Pune Police Challenge Juvenile Justice Board Order In Porsche Crash Case, Seeks Teen's Trial As Adult

The Pune Police has approached the sessions court challenging the Juvenile Justice Board's (JJB) order denying permission to try the teenager accused in the Porsche crash case as an adult. Speaking to CNN-News18, advocate Prashant Patil, who represents the boy, confirmed the development but said he has not yet received a copy of the police's plea.
In its petition, the police have termed the matter an 'exceptional case" and sought a psychoanalysis test of the juvenile. The move comes after the JJB ruled that the 17-year-old, accused of fatally running over two people while allegedly driving a Porsche under the influence, would be tried under the Juvenile Justice Act.
The high-profile crash took place in Pune's Kalyani Nagar area in May last year, killing IT professionals Anish Awadhiya and Ashwini Costa, who were on a motorcycle.
The Juvenile Justice Board had earlier rejected the Pune Police's plea to try the teenager accused in the Porsche crash case as an adult. The board ruled that the accused, who was 17 years old at the time of the incident, would be tried as a minor under the Juvenile Justice Act.
The prosecution had pressed the Juvenile Justice Board (JJB) to try the 17-year-old boy, accused of fatally running over two people while allegedly driving a Porsche under the influence, as an adult, citing the 'heinous" nature of the crime.
Senior Advocate Vikas Pahwa said the intent behind Section 15 of the Juvenile Justice Act is fundamentally rooted in the principle of reformation for children in conflict with the law. 'The provision is well-meaning and should remain in place," he noted, but added that its implementation is often casual and inconsistent.
'This casual approach needs to be addressed, either by the Supreme Court or through legislative intervention by Parliament," he had earlier said, pointing out that the provision was introduced following the Nirbhaya case to strike a balance between justice and rehabilitation.
He further said the Act does provide a mechanism for appeal against the Juvenile Justice Board's order and suggested that Pune Police could explore that option in this case.
'In several instances, proper psychological and social assessment is not conducted as per the guidelines. This leads to juveniles involved in heinous crimes slipping through the cracks," Pahwa observed. 'A more rigorous and standardised implementation of the law would better serve its original reformative intent."

The Gopalapuram police have transferred the Universal Srushti Fertility Centre child-trafficking and surrogacy case to the Special Investigation Team (SIT) of the CCS , Hyderabad, for further investigation. So far, 25 people, including five doctors, have been arrested in connection with nine cases registered at the Gopalapuram police station. These arrests are linked to an alleged inter-state racket. Another case was filed by a 90-year-old gynaecologist, Suri Srimathi, who said her name had been illegally used on the centre's letterhead to carry out illegal activities . As quoted by TOI, they said Dr Namratha convinced them to choose surrogacy instead, charging more than Rs 30 lakh for 'guaranteed babies'. The couples were never told who the surrogate mothers were. In one case, a couple was told their surrogate child had died at birth, while DNA tests in two other cases did not match the babies given to the clients. North Zone DCP Rashmi S Perumal said, as reported by TOI, that Dr Namratha ran a network of clinics in Secunderabad, Kondapur, Visakhapatnam, Vijayawada, Nellore, Rajahmundry, Bhubaneswar, and Kolkata. The alleged method was to attract couples through IVF, then persuade them to switch to surrogacy, promising to handle all legal work. Agents reportedly convinced financially struggling women to sell their babies, paying Rs 3.5 lakh for a girl and Rs 4.5 lakh for a boy. Victims were charged Rs 30–40 lakh. The DCP added, as quoted by TOI, that the accused faked DNA and medical reports by using the biological mother's DNA in place of the client's. The arrested include Dr Namratha; her son PSS Jayanth Krishna; doctors from Visakhapatnam and Gandhi Hospital; embryologists; branch managers; nurses; agents; and three parents who allegedly agreed to the illegal sale of their children. Police have seized about 50 files from the centre's offices and are checking them for more possible victims. Bank accounts linked to the accused have been frozen. According to police, Dr Namratha was previously involved in 15 criminal cases across Hyderabad, Visakhapatnam, Vijayawada, and Guntur. Some were settled, while others are still in court. New Delhi, Aug 13 (PTI) Two men, who were arrested for allegedly raping two nine-year-old girls and holding them captive overnight at a private swimming pool in Narela, lured them by purchasing perfumes at a nearby store, an official said on Wednesday. The accused, identified as Anil Kumar (37) and Munil Kumar (24), allegedly took the two girls, who lived with their families at a slum in Bawana, on August 5 to a nearby shop after they came to the swimming pool, about four to five kilometers away from their home, he said. 'They bought them perfumes at the store. The third girl, around 12 years of age, who had come along, went back home," a senior police officer said. The complaint filed by the mother of one of the girls stated that her daughter had been playing at her aunt's house in Bawana when she, along with two other girls, went to the pool. However, the two nine-year-old girls didn't come home that day and returned around 5 am the next day. The girls did not immediately reveal the crime to their parents as the accused allegedly threatened to kill them if they did so. However, two days after the incident, the girls said they had been locked in a room and raped by Anil, a contractor employed by the pool's owner, and Munil, the pool's caretaker, the officer stated. The accused also allegedly asked the girls for money, to which the minors said they had none. A case was registered on August 9 under Sections 70 (gang rape), 127 (wrongful confinement), and 351 (criminal intimidation) of the BNS and sections 6 (aggravated penetrative sexual assault) and 10 (sexual harassment) of the Protection of Children from Sexual Offences (POCSO) Act. 'The girls' medical examinations were conducted, and their statements were recorded before a judicial magistrate. The police arrested the two accused on August 10 from the swimming pool and recovered critical evidence," Deputy Commissioner of Police (Outernorth) Hareshwar V Swami said. Besides a pillow cover, a bedsheet, and two empty condom packets that were recovered, the police also seized the digital video recorder (DVR) of the swimming pool for gathering evidence, the officer mentioned, adding that the accused have no criminal records. South Zone Police achieve higher conviction rate in POCSO cases in 2025

South Zone Police have recorded a good jump in conviction rate in cases registered under Protection of Children from Sexual Offences (POCSO) Act in the first seven months of 2025. 'As many as 153 POCSO cases in the southern districts have resulted in conviction, involving 168 accused persons. Among them, 122 cases pertaining to child sexual abuse led to the conviction of 136 accused. This is a notable conviction rate of 70%,' said Inspector General of Police, South Zone, Prem Anand Sinha. The conviction rate had improved in comparison with that of 2024, he added. During the previous year, a total of 238 POCSO cases, involving 252 accused, ended up in conviction, with a 61% conviction, he added. Increased quantum of punishment The IG said that not just the conviction rate had improved but also the quantum of punishment had increased in many cases. 'The courts have awarded life imprisonment in 20 cases and 44 sentences of imprisonment of 20 years and above,' Mr. Prem Anand said. Among the southern districts, Dindigul has got the highest number of convictions in POCSO cases. It is followed by Theni and Kanniyakumari (20 cases each) Thoothukudi (18 cases) and Sivaganga (17 cases). Two accused in Dindigul district cases were sentenced to imprisonment of 30 years and 50 years respectively. In Sivaganga district, two cases resulted in 62 years of jail and 41 years of imprisonment on a concurrent basis. While one case in Theni ended up in double life imprisonment, three cases -- two from Theni and one from Kanniyakumari – resulted in imprisonment exceeding 30 years. Among the nine POCSO cases registered along with Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act that resulted in conviction, life imprisonment was awarded in one case each in Dindigul and Ramanathapuram districts. A 20-year sentence was imposed in one such case in Sivaganga. The police in South Zone continue to maintain a stringent and committed stance against crimes targeting children. 'Final reports in POCSO cases are being filed within the mandated 60-day period, thus ensuring a timely progression of investigations,' Mr. Prem Anand said. Besides, the police are conducting targeted awareness sessions to disseminate information on the provisions of the POCSO Act, victim rights, and other relevant legal safeguards. The police are also working in close coordination with the CWCs (Child Welfare Committees) at the district level to ensure better victim support, awareness and reporting. Expeditious trial 'In a majority of cases, trials have been completed within 1–2 years on an average, enabling a swift justice delivery,' he added. The police remain committed to thoroughout investigations, timely charge-sheet filing and active trial follow-up, reaffirming their resolve to protect children and support victims through every stage of the criminal justice process. The improved conviction rate also reinforced public trust in the criminal justice system.. Detention under Goondas Act The Inspector General of Police said that South Zone Police had also intensified action against sexual offenders and had detained 93 of them under the Goondas Act. In order to keep a sustained monitoring against sexual offenders, a total of 799 historysheets were being maintained across South Zone.
