Supreme Court asks YouTube channel to first approach High Court in ‘Dharmasthala burials' case

The Hindu23-07-2025
The Supreme Court on Wednesday (July 23, 2025) declined to hear a challenge to an 'ex-parte' and 'sweeping gag order' passed by a Bengaluru civil court restraining media outlets from publishing any defamatory material against Harshendra Kumar D., brother of Dharmasthala pattadhikari D. Veerendra Heggade, in connection with the alleged burials in the temple town.
Chief Justice of India B.R. Gavai, when the petition was mentioned orally for an early listing, advised advocate A. Velan, appearing for the YouTube channel, Third Eye, to first approach the Karnataka High Court.

The petition had sought an interim stay of the civil court order of July 18, which had also directed the media to take down any content already published in connection with the issue.
It argued that the civil court 'effectively imposed a sweeping gag order and mandatory content deletion on hundreds of media entities nationwide'.
'This order, secured through a calculated abuse of judicial process and material misrepresentation by the plaintiffs, directly obstructs a high-level State criminal investigation into allegations of mass burials and serious crimes linked to the influential Dharmasthala temple. It
is a frontal assault on the freedom of speech and the Press (Article 19(1)(a)) and the foundational principles of natural justice and due process (Article 21),' the petition said.
The Karnataka government has already constituted a Special Investigation Team to enquire into the allegations.

SC Justice Surya Kant inaugurates legal aid centre for armed forces families

Supreme Court Justice Surya Kant virtually inaugurated a specialised legal aid centre for armed forces personnel and their families on Monday, emphasising that those who fight for the country deserve 'justice and honour' while their families merit 'justice with dignity.' The program was organised by the High Court of Jammu and Kashmir and Ladakh in Srinagar. Under the NALSA Veer Parivar Sahayata Yojana, the inauguration of a dedicated legal aid centre for armed forces took place at the Sainik Welfare Department in Ghorpadi, coinciding with Kargil Vijay Diwas celebrations. The initiative was a collaborative effort between the National Legal Services Authority, Maharashtra State Legal Services Authority, District Legal Services Authority, Pune and the Maharashtra State Soldier Welfare Department. Speaking at the event, Pune Divisional Commissioner Dr. Chandrakant Pulkundwar said, 'The Legal Aid Centre is a step to honour soldiers and their families. It is an excellent example of administration, judiciary and social commitment working together.' He emphasised that providing timely and free legal aid with dignity is essential for military personnel and their dependents. Justice Mahendra K. Mahajan, principal district and sessions judge, Pune, said that around 50 percent of citizens are unaware of available legal aid schemes and government benefits. 'This especially includes the families of military officers and employees,' he said. 'Our soldiers do not retreat under any circumstances; they always stand to protect the country. Protecting them and their families is the true form of justice.' Secretary of Pune District Legal Services Authority Sonal Patil said, 'A soldier fights on the battlefield, but after him, his family's fight for justice begins. It is our duty to stand by them in that fight.' The centre will provide legal services, including advice on criminal, civil, service, and pension matters, assistance with accident and insurance compensation cases, guidance on property disputes, information about government schemes, free legal representation, and counselling services.

AAP moves SC against UP govt move to merge schools with low enrolment

Lucknow: The Aam Aadmi Party has taken its fight against the merger of schools with low enrolment in Uttar Pradesh to the Supreme Court. Party MP and UP in-charge Sanjay Singh filed a petition in the SC, challenging the UP govt's order issued on June 16, to close some primary schools and merge them with other schools within a 3 km radius. Singh called the govt's decision "arbitrary, unconstitutional, and against children's right to education," alleging that it violates not only Article 21A of the Constitution but also the spirit of the Right to Education (RTE) Act. An AAP functionary in UP said that the party highlighted the danger of closing primary schools, forcing children aged 6 to 14 years to travel 3 to 4 km through difficult and dangerous routes, including forests, railway tracks, highways, and other risky paths, which is not only impractical but could be life-threatening for children. In the petition, Singh said that as per the RTE Act, there has to be a primary school within a 1 km radius for every settlement with a population of 300. He added that before issuing this order, the govt did not consult school management committees nor seek approval from the legislative assembly. Moreover, he said, it is being implemented in the middle of the academic session, causing significant inconvenience to thousands of students and parents. Singh also argued that the order will have the worst impact on girls, children from marginalised communities, differently-abled children, and families living in remote areas.
