
Karnataka High Court Reserves Order On RCB's Petition After State Concludes Arguments

The Karnataka High Court on Wednesday reserved its order in the petitions filed by Royal Challengers Bengaluru (RCB) and its marketing head Nikhil Sosale, challenging the criminal proceedings in connection with the stampede deaths that occurred during the team's IPL victory celebrations. The order will be pronounced on Thursday at 2:30 pm.
Appearing for the petitioners, senior advocate Sandesh Chouta reiterated that while certain companies have been named as accused, individual employees like Sosale were being targeted without specific charges. The counsel questioned the basis of police action against the individuals, alleging that proper procedure was not followed during arrests.
Advocate General (AG) Shashikiran Shetty, representing the State, began his response by tracing the timeline of events following RCB's IPL victory. He submitted that plans for a victory parade were already in place before the team won the final, and this was reflected in internal communications and planning documents.
According to the AG, RCB went ahead with event announcements on social media without obtaining any permission from the State. "The Karnataka Cricket Association (KSCA) merely sent an intimation on June 3. No official request for permission came from RCB," he said. The AG accused the petitioners of suppressing this information in court filings and misleading the judiciary.
Calling the event "illegal", the AG said that under the Karnataka Police Act, a license is mandatory for such public gatherings. He added that ticketing, crowd management, and security were the responsibility of RCB and BCCI.
On the arrests, the AG argued that Sosale was detained while attempting to leave the city shortly after learning he was named in the FIR. He laid out the timeline, noting that after the suspension of DCP Shekhar, the investigation was lawfully transferred to another officer, who supervised the arrest via the Ashok Nagar Police Station. "Due process was followed even during transfer of case to CID, and all arrest documents were provided to the accused, in reasonable time," the AG said.
He contended that the arrests were legal, the petitioners were evading investigation, and that Sosale, in his official role, bore direct responsibility for the alleged lapses in safety and planning. "There were no barricades, no medical support, no permissions. The public was invited by RCB in an irresponsible manner, and the tragic deaths are a direct result of this negligence," he submitted.
The AG further stated that unless the arrest is proven to be illegal, the petition seeking quashing of proceedings is not maintainable. He emphasised that there was no delay in providing arrest documents and that the petitioners were attempting to suppress key facts.
The petitioners' counsel Mr Chouta responded by alleging that Sosale's fundamental rights were violated and once again questioned whether the Chief Minister had directed the arrest, as reported in the media. He pointed out that the State had not issued a specific denial on this issue. He also asked why several police officials were suspended or transferred if the government believes the entire responsibility lies with RCB and associated entities.
After hearing both sides, the court reserved its order for Thursday afternoon.

Bengaluru stampede: Karnataka govt hints at RCB announcement in Ahmedabad after IPL win being a trigger
The Royal Challengers Bengaluru (RCB) cricket team made an announcement on June 3 in Ahmedabad at 11.30 pm about hosting celebrations in Bengaluru on June 4 for its first-ever Indian Premier League (IPL) final victory, the Karnataka government Thursday said in a factual narration of events in a report given to the Karnataka High Court on the June 4 stampede at Bengaluru's M Chinnaswamy cricket stadium that resulted in the death of 11 RCB fans. 'On factual narration what emerges is that on the evening of June 3, at 11.30 PM, they have stated that they are coming to Bengaluru for celebrations,' state Advocate General K M Shashikiran Shetty told a division bench of the Karnataka High Court after providing a report in a sealed cover on the stampede deaths, as sought by the court. The high court has posed nine questions to the Karnataka government with regard to the June 4 stampede. Among the questions posed by the HC are, 'When and who has taken the decision to hold the victory celebration and in what manner?' Whether 'any permission was sought to organize the event?' and 'whether any SOP (Standard Operating Procedure) has been formulated to manage a crowd of 50,000 and above in any sports event and celebrations of this nature?' The Karnataka government, which also felicitated the RCB team on June 4 in Bengaluru, has been arguing in the courts that the cause of the stampede at the Chinnaswamy cricket stadium was the unilateral decision of RCB to invite fans for an open celebration in Bengaluru on June 4 – through announcements in Ahmedabad on June 3 (including those by key RCB players after the win) and social media posts early on June 4. The government has argued that open invitations were extended to fans without RCB obtaining the official clearances needed from the Bengaluru police for hosting the event. 'The pre incident, the incident, the post incident – we have given a factual narration and answered all your queries to the extent possible on the basis of the material that is available,' the Karnataka advocate general told the HC on Thursday after handing over a report. The division bench of the HC comprising Acting Chief Justice V Kameswar Rao and Justice C M Joshi adjourned the suo motu petition for further hearing on June 17 after noting that the AG had 'filed the report sought by us'. The high court also ordered that 'all the original correspondence – both offline/online – of all stakeholders involved in organizing the event should be kept in safe custody.' The HC identified the Karnataka chief secretary to be the custodian of the correspondence. In the wake of the Bengaluru stampede, the state government had suspended five police officers – including the Bengaluru police commissioner – on June 6. It also constituted a one-man judicial commission to probe the stampede incident and the deaths.

Bengaluru stampede: Karnataka High Court grants interim bail to RCB marketing head Nikhil Sosale, 3 others
A single-judge bench of the Karnataka High Court Thursday granted interim bail to Royal Challengers Bengaluru (RCB) marketing head Nikhil Sosale along with event management company DNA Entertainment's vice president Sunil Mathew, and two others in the Bengaluru stampede case. The interim bail in question was granted to the petitioners subject to their cooperation with the investigation while also refraining from threatening witnesses or hampering the investigation. They were also directed to not leave the court's jurisdiction, deposit their passports with the trial court, and execute a personal bond of Rs 1 lakh. The four accused petitioners in this case were arrested on June 6 based on three First Information Reports (FIRs) registered the previous day. Arguing for the petitioners, senior advocate Sandesh Chouta had questioned the justification for an arrest without conducting an investigation that would implicate them in said offences. It was also argued that with the case having been transferred to the Criminal Investigation Department (CID) on June 5, neither the regular police nor the Central Crime Branch (CCB) had the authority to carry out arrests. It was further stated that the arrests were not based on FIRs but rather the instructions of the chief minister on June 5 at a press conference. Opposing the bail plea on behalf of the State was Advocate General Shashikiran Shetty, arguing that all necessary documents had been provided. He also stated that while the case had been officially transferred to the CID on June 5, the investigation was handed over to the agency only after the arrests. Till then, the Cubbon Park police carried out the investigation, with the CCB being deputed by them for the arrests. With regard to Sosale, he also pointed out that he appeared to have been fleeing, taking into account the time of purchase of his flight ticket and his arrest from Kempegowda International Airport. Having heard the respective arguments, the bench observed in its detailed order that to arrest without a warrant, 'It was absolutely essential for the respondent Police to receive credible information that the petitioners had committed a cognizable offence punishable with imprisonment for more than seven years and the respondents should have also recorded reasons to believe in writing on the basis of the said credible information that the petitioners had committed the alleged offences.' The court went on to observe that in absence of material or an investigation to establish this, or their specific role in the offences, the arrests appeared to be contrary to law. The high court also did not accept the State's contentions with regard to the timing of transfer of the case to the CID, which was based on a 2015 State circular that existing investigating officers should continue investigation until the CID takeover, noting that it was, 'applicable only to the cases where there was incomplete documentation by the local investigation officers who have been directed to continue investigation in relation to mandatory provisions like post-mortem examination, etc.' While granting interim bail in this order, the judge also noted that since there appeared to be a delay of 10-11 hours after arrest in communicating grounds of arrest to the accused petitioners, the arrest appeared to stand vitiated. Eleven people died in a stampede outside the M Chinnaswamy Stadium in Bengaluru earlier this month during the felicitation event for the RCB following their maiden title victory in the Indian Premier League.
