
RBI releases Discussion Paper on Capital Raising Avenues for Primary (Urban) Co-operative Banks
The Reserve Bank of India (RBI) has released a Discussion Paper on Capital Raising Avenues for Primary (Urban) Co-operative Banks. The Banking Regulation (Amendment) Act, 2020 has enabled certain capital related provisions such as issuance of special shares, issuance of shares at a premium, etc., which are new to the co-operative banking sector. The Report of the Expert Committee on Primary (Urban) Co-operative Banks (the Expert Committee), chaired by N.S. Vishwanathan, former Deputy Governor, RBI, had provided broad guiding principles on these provisions through its recommendations. Thereafter, a Working Group was constituted in RBI to inter alia operationalise the recommendations of the Expert Committee on these newly enabled capital related provisions.
RBI noted that as a part of the Statement on Developmental and Regulatory Policies released on Oct 09, 2024, RBI had proposed to issue a Discussion Paper (DP) on Capital Raising Avenues for Primary (Urban) Co-operative Banks based on the recommendations of the Working Group. Accordingly, RBI released the DP which proposes capital raising avenues for UCBs.
The research paper outlines the recommendations of the Committee are as under:
Amendments to the BR Act for enabling RBI to notify through a Gazette Notification the classes of instruments as securities for the purpose of SCRA and SEBI Acts, to enable their listing and trading on stock exchanges. Till such amendment comes into force, banks may be allowed to have a system on their websites facilitating buyers and sellers of member shares to indicate their interests to buy / sell securities at book value, subject to the bank ensuring that the prospective buyer is eligible to be admitted as a member. RBI may provide the broad mechanism for guidance of the banks to determine the valuation (book value) based on their last audited financial statement. The statutory auditor of the bank may be required to certify the book value of the member shares as per RBI's directions. Eligible banks may be required to publish their financial statements more frequently (say, quarterly / half-yearly) for transparency. The banks may also be required to carry out valuation of their member shares with certification by the auditors at quarterly / half yearly intervals. The valuation of the member shares should be disclosed by banks on their websites. The banks should disclose the price / volume and other important data with respect to all buy / sell transactions on their website for the guidance of other prospective investors. Banks should not be allowed to issue fresh member shares at less than the book value certified by the Statutory Auditors. However, the transactions between members may happen at the price negotiated by the buyers / sellers. Redemption of the member shares with the bank may only be as per the provisions of the concerned Co-operative Societies laws. Where legislations permit redemption at higher than face value, redemption value may not be more than the price paid at the time of the primary issuance of the share and in any case not higher than the book value at the time of redemption. UCBs should be required to disclose other important information like divergences identified by the RBI, penalties imposed by the regulators, etc. on their websites for the benefit of the investors.

KYC update pain may ease as RBI rejigs rules
Representative image MUMBAI: RBI has eased KYC norms to simplify compliance and to make it easier for individuals to access long-dormant bank accounts and unclaimed deposits, many of which have remained untouched for over 10 years. The move, announced through a circular on June 12, aims to ensure that anti-money laundering rules do not hinder rightful account holders from accessing their savings particularly in accounts opened to receive government benefits. RBI has asked banks to give three advance intimations prior to the due date of periodic updation of KYC and at least one intimation must be by letter. In the past customers have complained that digital alerts have been missed and they only come to know when they are not able to transact on their account. The central bank has also asked banks to allow KYC updates at any branch, irrespective of where the account was opened. It has also permitted the use of Aadhaar OTP and video-based customer identification for periodic KYC updates. Business correspondents, especially in rural areas, can now assist customers with reactivating inoperative accounts and completing KYC requirements. Andhra Pradesh government assures to protect workers' rights despite increased working hours
1 2 Vijayawada: State govt has assured that it is committed to protect the rights of the workers despite increasing the daily working hours from 8 to 10 as the weekly cap of 48 hours will remain in force. The amendments to the labour laws have been initiated to allow better scheduling, especially during peak business periods, without increasing overall workload. Similarly, changes to overtime rules, replacing the monthly 50-hour cap with a 144-hour quarterly limit, will provide seasonal flexibility without raising annual overtime, said govt. Labour commissioner MV Seshagiri Babu explained that the amendment to Section 73 only exempts very small establishments (with fewer than 20 workers) from select provisions, while key protections remain fully in force including women's safety during night shifts, paid leave, holidays, and registration. "Central laws on wages, termination, gratuity, and child labour will continue to apply and be enforced. These reforms are part of a broader effort to modernise labour regulations, support small businesses, and align with contemporary work practices especially in sectors with fluctuating footfalls like retail and services," he explained. Seshagiri Babu said that it is a fact that the daily working-hour limit for employees in shops is proposed to be increased from 8 hours to 10 hours. However, it is important to highlight that the weekly limit remains unchanged at 48 hours. This means that employees cannot be made to work more than 48 hours in a week, ensuring that the overall workload does not increase and workers are not overburdened. This change is aimed at providing greater scheduling flexibility for businesses and employees alike, particularly to meet seasonal or peak demand without breaching weekly work-hour protections. However, the labour commissioner did not elaborate whether the department has manpower to check the workload of the workers on a daily and weekly basis. The proposed amendment to Section 73 of the AP Shops and Establishments Act seeks to exempt commercial establishments employing fewer than 20 workers from most provisions of the Act, while retaining key safeguards such as registration, women's safety during night shifts (Section 23), paid leave (Section 30), and mandatory holidays (Section 31).
