The Delhi High Court on Wednesday directed the Delhi Police and the Delhi government's Excise department to submit the details of the action taken against clubs, pubs, bars and restaurants, which are operating illegally, including those running in violation of the licence conditions.
The bench of Chief Justice DK Upadhyaya and Justice Tushar Gedela was hearing a public interest litigation (PIL) filed by Mahtab Khan, a Delhi resident.
In the petition, Khan submitted that at least 21 such establishments were operating in violation of the licence conditions. Violations included operating and selling alcohol past the permitted hours, clubs operating out of fake hotels, a lack of ample security and safety measures, serving alcohol without adhering to age-limit restrictions, among others.
Upon an oral inquiry from the court on the action taken, the Excise department informed the bench that it has already imposed penalties on 14 of the 21 establishments listed in the petition. The court went on to direct the authorities to file responses on the action they have taken against such violations so far.
Khan, through his advocate Sitab Ali Chaudhary, highlighted before the bench that the operations of these establishments are causing a loss to the state exchequer due to violation of licensing regulations under the Excise Act.
'These establishments are operating clandestinely with the apparent assistance and complicity of officers from both the Delhi Police and the Excise department,' the PIL alleged. It also flagged that several establishments were operating until 7 am, defying the order that prevents pubs, and bars from serving alcohol past 1 am.
In his PIL, Khan argued that only establishments with L-16 licence can operate for 24 hours. He underlined that the mandatory prerequisite for issuing an L-16 licence is that such an establishment must be located within the premises of a 5-star hotel or a hotel of a higher category.
Khan, in his petition, has listed 21 such establishments where he or his associates visited and found various violations, including some being located in places where fire tenders could not enter in the absence of a proper approach road. The PIL argued that it puts people's lives at risk.
The court has posted the matter for further consideration on August 27.

A proposal was thus prepared by the home department and sent to the LG for his approval. Agency: Last Updated: August 12, 2025, 20:00 IST Representational image (Image: News18) Lucknow, Aug 12 (PTI) The Uttar Pradesh Police on Tuesday said they have busted a gang allegedly involved in mixing ethanol and solvent chemicals in stolen petrol and diesel on a massive scale for sale, with the arrest of five people. The arrests were made following a raid conducted around 2.15 am near Lodhamau village on the Kisan Path highway towards Sitapur. Police said that adulterated fuel can cause serious damage to vehicles, often leading to breakdowns much earlier than normal. According to an STF statement, Ramu Yadav, Sukhbir Kumar, Sujit Kumar, Rinku Singh, and Mohammad Deenu were nabbed with a tanker carrying 15,000 litres of petrol and 5,000 litres of diesel, as well as drums of ethanol, solvent chemicals and petrol. The STF team also seized multiple vehicles, fuel extraction pipes, motorised filler machines, a generator, mobile phones, Indian Oil invoices, and cash. Investigators allege the gang used to steal fuel from tankers, replace the siphoned quantity with solvent chemicals, and then deliver the altered fuel to buyers in Lucknow and surrounding districts. The accused reportedly sold the product for Rs 75 to Rs 80 per litre, while buying the solvents for about Rs 30 per litre. Tests by the excise department confirmed the seized liquid contained ethanol and solvents. According to officials from the L-G Office, this marks a departure from the current requirement for officers — including investigating officers and those who are witnesses in criminal cases — to be physically present in court for providing evidence or deposition. Officers will no longer have to travel and physically attend court proceedings — saving a great amount of time and resources. This major reform comes under the draft model rules (Nyaya Shruti) on video conferencing under the Bharatiya Nagarik Suraksha Sanhita, which recommends for inclusion of police stations as a 'designated place' for deposition through video conference for police personnel/officers. According to Delhi Police estimates, on average, nearly 2,000 police officers depose before various courts every day. Officials said the move is expected to bring greater transparency and efficiency in overall police functioning. Further, it would decongest the courts and enable police officers to devote more time to policing and the investigation of other cases. Earlier, the video conferencing facility for providing evidence was only available in the Delhi High Court, District Courts, Delhi Prisons, Hospitals and the Forensic Science Laboratory, and some government offices.
