismanagement and unreliable service. Instead of driving up ticket costs, Cosatu recommended attracting more passengers to improve revenue. 'Prasa should steer clear of implementing a price increase that will change the cost structure of rail transport fees,' Cosatu said. 'While mindful of the significant investment in infrastructure, the rail agency should aim to recoup costs by swelling the number of commuters rather than relying solely on increased fare contribution.' Cosatu added that any fare increases above inflation should only be implemented after public transport subsidy policies are finalised through Nedlac. UCV, which led coordinated objections with support from commuters, labour, and community groups, confirmed that Prasa has now backed down from its initial fare plan. 'The fare increase, originally scheduled for full implementation on 1 August 2025, has now been adjusted downwards to reflect more affordable rates that take into account the financial strain on low-income commuters,' said UCV National Chairperson Paul Soto. 'We thank all stakeholders who stood in solidarity with us against the initially proposed fare hikes that were threatening affordability and access to public transport,' Soto said. 'Your voices have made it clear that decisions affecting the poor must be made in consultation with the key stakeholders.' The new structure includes lower monthly ticket increases than those originally communicated, and discounts for school children, military veterans, and senior citizens. • Monthly ticket increases have been scaled down. • Pensioners and military veterans will retain their 50% off-peak discount• Schoolchildren in full uniform will receive a 50% discount at all times. • A 40% off-peak discount remains in place for general commuters travelling between 9am and 2pm. Prasa said the updated fares had been approved by the Minister of Transport and noted that this was its first fare adjustment in 10 years. 'Despite these adjustments, rail remains South Africa's most affordable public transport mode,' Prasa stated in its official announcement. The agency confirmed that the amendments were made after identifying discrepancies in the original fare table and following feedback from commuter stakeholders. It said the changes would support improved service delivery, safety, and reliability across the Metrorail network. Both Cosatu and UCV reiterated their commitment to advocating for an affordable, safe, and reliable public transport system. Cosatu also signalled its readiness to help fast-track policy processes at Nedlac that ensure fare increases are equitable and rooted in commuters' lived realities.
