AGRA: A Muzaffarnagar court acquitted 10 individuals accused in a 2013 riots case due to lack of evidence and hostile witnesses. The accused were charged under IPC Section 153A (promoting enmity between groups) based on complaints by locals, Mohammad Iqbal and Noor Mohammad. However, Iqbal later turned hostile, telling court he wasn't present in the village at the time. Other witnesses testified they were in Delhi during the incident. Defence argued accused were falsely named in FIR. This comes just months after a similar acquittal in May, when 11 men from Lisarh village in Shamli district were cleared of charges of looting and torching the house of Kamruddin, who had fled with his family during the riots. The communal violence in Muzaffarnagar and Shamli was triggered after Shahnawaz, 25, was stabbed to death in Kawal village on August 27, 2013. In retaliation, two of the alleged attackers, Sachin and Gaurav, were lynched. This led to widespread riots that claimed 62 lives and displaced over 50,000 people. tnn

Booked for allegedly accepting a bribe of Rs 5 lakh to let off two drug peddlers, the Moga Police has registered another FIR against Punjab Police inspector Arshpreet Kaur Grewal after a local court declared her a proclaimed offender. The Moga court of CJM Shilpi Gupta declared the inspector a proclaimed offender in an order dated July 2 and ordered the police to register a fresh FIR against her under the section 209 (fail to appear at the specified time and place after being summoned under a proclamation) of the Bharatiya Nyaya Sanhita (BNS). An officer from Kot Ise Khan police station of Moga confirmed that a fresh FIR against the inspector has been registered on the court order. Grewal, the former SHO of Kot Ise Khan police station, was booked along with two senior constables in October last year under several sections of the NDPS Act and Prevention of Corruption Act (PCA) for allegedly accepting Rs 5 lakh bribe to let off two drug peddlers and showing less recovery of opium than what was actually recovered. Since then, the Moga police failed to arrest her in the case as she was absconding. According to the FIR, Grewal and her team had apprehended one Amarjit Singh of Datewala road, and recovered 3-kg opium from him. However, along with Amarjit, his brother Manpreet and son Gurpreet were also present. However, the inspector along with both constables, allegedly struck a deal of Rs 8 lakh via a private person, the FIR claimed. 'After accepting Rs 5 lakh as bribe, the inspector let off Manpreet and Gurpreet and the drug peddling case was registered only against Amarjit Singh,' the FIR further said. The recovery in the case was shown as 2-kg of opium instead of 3 kg.

MUMBAI: Five persons attempted to pull off an audacious fraud, posing as senior government officials and even a former minister, to defraud a businessman of ₹6 crore. They pretended to offer the businessman a government contract to supply 12,000 ICU beds to government hospitals – but a faked Government Resolution (GR) gave the game away. Fake ex-minister, aides dupe bizman of ₹ 6 crore Two of the accused posed as officers on special duty (OSDs) of ministers, while one claimed to be a former minister. They took ₹6 crore upfront to secure the fictitious contract. The complainant is Taufail Khan, 45, proprietor of a Vidyavihar-based company called Novel Designer Display System Private Limited, which manufactures wooden and metal furniture. One of the suspects, Nitin Gupta, had worked for Khan as a consultant and promised to introduce him to senior government officials to bag a massive contract. Gupta fixed a meeting between Khan and three persons in an expensive hotel in Bandra in March. They were Gupta's partners in crime. One, he claimed, was a former minister, and the other two were OSDs to the state health minister, and food and drugs minister. They were carrying what looked like Maharashtra government identity cards, said the Bandra police. The accused offered Khan a contract to manufacture 12,000 ICU beds, and said their technical teams would visit his manufacturing facilities to verify their production capacity. During the meeting, the accused also discussed advance payments and commissions, as well as sums that senior government officers would need to get the process started. After a few days, Khan was invited to another meeting, where he was introduced to a fifth suspect, who he was told was an IAS officer. Khan walked right into the trap. He prepared a sample bed, which the accused 'inspected', and they agreed to give him an order for 12,000 beds for ₹100 crore, reads the First Information Report (FIR). The accused then started pressuring Khan to pay ₹6 crore in cash, which they needed to distribute to various government officers. Khan borrowed from friends and relatives, and paid the money in instalments. The accused then faked a GR, mentioning the contract. When Khan checked the government portal, he found no GR issued in his firm's name. That's when he approached the police. 'The five accused are Nitin Gupta, Ramesh Bansode, Balaji Pawar, Uddhav Bhamre and Kaustubh Bhamre. None of them is an OSD, a minister or a former minister. Our investigation is ongoing,' said an officer with the Bandra police.

Tirunelveli: The investigation into the murder of 27-year-old dalit man Kavin Selvaganesh has been transferred to the Crime Branch-Criminal Investigation Department (CB-CID), the Tamil Nadu police said in a statement on Wednesday. Both Saravanan and Krishnakumari, named as co-accused in the FIR, were suspended from service. "Considering the seriousness and importance of the case, and to guarantee an independent and unbiased investigation, the case has now been handed over to the CB-CID," the release added. Earlier in the day, Surjith was detained under Goondas Act following a detention order issued by Tirunelveli commissioner of police Santosh Hadimani. Meanwhile, for the fourth consecutive day, Kavin's parents refused to receive his body, demanding the arrest of Subashini's parents and action against police officials allegedly complicit in the case. Speaking to reporters in Tirunelveli, Kavin's father Chandrasekar alleged that Palayamkottai inspector Kasi Pandian threatened his son 15 days before the murder. "Even now, no senior officer has come forward to investigate. Pandian should be dismissed. If the govt does not act, we will resort to all forms of protest," he said. Kavin, a native of Tuticorin district and belonging to the scheduled caste devendra kula vellalar community, was hacked to death on July 27 at KTC Nagar in Tirunelveli. The murder is believed to have been triggered by his relationship with Subashini, a woman from the maravar caste. At a press conference in Madurai, he claimed that Kavin's family possesses chat records confirming the relationship between Kavin and Subashini. "This doesn't appear to be a murder executed solely by Surjith. The injury marks on Kavin's body suggest the involvement of trained assailants. The postmortem was done in haste, and we demand a second, transparent autopsy," he said. Kathir urged chief minister M K Stalin to respond to the incident, drawing parallels with the custodial death case in Madapuram. He called for a dedicated law to prevent caste-based killings in the state. Later in the evening, senior ministers K N Nehru and Anitha R Radhakrishnan, along with south zone IG Prem Anand Sinha and Tirunelveli city police commissioner Santosh Hadimani, met Kavin's parents and urged the family to receive the body, stating that the case had been transferred to the CB-CID. However, Kavin's parents refused to receive the body, insisting that Surjith's parents must be arrested since they have been named as accused in the FIR.

New Delhi: The Supreme Court on Wednesday declined to direct a Delhi trial court to defer proceedings on the framing of charges against Rashtriya Janata Dal (RJD) leader Lalu Prasad in the alleged land-for-job scam case. In his latest application before the top court, Lalu Prasad Yadav sought a direction to the trial court to postpone proceedings until August 12, when his petition seeking quashing of the FIR filed by the Central Bureau of Investigation (CBI) is scheduled for hearing before the Delhi High Court. Refusing to issue any directions, a Bench of Justices M.M. Sundresh and N. Kotiswar Singh remarked that the petition pending before the Delhi High Court would not turn "infructuous" even if the trial court proceeds to frame charges. It added that the trial court proceedings, including the framing of charges, are naturally subject to the outcome of the quashing petition pending before the Delhi High Court. Earlier, on July 18, the Justice Sundresh-led Bench had refused to stay the trial proceedings against Lalu Prasad Yadav, observing that it would not retain such a small matter for its own consideration and that the Delhi High Court should decide his plea. Lalu Prasad Yadav moved a Special Leave Petition (SLP) before the top court after the Delhi HC had rejected his application to stay the trial proceedings based on the charge sheets filed against him under the Prevention of Corruption Act. In his application before the Delhi High Court, the former Railway Minister argued that no police officer can investigate offences allegedly committed by a public servant where the offence is related to any recommendation made or decision taken in discharge of his public functions without approval of the competent authority. He contended that the registration of the FIR without such approval was illegal, rendering all subsequent actions - including the investigation, filing of charge sheets, and cognisance taken by the trial court - void ab initio (from the very beginning). After hearing the submissions, the Delhi High Court had granted liberty to Lalu Prasad Yadav to urge all his contentions before the trial court at the stage of framing of the charge and dismissed his plea seeking a stay on trial proceedings in the land-for-job case, prompting him to approach the Supreme Court. As per the CBI case registered on May 18, 2022, during the period between 2004-2009, then Railway Minister Lalu Prasad Yadav had obtained pecuniary advantages in the form of transfer of landed property in the name of his family members in lieu of appointment of substitutes in Group 'D' posts in different Zones of the Railways. Several people themselves or through their family members, allegedly sold or gifted their land in favour of the family members of Lalu Prasad Yadav and a private company controlled by him and his family. "No advertisement or any public notice was issued for such appointment of substitutes in Zonal Railways, yet the appointees, who were residents of Patna, were appointed as substitutes in different Zonal Railways located in Mumbai, Jabalpur, Kolkata, Jaipur and Hajipur," the CBI had said.
