Govt agencies, GLCs must return misused public funds - Auditor-General

KUALA LUMPUR: All federal and state agencies, statutory bodies and 1,875 government-linked companies (GLCs) flagged in the Auditor-General's Report for public fund leakages must return the misappropriated funds.
Auditor-General Datuk Seri Wan Suraya Wan Mohd Radzi stressed that no public department or organisation will be exempt from action if such leakages are detected.
'Through the Auditor-General's Report Follow-up Committee, we have identified several instances of leakages in federal and state financial statements, which will be recovered.
'We also audit statutory bodies and GLCs. If there are any irregularities, such as uncollected or unreceived revenue, follow-up action will be taken,' she said at the launch of the Accounting Fraud Working Group here today.
Also present was Malaysian Anti-Corruption Commission (MACC) Chief Commissioner Tan Sri Azam Baki.
Wan Suraya further said that collaboration with enforcement agencies via the working group would strengthen the role of the National Audit Department, in line with amendments to the Audit Act 1957 (Act 62) passed last year.
She said the establishment of the Accounting Fraud Working Group would help address emerging issues highlighted in the Auditor-General's Report, several of which are already being jointly pursued.
In her speech at the event, Wan Suraya noted that the working group was established to develop more effective fraud risk control mechanisms, enhance early detection capabilities and improve compliance with accounting standards and related laws.
'The findings in the Auditor-General's Report demand firm and coordinated action. Simultaneously, internal controls must be strengthened, supervisory mechanisms improved and accountability reinforced.
'If not addressed efficiently and effectively, recurring weaknesses will persist. Corrective measures must go beyond procedures to include workplace culture, structured monitoring and the development of human capital within the public sector,' she added.

PUTRAJAYA: The Department of Statistics Malaysia (DOSM) has been unanimously elected as chair of the Working Group on Data Sharing, Analysis, Dissemination and Communication of Statistics (WGDSA) for the 2026–2027 term. The decision was made at the 23rd Meeting of the WGDSA (WGDSA23), which began yesterday in Putrajaya. The two-day meeting brought together 18 delegates from Asean Member States (AMS) and the Asean Secretariat (Aseanstats), with Myanmar participating virtually. The gathering aimed to strengthen regional statistical cooperation, enhance data transparency and improve communication strategies under the ASEAN Community Statistical System (ACSS). Chief statistician and ACSS15 chairman, Datuk Seri Dr Mohd Uzir Mahidin, said in a statement today that the appointment reflected the continued trust of member states in Malaysia's active role in advancing the Asean statistical system. He reaffirmed Malaysia's commitment to fostering innovation, inclusivity and resilience in the regional statistical ecosystem, stressing the importance of accessible, reliable and timely statistics in supporting evidence-based policymaking and Asean's integration and development goals. "As we move forward together, it is our collective responsibility to ensure that statistics are communicated clearly, shared meaningfully and used effectively to support Asean's progress. "Malaysia, as Asean chair for 2025, remains committed to promoting statistical cooperation, capacity building and innovation across the region," he said. Discussions at the meeting focused on the implementation of the WGDSA Multi-Year Plan (MYP), expansion of the Asean Statistical Indicators – Consolidated Template (ASI-CT), integration of Application Programming Interfaces (API) for real-time data access, and increased statistical outreach through initiatives such as the Asean Virtual Learning Academy and targeted awareness programmes. Mohd Uzir said the meeting also discussed enhancements to the ASICT data collection template for indicators in areas such as micro, small and medium enterprises (MSMEs), the manufacturing sector, inflation, population and employment. A key milestone of WGDSA23 was the presentation of Malaysia's preliminary 2025 Action Plan for the Awareness Initiative - an ACSS Annual Priority under the Asean Economic Community (AEC) reporting framework. "The initiative was previously endorsed by the Heads of National Statistical Offices (NSOs) at the 14th Session of the Asean Community Statistical System (ACSS14) in Laos. "As the lead country, Malaysia announced the formation of a dedicated Task Force on Statistical Awareness and Engagement under WGDSA to spearhead its implementation," he said. The outcomes of WGDSA23 will directly inform the ACSS Action Plan 2026–2030, aligned with the broader Asean Community's post-2025 vision, reinforcing the role of statistics in regional integration and policy development.

Heidy Quah Gaik Li, the founder of Refuge for Refugees is claiming the use of the words "offensive' and annoy' in Section 233 of the Act are invalid as it goes against two fundamental human rights protected by the Federal Constitution. Section 233(1)(a) states that it is an offence for a person to make, create or solicit, and initiate the transmission of any online comment which is "obscene, indecent, false, menacing or offensive' with "intent to annoy, abuse, threaten or harass another person. In Sept 2023, the Shah Alam High Court dismissed Quah's lawsuit, leading her to file an appeal in the Court of Appeal. The hearing today was a continuation of proceedings that had begun earlier. Justice Lee was serving as a Court of Appeal judge before being elevated to the Federal Court in May this year. During today's hearing, senior federal counsel Liew Horng Bin representing the Malaysian government submitted that speech involving expletives, profanity, crude references, hate speech or incitement to violence are not expressions protected under Article 10 (1) (a) of the Federal Constitution. He argued that the right to free speech should be used to disseminate truth, respect for human dignity and perform essential informing function. On the other hand, lawyer Datuk Malik Imtiaz Sarwar, representing Quah argued the words "offensive' or annoy contained in Section 233 is inconsistent with Article 10 and Article 8 of the Federal Constitution, namely the right to equality and freedom of speech. He argued that the two words in Section 233 are not a "permissible restriction' under public order as prescribed in the Federal Constitution. In July 2021, Quah, 31, was charged in the Kuala Lumpur Sessions Court for allegedly making "offensive' online comments in a Facebook post.
