Police add 6 kg ganja to seized 230-kg bags; court acquits suspects

Chennai: While acquittals in ganja peddling cases due to lack of evidence are not uncommon, a Chennai narcotics court recently acquitted four individuals accused of smuggling 230 kg of ganja because the police submitted six kg more of the drug in court than what was originally seized.
The quantity variation found is very high, creating a reasonable suspicion about the seized property itself. The actual quantity is 230 kg, but it was 236.58 kg during the proceedings under Section 52A (during the destruction of the seized drug in the presence of a magistrate) of the NDPS Act, special judge for NDPS cases M Rajalakshmi said.
In addition to that, according to the case of the prosecution, two samples were taken from all five bags, each containing 50 grams.
Out of the two samples taken from five bags, one sample from each pair was sent for analysis to the forensic science laboratory, the court said.

According to the evidence given by the deputy director of the laboratory, the contraband is dry ganja, and hence there is no possibility of an increase in weight, she added. The court further pointed out that there was a delay of six days in sending the contraband recovered from the accused to the court, and meanwhile, the properties were kept in the police station.

"Even though the delay of six days is not so enormous, coupled with the evidence given by PW6 (DSP) that the seized contraband was kept in the police station without a seal and the huge variation in the quantity of samples and the bulk quantity recovered from the accused create a serious doubt whether the property produced before this court was actually recovered from the accused," the court wondered.
Since the prosecution did not succeed in proving the possession of contraband by all accused, nothing can be presumed by the court under the NDPS Act, the court said and acquitted all four accused.

Absconding for the past six years, the accused, Magaram, was operating a smuggling network in Rajasthan and Madhya Pradesh. Range IG Vikas Kumar said Magaram used to bring 4 to 5 consignments of narcotics each month from MP to the Marwar region. In 2019, while transporting 8 quintals of poppy husk, he abandoned his vehicle and fled when surrounded by police near Pachpadra police station. Illegal weapons and opium were recovered from the vehicle, leading to a case being registered against him under the NDPS Act. In 2023, RGT police caught him again while transporting poppy husk in a Scorpio vehicle. However, after being released on bail, he resumed his smuggling activities. Kumar said the team received information that Magaram was heading towards Gujarat in a truck after making a payment at a petrol pump. Acting on the tip-off, the team tracked him to Kadodara village in Surat, Gujarat. "Eventually, they caught Magaram while he was having a meal at a hotel near the village. When questioned, Magaram initially gave a fake name and address, but under strict interrogation, he revealed his true identity and confessed everything," said Kumar.

1 2 Nagpur: In a swift operation, Ganeshpeth Police arrested 29-year-old Sanket Buggewar for possessing 16 grams of MD powder, valued at approximately Rs1.67 lakh early Sunday morning. Acting on reliable intelligence, the police laid a trap between 3.53 am and 6.15 am near Hedau Restaurant, NIT Complex Road, in front of Ganeshpeth Bus Station. Buggewar, a resident of Ashirwad Nagar, was apprehended from a car. A search conducted in the presence of witnesses led to the recovery of four ziplock bags containing the narcotic substance. The police also seized the vehicle and a mobile phone, with the total value of confiscated items amounting to Rs18 lakh. During interrogation, Buggewar revealed that the MD powder was supplied by one Pranay Bazare, 25, also from Ashirwad Nagar. Both accused face charges under Sections 8(a), 21(b), and 29 of the NDPS Act.
