An interim US Attorney has a tenure of 120 days, post which if an attorney is not selected, the district courts can choose their replacement.

New Jersey's judges said such a decision was according to the law and keeping in mind Alina Habba's lack of proper courtroom experience and notoriety for targeting particularly Democrats during prosecution.

Stating the judges had 'overstepped' their right by the replacement, AG Pam Bondi and the
DOJ reinstated Habba
as the attorney. They cited that Habba had broader public support.
Bondi, a well-known Trump loyalist, has been criticised for this action, however, her defence is that the judges showed a partisan retaliation when it came to judiciary action, implying such an act was not entirely improbable.
The federal judges invoked 28 US Code and 546 (D) to appoint a new attorney if no replacement was made in the 120-day period.
The DOJ contended that this was meant to be an executive action and not a business of the judiciary.
Post her 120-day period, federal judges of New Jersey replaced her with former deputy Desiree Leigh Grace.
Habba, known for her right-wing stance, with open comments such as 'New Jersey will soon be Red', has come to the scrutiny of federal judges and political mahouts.
Alina Habba's list of controversies
Habba has been the prosecutor for high-profile Democrat officials. One such person was Newark Mayor Ras Baraka and Representative LaMonica McIver.
Habba alleged that the mayor and her representative had 'trespassed', by organizing a migration protest.
Even, the federal judge of the case, commented that this was a 'worrisome step' and both Newark mayor and representative have accused Habba of being politically driven.
Habba, who has only had state level practice as a lawyer, has been criticised for her inexperience to handle contentious cases.
In the E Jean Caroll defamation case against President Trump, the judges commented on how the evidence was mishandled, and basic courtroom procedures, which are taught in the first year of law school, were not followed.
Disturbing workplace accusations
In 2022, she was allegedly suspected to have pressured an employee of the Trump National Golf Club to sign a non-disclosure agreement, contrary to the wishes of the employee and lack of proper explanation as to why such a move took form.

BENGALURU: Lenskart Solutions is gearing up for one of the largest consumer-tech listings of the year, with its initial public offering (IPO) expected to raise between Rs 7,500 crore and Rs 8,000 crore, people aware of the matter said. The final size will depend on valuations at the time of listing. The company filed its draft red herring prospectus (DRHP) with the Securities and Exchange Board of India (Sebi) on Tuesday. The IPO consists of a fresh issue of shares worth Rs 2,150 crore and an offer for sale (OFS) of up to 13.23 crore shares by existing investors and promoters. A pre-IPO placement of up to Rs 430 crore has also been proposed, which could reduce the fresh issue size. Proceeds from the fresh issue will be used for the expansion of company-owned (CoCo) stores in India (Rs 272.62 crore), lease-related payments (Rs 591.44 crore), technology and cloud infrastructure (Rs 213.38 crore), and brand marketing (Rs 320.06 crore). NEW DELHI: Less than half an hour after Prime Minister Narendra Modi declared that "no global leader interfered in Operation Sindoor ," the Congress launched a fresh attack, accusing him of being afraid to confront US President Donald Trump . Congress MP KC Venugopal asked bluntly, 'We are asking very clearly whether Trump's claim is bogus or not, whether he is telling truth or not. No answer... Why is he scared about talking about Trump?' He accused the Prime Minister of hiding behind Pakistan rhetoric instead of addressing serious questions about India's sovereignty and military decision-making. ' He declared that Pakistani airbases hit during the operation were "still in ICU" and said the masterminds of the April 22 attack had 'sleepless nights.' Emphasising India's strength, Modi said, 'We destroyed terror sites deep inside Pakistan within 22 minutes… drones and missiles made in India exposed Pakistani arms.' BJP Kerala secy meets Chhattisgarh CM Sai, dy CM Sharma over nuns' arrest
1 2 Raipur: Four days after arrest of two Catholic nuns in Chhattisgarh on charges of human trafficking and attempted religious conversion of three tribal girls, Kerala BJP general secretary Anoop Antony Joseph on Tuesday held a closed-door meeting with CM Vishnu Deo Sai and deputy CM, who is also the home minister, Vijay Sharma, on the issue. He also met the nuns, who are now in judicial custody. Both the arrested nuns hail from Kerala. Nuns Preethi Merry and Vandana Francis, along with Sukaman Mandavi – the person who got the girls to Durg railway station -- were arrested from the station on July 25 on a complaint filed by a local Bajrang Dal worker who accused them of trafficking the girls to another state and indulging in forced religious conversion. Later, a delegation including Congress MPs Benny Behanan from Chalakudy and K Francis George from Kottayam, RSP MP NK Premachandran from Kollam and Kerala legislative assembly member Roshi M John met the CM and deputy CM. Congress MP from Koraput constituency in Odisha, Saptagiri Ulaka, was also a part of the delegation. After meeting the delegation, Sai said Chhattisgarh is a peace-loving state that believes in harmony and coexistence. "People of all religions live here with mutual respect and brotherhood," he said. Reassuring the delegation, CM stated that the matter is being investigated as per due judicial process. "I met Anoop Antony Joseph and he briefed me with the information that he had. Everything is being done legally, and the case is in court. There have been instances in the past where women from Narayanpur have been trafficked in a similar manner. The matter is under investigation," Sharma said. "We were allotted time to meet the nuns at 12.30pm, but we were asked to wait, and the meeting took place only after the BJP delegation met them. We staged a demonstration outside the jail," Premchandran said. He said that he couldn't disclose the details of the meeting with nuns. The three young girls were being taken for jobs and the nuns had come to receive them at the railway station. Then some Bajrang Dal people arrived and assaulted them, he alleged.
