Labour urged to publish impact of rent reforms as eviction delays soar
Government departments are required to complete a justice impact assessment for any new bills that are likely to impact the UK courts system.
Labour's Renters' Reform Bill is set to become law this summer and will include the removal of Section 21 'no-fault evictions'.
There are fears the change will force landlords to rely on the courts to regain possession of their properties, adding to existing backlogs.
Private landlords faced an eight-month wait from making a claim to the courts to their properties being repossessed in the first four months of 2025, according to the latest government data.
Chris Norris, chief policy officer for the National Residential Landlords Association, said: 'The justice system is simply not ready for the impact of the Bill.
'In the interests of transparency, the Government should publish the Justice Impact test. The Government also needs to come clean about how it defines the courts being ready for the reforms. Warm words are no substitute for clear objectives for the justice system.'
Justice impact assessments are an internal process and not usually published by government departments, but previous ministers have committed to publishing court reviews ahead of implementing rental reforms.
The former Levelling Up, Housing and Communities Committee in a 2023 report said: 'It is not clear whether the Government fully appreciates the extent to which an unreformed courts system could undermine its tenancy reforms.'
Furthermore, in a consultation in 2022, the then-government acknowledged that Section 21 was preferred by landlords to other means of eviction – such as Section 8 – as it was perceived as 'quicker and more certain'.
Richard Atkinson, president of the Law Society, said of the Renters' Rights Bill: 'The bill will not be effective without further investment in the justice system.'
Mr Atkinson also urged the Government to 'provide greater funding and more clarity to the enforcement provisions so that justice is accessible to renters and landlords alike'.
In addition to concerns about the justice system, a report has warned impacts of the bill will add almost £900 a year to the average tenancy. The legislation will limit landlords to just one rent increase per year capped at the 'market rate' – the price that would be achieved if the property was newly advertised to let.
Landbay said property owners were planning to increase rent by an average of 6pc, which would add £74 to the average monthly rent, or £888 a year.
Dr Neil Cobbold, director at property software company Reapit UKI, said: 'The Government's decision not to share the Renters' Rights Bill justice impact test raises serious questions about transparency and accountability. The estimate of changes in the number of court and tribunal cases is a vital tool for understanding how the legislation will affect the property sector – including case volumes – and whether the justice infrastructure is in place to support the change.'
The Bill is currently going through the House of Lords before being sent back to the Commons and is expected to receive Royal Assent by summer 2025 and be implemented before the end of the year.
An MHCLG spokesman said: 'As was the case under previous governments, Justice Impact Tests are internal government documents and it is not standard practice for them to be published.
'We are fully focussed on ensuring the justice system is ready for our reforms, which will create a fairer housing market, and are working closely with the Ministry of Justice and HM Courts and Tribunal Service to ensure all necessary preparations are in place.'

They should never complain about a lack of finance as they have wasted between £60 and £70 million on the Queensway Area. Talk about a white elephant. Badenoch urges Tory councils to challenge asylum hotels in court
Kemi Badenoch has called for more Conservative councils to launch legal challenges over asylum hotels as the Government faces a potential revolt from its own local authorities. In a letter to Tory councils, Mrs Badenoch said she was 'encouraging' them to 'take the same steps' as Epping Council 'if your legal advice supports it'. Labour dismissed her letter as 'desperate and hypocritical nonsense', but several of its own local authorities have already suggested they too could mount legal action against asylum hotels in their areas. Epping secured a temporary injunction from the High Court on Tuesday, blocking the use of the Essex town's Bell Hotel as accommodation for asylum seekers on planning grounds. The decision has prompted councils controlled by Labour, the Conservatives and Reform UK to investigate whether they could pursue a similar course of action. These include Labour-run Tamworth and Wirral councils, Tory-run Broxbourne and East Lindsey councils and Reform's Staffordshire and West Northamptonshire councils. But Labour's Newcastle City Council and Brighton and Hove City Council have both ruled out legal action. Tuesday's High Court decision has also caused a potential headache for the Home Office, which has a legal duty to house destitute asylum seekers while their claims are being dealt with. If planning laws prevent the Government from using hotels, ministers will face a scramble to find alternative accommodation, potentially in the private rented sector. In her letter, Mrs Badenoch praised Epping Council's legal challenge and told Tory councils she would 'back you to take similar action to protect your community'. But she added that the situation would 'depend on individual circumstances of the case' and suggested Tory councils could pursue 'other planning enforcement options'. She also accused Labour of 'trying to ram through such asylum hotels without consultation and without proper process', saying the Government had reopened the Bell Hotel as asylum accommodation after the Conservatives had closed it. The hotel had previously been used as asylum accommodation briefly in 2020 and then between 2022 and 2024 under the previous Conservative government. A Labour spokesperson said Mrs Badenoch's letter was a 'pathetic stunt' and 'desperate and hypocritical nonsense from the architects of the broken asylum system', saying there were now '20,000 fewer asylum seekers in hotels than at their peak under the Tories'. The letter comes ahead of the publication on Thursday of figures showing how many asylum seekers were being temporarily housed in hotels at the end of June this year. Home Office figures from the previous quarter show there were 32,345 asylum seekers being housed temporarily in UK hotels at the end of March. This was down 15% from the end of December, when the total was 38,079, and 6% lower than the 34,530 at the same point a year earlier. Figures on those staying in hotels date back to December 2022 and showed numbers hit a peak at the end of September 2023, when there were 56,042 asylum seekers in hotels. Data is not released on the number of hotels in use, but it is thought there were more than 400 asylum hotels open in summer 2023. Labour has said this has since been reduced to fewer than 210.

Gabbard launches 'ODNI 2.0,' with plan to cut workforce by 40%
Director of National Intelligence Tulsi Gabbard announced a transformation of the agency Wednesday that will cut the "bloated" ODNI by more than 40% by the end of the year and save taxpayers more than $700 million annually, all while executing its core national security and intelligence mission "in the most agile, effective, and efficient way." Gabbard, on Wednesday, announced what she described as a "long-overdue" transformation, that will refocus ODNI and eliminate offices that were involved in the politicization of intelligence. "Over the last 20 years, ODNI has become bloated and inefficient, and the intelligence community is rife with abuse of power, unauthorized leaks of classified intelligence, and politicized weaponization of intelligence," Gabbard said. "ODNI and the IC must make serious changes to fulfill its responsibility to the American people and the U.S. Constitution by focusing on our core mission: find the truth and provide objective, unbiased, timely intelligence to the President and policymakers. Ending the weaponization of intelligence and holding bad actors accountable are essential to begin to earn the American people's trust which has long been eroded." Gabbard said that "under President Trump's leadership, ODNI 2.0 is the start of a new era focused on serving our country, fulfilling our core national security mission with excellence, always grounded in the U.S. Constitution, and ensuring the safety, security, and freedom of the American people." ODNI was first created after the 9/11 terror attacks and exposed systemic failures across the intelligence community. ODNI's purpose was to integrate intelligence from and provide oversight over all intelligence community elements in order to ensure the intelligence provided to the president and policymakers was "timely, accurate, and apolitical." "Unfortunately, two decades later, ODNI has fallen short in fulfilling its mandate," an ODNI spokesperson said. ODNI 2.0 is set to eliminate "redundant missions, functions and personnel," and is set to make "critical investments" in areas that support Trump's national intelligence priorities. ODNI officials said that ODNI 2.0 will focus on rebuilding trust, exposing politicization and weaponization of intelligence, holding bad actors accountable, saving American tax dollars, and focusing on their "core mission," which is to protect "the safety, security, and freedom of the American people." As part of the effort, Gabbard is closing ODNI's Reston Campus and moving the National Intelligence Council to the main ODNI campus, which will ensure the all essential intelligence functions are kept "under one roof," which officials say will "enable savings," and will ensure "greater efficiency and oversight, and integration across the ODNI and IC." Gabbard is also leading intelligence community-wide reforms for "efficient and effective operations." Gabbard is expected to issue guidance to create a streamlined contracting authority for companies that pursue emerging technologies, and that are already approved for business with the IC to provide services quickly. Gabbard is also leading an IC-wide effort to "rebalance and optimize" its civilian and contractor workforce to "reduce bloat, increase analytic capability, remove stovepipes, eradicate politicization and analytic bias, accelerate information sharing, and increase efficiency to ensure mission success," officials said. Meanwhile, Gabbard has also ended non-merit-based recruitment of intelligence community professionals. As for ODNI components, the National Counterterrorism Center is building capability to increase two-way information sharing between federal, state, and local law enforcement to secure borders and communities. As for the National Counterintelligence and Security Center, Gabbard is calling for a renewed focus on security clearance reform, deterring counterintelligence threats, and oversight of investigations and probes of unauthorized leaks of classified information.
