Halim Saad loses appeal to revive RM1.8b Renong-UEM lawsuit against govt, Dr M

PUTRAJAYA, Aug 18 — Businessman Tan Sri Halim Saad has lost his appeal to reinstate his lawsuit against the government, former prime minister Tun Dr Mahathir Mohamad and former finance minister II Tan Sri Nor Mohamed Yakcop over alleged losses he incurred following the government's 2001 acquisition of Renong Bhd and United Engineers Malaysia Berhad (UEM) shares.
A three-man bench comprising Justices Datuk Supang Lian, Datuk Lim Chong Fong, and Datuk Dr Alwi Abdul Wahab yesterday dismissed Halim's appeal and ordered him to pay RM20,000 in legal costs.
'We find the appellant's suit is time-barred pursuant to the Limitation Act 1953 and Public Authorities Protection Act 1948, warranting the striking out of the suit,' said Justice Supang, who delivered the court's unanimous decision.
She also said Halim's claim of concern about the violation of his guaranteed constitutional right should have been raised in his earlier lawsuit filed in 2013.
On May 9, 2024, the High Court allowed the applications by Dr Mahathir, Nor Mohamed, and the government to strike out the lawsuit filed by the 72-year-old business tycoon.
Earlier, on April 17, 2013, Halim filed a similar lawsuit against Khazanah Nasional, Nor Mohamed, and the government to claim damages of more than RM1.8 billion for selling his shares in Renong.
However, on October 31 of the same year, a High Court allowed an application by Khazanah Nasional, Nor Mohamed, and the government to strike out the suit on the grounds that Halim had filed the suit after a six-year time frame.
Halim failed to reinstate the 2013 lawsuit following the Federal Court's dismissal of his application to obtain leave to commence his appeal in the Federal Court in 2015.
Meanwhile, in his statement of claim in the lawsuit against Dr Mahathir, Nor Mohamed, and the government, Halim, who is Renong's former executive chairman and director, claimed that he intended to make a general offer to privatise UEM as a subsidiary of Renong with the implementation enabling the plaintiff to gain complete control and ownership of UEM.
Halim claimed that he was instructed by Dr Mahathir and Nor Mohamed not to proceed with the general offer because the government wanted to take over all the shares in UEM through Khazanah Nasional or a party to be nominated by Khazanah.
Halim alleged that he was also instructed to leave UEM and Renong as a shareholder and director, including the subsidiaries of the two companies, thus obliging him to hand over control of Renong and UEM to the government and further dispose of his Renong shares at a loss.
He claimed that Khazanah had acquired all of UEM's shares through its subsidiary, Danasaham Sdn Bhd, thereby gaining control over UEM, which at the time owned 32.6 per cent of Renong shares.
Halim is claiming, among other things, compensation for the forced takeover by the government between July and October 2001, as well as a declaration that he is a Renong shareholder.
In their statement of defence, the defendants denied having forcibly taken over the shareholding of the two companies, as the takeover was approved by Halim, who received RM165 million in compensation.
In yesterday's proceeding before the Court of Appeal, lawyers Datuk Malik Imtiaz Sarwar, A. Surendra Ananth, and Yvonne Lim represented Halim. Senior federal counsel Ahmad Hanir@Hambaly@Arwi appeared for the government, Dr Mahathir, and Nor Mohamed. — Bernama

GEORGE TOWN, Aug 20 — About 81 hectares of land have been reclaimed for Silicon Island, according to Penang Infrastructure Corporation Sdn Bhd (PIC) chief executive officer Datuk Seri Farizan Darus. He said the mega reclamation project was moving forward as planned. The Silicon Island reclamation project off the southern coast of Penang island covers about 930.7ha. The project is being developed in two phases, 510ha under phase one and 420ha under phase two. 'Reaching 200 acres (81ha) of reclaimed land is not just about physical progress – it is a signal of confidence that Silicon Island is moving forward as planned,' Farizan said in a statement issued today. He said the project will create new opportunities for investment and jobs, while ensuring local communities benefit from better amenities. Among the facilities to be built on the man-made island included a 380m marine viaduct, the Pan Island Link 2A (PIL2A), the Matang Food Court and Community Hub and a new Department of Community Development (KEMAS) training centre. The marine viaduct, expected to open by January 2029, will have four lanes in each direction and is part of PIL2A. Farizan said it will connect the island to the southern coast of Penang island and also improve access to the Sultan Abdul Halim Mu'adzam Shah Bridge. The Matang Food Court, covering 0.8ha, will house a new Village Community Management Council (MPKK) hall, a Fishermen's One-Stop Service Centre, food stalls, restaurants and fishermen's storage sheds. Construction of the suction tank and pump house will start in October and is expected to complete by the end of 2027. Farizan added that Silicon Island was planned with resilience and sustainability at its core. 'Every element – from the marine viaduct to the community facilities – has been integrated to serve both economic and social needs,' he said. He said a total RM11.7mil in ex-gratia payments has been disbursed to 791 eligible fishermen under the Social Impact Management Plan (SIMP). 'In addition to the cash aid, the government has also rolled out the boat and engine assistance scheme,' he said. To date, 118 out of 295 active fishermen who are boat owners have received new boats and engines, with an overall expenditure amounting close to RM10mil. Earlier today, Penang Yang diPertua Negri Tun Ramli Ngah Talib and his consort Toh Puan Raja Noora Ashikin Raja Abdullah visited the site, accompanied by an entourage from the state government and SRS Consortium, to commemorate the milestone. KUALA LUMPUR, Aug 20 — The ringgit appreciated against most major currencies but eased slightly against the greenback at the close on Wednesday amid cautious market sentiments ahead of the release of the US Federal Open Market Committee (FOMC) meeting minutes later tonight. At 6pm, the local note dipped to 4.2250/2290 against the US dollar from yesterday's close of 4.2215/2255. Bank Muamalat Malaysia Bhd chief economist Dr Mohd Afzanizam Abdul Rashid said that apart from the minutes, comments by senior US central bank officials will also come into focus after the release of the FOMC details. 'Markets are anxious about whether the US Federal Reserve (Fed) will deliver a 25 basis points interest rate cut in the upcoming FOMC meeting,' he told Bernama. Afzanizam said last week's US consumer price index and producer price index dynamics suggested that the Fed might continue to focus on inflation, but noted that the weak labour market warranted additional monetary stimulus. In addition, the market sentiment will stay guarded ahead of policy signals from the Fed's Jackson Hole Economic Policy Symposium later this week. At the close, the ringgit settled mostly higher against a basket of major currencies. It gained versus the euro to 4.9196/9242 from 4.9307/9354 yesterday and inched up against the British pound to 5.7033/7087 from 5.7066/7120, but dropped vis-à-vis the Japanese yen to 2.8648/8677 from 2.8572/8601. The ringgit also traded mostly higher against other Asean currencies. It gained versus the Singapore dollar to 3.2864/2898 from 3.2901/2935 at Tuesday's close, strengthened against the Thai baht to 12.9756/9935 from 12.9848/13.0027 and inched up vis-à-vis the Indonesian rupiah to 259.6/260.0 from 259.8/260.2. KUALA LUMPUR, Aug 20 — Bursa Malaysia pared most of its earlier losses to close marginally lower as profit-taking was offset by selective buying in heavyweights, amid cautious sentiment in regional markets, a dealer said. At 5pm, the FTSE Bursa Malaysia KLCI (FBM KLCI) slipped 2.03 points, or 0.13 per cent, to close at 1,588.21 from Tuesday's close of 1,590.24. The benchmark index opened 2.21 points lower at 1,588.03, and moved between 1,583.40 and 1,591.04 throughout the day. The broader market was negative with decliners outpacing advancers 647 to 376, while 487 counters were unchanged, 1,084 untraded and 16 suspended. Turnover narrowed to 2.55 billion units worth RM2.50 billion from 2.60 billion units worth RM2.74 billion on Tuesday. UOB Kay Hian Wealth Advisors Sdn Bhd head of investment research Mohd Sedek Jantan said that the broader market sentiment today remained guarded ahead of policy signals from the US Federal Reserve's Jackson Hole Economic Policy Symposium later this week. 'Sector rotation was evident, with industrials outperforming on the back of a double-digit rally in petrochemicals, while plantations and consumer cyclicals also showed strength - underscoring resilient domestic demand amid external policy uncertainty,' he told Bernama. Meanwhile, Rakuten Trade Sdn Bhd vice-president of equity research Thong Pak Leng viewed today's profit-taking as a healthy correction as it allows the market to digest the recent strong uptrend. 'The FBM KLCI is holding well above the key 1,585 support mark, which sets the stage for further gains. Barring any external shocks, we expect the benchmark index to trade within the 1,570 to 1,600 range throughout the week,' he said. Among the heavyweights, Maybank and Public Bank were flat at RM9.80 and RM4.46, respectively, Tenaga Nsaional declined 6.0 sen to RM13.66, CIMB fell 3.0 sen to RM7.36, while IHH Healthcare rose 3.0 sen to RM6.88. Of the most active counters, Vantris Energy eased half-a-sen to 3.5 sen, Sime Darby trimmed 1.0 sen to RM1.75, while Zetrix AI added 1.0 sen to 87.5 and Tanco was flat at 73 sen. Across the broader market, the FBM Emas Index decreased 29.58 points to 11,782.83, the FBMT 100 Index shed 29.35 points to 11,568.30, the FBM Emas Shariah Index gave up 32.06 points to 11,699.34, the FBM 70 Index dropped 106.51 points to 16,603.46, while the FBM ACE Index slipped 13.77 points to 4,695.92. By sector, the Financial Services Index slid 20.36 points to 18,165.14, the Plantation Index garnered 46.12 points to 7,592.60, the Industrial Products and Services Index perked up 1.61 points to 160.73, and the Energy Index eased 0.93 of-a-point to 749.29. The Main Market volume dipped to 1.46 billion units valued at RM2.28 billion from Tuesday's 1.49 billion units valued at RM2.51 billion. Warrants turnover improved to 780.41 million units worth RM93.66 million from 732.43 million units worth RM101.91 million previously. The ACE Market volume declined to 310.20 million units worth RM124.67 million from 375.68 million units worth RM134.87 million yesterday. Consumer products and services counters accounted for 247.19 million shares traded on the Main Market; industrial products and services (235.22 million), construction (146.13 million), technology (189.98 million), financial services (82.44 million), property (176.76 million), plantation (25.02 million), REITs (21.21 million), closed-end fund (3,000), energy (186.91 million), healthcare (32.64 million), telecommunications and media (47.13 million), transportation and logistics (34.33 million), utilities (38.49 million), and business trusts (11,600). — Bernama
