Baste Duterte to serve as acting Davao City mayor —Comelec

Vice Mayor Baste Duterte may serve as acting mayor of Davao City amid the detention of former President Rodrigo Duterte in The Hague, Netherlands, the Commission on Elections (Comelec) said Monday.
Citing the Local Government Code, poll chief George Erwin Garcia explained the rule of succession applies to cases of elected local officials who are temporarily incapacitated from performing their duties.
'Yes, by operation of the law,' Garcia answered when asked if the elected vice mayor will serve as Davao City's acting mayor.
''Yung mag-assume ng position will be assuming in an acting capacity unless maging permanent incapacity,' he said.
Section 46 of the Local Government Code states that 'when the governor, city or municipal mayor, or punong barangay is temporarily incapacitated to perform his duties for physical or legal reasons such as, but not limited to, leave of absence, travel abroad, and suspension from office, the vice-governor, city or municipal vice-mayor, or the highest ranking sangguniang barangay member shall automatically exercise the powers and perform the duties and functions of the local chief executive concerned, except the power to appoint, suspend, or dismiss employees which can only be exercised if the period of temporary incapacity exceeds 30 days'.
Meanwhile, Garcia said that upon assumption of office at 12 noon of June 30, local elected officials are now under the jurisdiction of the Department of the Interior and Local Government (DILG).
'Basta naproklama na at wala namang case sa amin na naka-pending, ang jurisdiction ay wala na sa amin. Basta walang kaso sa amin, walang nakapending, wala kaming naging desiyon, naproklama, kaagad ang jurisdiction ay malilipat sa DILG,' he said.
(As long as they were proclaimed and have no pending cases before us, the jurisdiction will be under the DILG.)
'Lalo na pagdating ng June 30. So kung sino ngayon ang uupo, sino papaupuin, ano nangyari sa kandidato, yan ay call na ng DILG,' he added.
(Come June 30, the DILG will have the say on who will serve and what will happen to the winning local candidates.)

The Commission on Elections (Comelec) has issued an advisory against a social media post circulating online which falsely states that money will be charged to those who seek to register as voters. In a "fake news alert" on Friday evening, the poll body denied that it now charges a P3,000-fee for each voter registration, as claimed by a bogus social media announcement. "Ang Facebook post na kumakalat ukol sa pagbabayad ng halagang 3,000 PHP para makapagparehistro bilang botante ay HINDI TOTOO at HINDI GALING sa tanggapan ng Commission on Elections," the poll body said. (The Facebook post spreading online about paying P3,000 to be able to register as a voter is not true and is not from the office of the Commission on Elections.) The Comelec added that the same misleading content was not posted in its official and verified social media channels on any platform. A total of 2.8 million Filipinos registered for the barangay and Sangguniang Kabataan elections (BSKE) during Comelec's 10-day voter registration drive. It kicked off on August 1, or nearly two weeks before President Ferdinand "Bongbong" Marcos Jr. signed into law Republic Act (RA) 12232, which postponed the polls from October 2025 to November 2026. The new law sets the term of office of all elected barangay and Sangguniang Kabataan officials to four years. Comelec Chairman George Garcia had said voter registration for the BSKE would resume in October this year. Also in its advisory, the Comelec insisted that it would never charge any fees to register as voters in any election. "Ang pagpaparehistro bilang botante ay isang karapatang ginarantiya ng ating Konstitusyon sa mga kwalipikadong Pilipino at walang anumang klase ng bayad ang kailangan para rito," the Comelec said. Defeated senatorial candidates of the Duterte-backed PDP Laban called on the Senate to probe the supposed "irregularities" during Eleksyon 2025. Israelito Torreon, lawyer of former senatorial candidate Apollo Quiboloy, and Jimmy Bondoc went to the Senate and filed a petition for the upper chamber and its concerned committees, especially the Senate Blue Ribbon Committee, to investigate the supposed 'direct and blatant involvement of the Commission on Elections (Comelec) in the widespread and well-documented irregularities in the 2025 National, Local, and Bangsamoro Elections.' In the letter addressed to Senate President Francis 'Chiz' Escuderom, Torreon enumerated several alleged 'anomalous and irregular' instances involving Comelec during the midterm polls. Among them are the alleged mishandling of election paraphernalia, online voting irregularities, questionable procurement activities, and mismatches between ballot contents and voter receipts. 'Indeed, the 2025 Elections revealed the vulnerabilities and statutory gaps in our current automated elections system,' the letter read. Of the 12-man PDP Laban senatorial slate, five candidates won in the last elections, namely Senators Ronald dela Rosa, Bong Go, Rodante Marcoleta, Camille Villar, and Imee Marcos. "While we celebrate the victory of our peers here in the new Senate, we also cannot in good conscience turn a blind eye to the frustrating realities that diminish the faith of the Filipino People in our democratic process," added the petitioners in the letter. Comelec, meanwhile, said it welcomes the possible probe of the Senate. 'We believe a prompt and thorough Senate inquiry will greatly assist the public in understanding the gravity of these issues, and allow the legislature to explore remedial or regulatory measures to ensure that the next elections are secure, transparent, and genuinely reflective of the will of the People,' said Comelec in a statement. To recall, the PDP Laban in June also filed a petition before the Supreme Court seeking for a manual recount of senatorial votes in the 2025 elections. Comelec chairman George Garcia previously noted that the random manual audit of the automated elections indicated a 99.997% accuracy by the machines used. Election lawyer Romulo Macalintal on Friday asked the Supreme Court (SC) to declare the law postponing the Barangay and Sangguniang Kabataan Elections (BSKE) as unconstitutional. In a 34-page petition, Macalintal asked the Court to declare Republic Act (RA) 12232 unconstitutional, or to the extent that it pertains to the postponement of the election on December 1, 2025. This came after President Ferdinand 'Bongbong' Marcos Jr. signed into law the measure seeking to postpone the BSKE to November 2026. Macalintal also sought a temporary restraining order and/ or status quo ante order directing the respondents to cease and desist from implementing RA 12232 or to observe the status quo before its passage. He also asked the Court to direct the Commission on Elections (Comelec) to continue preparing for the December elections. The respondents are the Senate of the Philippines, the House of Representatives, the Office of the President, through Executive Secretary Lucas Bersamin, and the Comelec. When sought for comment, Comelec chairperson George Garcia welcomed the filing, saying that the 'cloud of uncertainty should be removed outright.' 'Early filing of petition means early determination whether to proceed or not with our preparations,' Garcia said in a statement. In his petition, Macalintal argued that the postponement is a violation of the people's right to suffrage and a violation of their right to information, affecting their constitutional right. 'Maging doon sa desisyon ng ating Korte Suprema sa kaso ng Macalintal vs. Comelec noong 2023, sinabi ng ating Korte Suprema na walang kapangyarihan ang Kongreso na mag-postpone ng halalan ng walang ano mang dahilan, mabigat na kadahilanan,' he said.
