Shwetha Menon Obscene Films Case: Kerala High Court Orders Interim Stay On Proceedings In FIR Against The Actor
Kerala High Court on Thursday stayed the proceedings in connection with the FIR lodged against Malayalam film actor Shwetha Menon for allegedly publishing or transmitting obscene scenes of some of her past movies and advertisements.
The interim order was passed by Justice V G Arun on a plea made by the actor to quash the FIR against her.
The High Court said there was prima facie substance in the contention of the actor's counsel. Before referring the complaint for investigation, the requirements of calling for a report from the police and of making an enquiry ought to have been complied.
"Considering the short duration within which the complaint was filed and forwarded to the police, it appears that no such procedure was followed. Registry shall call for a report from the court of the Chief Judicial Magistrate, Ernakulam regarding the procedure followed before forwarding the complaint to the police for investigation".
"There shall be an interim stay on further proceedings in crime number 1075/2025 (the FIR) of Ernakulam central police station," the High Court said.
It also issued notice to the state and the complainant on whose complaint the magisterial court had ordered after the FIR was lodged.
An FIR, under the section 67 (publishing or transmitting obscene material in electronic form) of the Information Technology (IT) Act and provisions of the Immoral Traffic (Prevention) Act was lodged against the actor.
Menon, known for films like Salt N Pepper, Rathinirvedam and Kalimannu, is in the fray for the president's post in the Association of Malayalam Movie Artistes (AMMA).
The election to the executive committee is scheduled for August 15.
In her plea, seeking quashing of the FIR, the actor has claimed that the allegations are "mala fide" in nature and the offences she has been booked for are not made out.
The complainant -- Martin Menachery -- has alleged that Menon appeared in several films -- Paleri Manikkyam, Rathinirvedham, Kalimann and a condom advertisement containing her obscene visuals with the intention of securing monetary gain.
Rejecting the allegations, the actor has contended that the films referred to in the complaint were duly censored and certified and have been available in the public domain for several years now. She also said that the character portrayed by her in the movie Paleri Manikyam, bagged her a Kerala State Award for best actress.
Even the advertisement, in which she appeared years ago, was duly censored and certified, the plea said.
"The allegation of the petitioner (Menon) being privy to running porn sites is absurd and per se defamatory. It is submitted that such allegations are raised in a callous and irresponsible manner without any supporting material," it contended.
The actor also said that the complaint was filed in the wake of her filing nomination for the post of AMMA president.

13 Allahabad High Court judges urge Chief Justice to not follow Supreme Court's directive
Three days after the Supreme Court issued a scathing order barring an Allahabad High Court judge from hearing criminal cases until his retirement, several judges of the High Court have come out in support of their fellow judge opposing the implementation of the apex court's directive. Thirteen judges of the Allahabad High Court have written to Chief Justice Arun Bhansali, requesting the convening of a Full Court meeting and urging that the apex court's order removing Justice Prashant Kumar from the criminal roster not be implemented. The letter was circulated on Thursday (August 7, 2025), even as the Supreme Court relisted the case in which it made the remarks against Justice Kumar for allowing criminal proceedings in a civil dispute case. 'The Full Court resolves that direction made in para 24 to 26 in the subject order dated August 4, 2025 is not to be complied with as the Supreme Court does not have administrative superintendence over the High Courts,' the letter said. The High Court judges also recorded their 'anguish in respect of tone and tenor of said order'. On August 4, 2025, a Supreme Court Bench of Justices J.B. Pardiwala and R. Mahadevan had reprimanded Justice Kumar for 'cutting a sorry figure for himself' and making 'a mockery of justice'. The apex court had taken stern exception to Justice Kumar finding nothing wrong in a litigant filing a criminal case against a buyer in a purely civil dispute over an unpaid balance of money in a sale transaction. The Bench said the High Court judge had found nothing wrong in allowing a criminal case for 'criminal breach of trust' registered in the civil dispute. 'We are at our wits' end to understand what is wrong with the Indian judiciary at the level of the High Court. At times we are left wondering whether such orders are passed on some extraneous considerations or it is sheer ignorance of law. Whatever it be, passing of such absurd and erroneous orders is something unpardonable,' the Bench said. Couple, child rescued from bonded labour in Madurai; employer booked
Madurai: A couple in bonded labour and their one-and-a-half-year-old daughter were rescued from Ananjiyur village in Madurai East taluk on Thursday by revenue officials. The couple, Raghu, 21, and Radha, 25, from Perumangalam village in Peravurani taluk, Thanjavur, worked without pay for more than five months to repay a loan of 30,000. A ccording to officials, the couple borrowed the money from a person in Thanjavur but were unable to repay the debt after their house was gutted in a fire accident. The lender subsequently handed them to another person in Madurai, who in turn sent them to Tirupathi, 40, of Angadimangalam village in Madurai. Tirupathi forced them to work in cattle grazing, claiming their loan escalated to 2.5 lakh due to high interest. Following a tip-off, a team led by Melur RDO T Sangeetha and east taluk Tahsildar Manesh Kumar, carried out an inspection and rescued the three. A complaint was filed at the Silaiman police station. Tirupathi was booked under provisions of the Bonded Labour System (Abolition) Act. The RDO said, "They (couple) initially borrowed 30,000 two years ago but were coerced into accepting an inflated amount of 2.5 lakh charged with exorbitant interest. Man lynched over suspicion of scooter theft in Gandhinagar
Ahmedabad: A 30-year-old man from Aravalli district was allegedly beaten to death by three men in Gandhinagar who suspected him of stealing a scooter. The incident took place in the early hours of Tuesday, according to an FIR filed with Dabhoda police by the victim's elder brother, who accused the trio of lynching. The deceased, Kalpesh Katara, was a resident of Sunokh village in Bhiloda taluka of Aravalli. On Monday night, he reportedly went out with a friend from Vaktapur. The next morning, Kalpesh's family received a call from Dabhoda police station stating that he met with an accident and was admitted to Gandhinagar Civil Hospital. Later, they were informed that Kalpesh died during treatment. In the FIR, his elder brother Arvind Katara, a resident of Himmatnagar, stated: "My brother Kalpesh Katara was beaten up by Yash Darji and his aides Nikunj Patel and Sanjay Barot of Lawarpur village of Gandhinagar on suspicion of stealing a scooter. Due to the injuries inflicted by them, my brother died." That night, Darji, along with Patel and Barot, set out to trace the stolen vehicle. "Around 2am on Tuesday, they reportedly saw someone riding Darji's scooter near Gambhoi crossroads and attempted to intercept him. The rider tried to flee but fell into a roadside ditch after losing control of the vehicle, suffering injuries. The trio pulled him out of the ditch and then beat him to death," said inspector G K Bharwad of Dabhoda police. The trio caught Kalpesh and instead of handing him over to police immediately, they allegedly took him to the spot from where the scooter was stolen. The FIR states, "They took Kalpesh either to the garage or some other place and assaulted him, which caused severe injuries leading to his death." The accused informed the police about a thief being caught around 3.15am on Tuesday, and Kalpesh, who was unconscious, was shifted to Gandhinagar Civil Hospital. He died during treatment around 8:30am on Tuesday. A panel of doctors conducted the postmortem and noted multiple injuries on Kalpesh's body. Dabhoda police registered a case of murder under Bharatiya Nyaya Sanhita (BNS) sections for murder and abetment against the accused, along with charges of the SC/ST (Prevention of Atrocities) Act, as the victim belonged to a scheduled tribe.
