Academician calls for compulsory dashcams in all Malaysian vehicles

KUCHING (June 11): Dashcams should be mandatory in all vehicles in Malaysia to enhance road safety and support legal proceedings, said Dr Muzaffar Syah Mallow.
In this regard, the Universiti Sains Islam Malaysia's Faculty of Syariah and Law associate professor urged the government to review existing laws, particularly the Road Transport Act 1987 (Act 333), to introduce new provisions making dashcams mandatory.
'The government can consider requesting vehicle owners in the country to instal dashcam inside their vehicle by themselves or requesting car manufacturers in the country to add a dashcam component to every vehicle which they produce.
'Whatever approach we take, we should never undermine the importance of a dashcam. With so many issues which occur on the road, dashcam footage can serve as vital evidence when needed,' he said in a statement today.
He explained that modern dashcams, now compact and easy to mount, allow drivers to record visuals of any road incidents they encounter.
'Drivers may opt to instal dashcams in their vehicles for liability protection. I f a driver is involved in an accident or is accused of a crime, the lawyer may be able to use the footage from a dashcam as evidence to assist the driver with their legal battle in court,' he said.
Highlighting the risks drivers face—such as accidents, snatch theft, road bullying, and harassment—Muzaffar said recorded visual evidence can assist them in filing police reports, insurance claims, and even in legal cases.
Legally, Dr Muzaffar said dashcam footage qualifies as admissible documentary evidence in court, provided it is relevant, strong, and credible.
He cited Section 3 of the Evidence Act 1950 (Act 56), which states that evidence includes both oral and documentary forms, such as visual recordings.
'This view is based on the case of Chin Seow Noi v PP (1994) 1 SLR 135, where the court said that 'The use of the single word 'includes' in our Section 3 is clearly intended to make the definition of evidence in our Evidence Act an extensive one.'

Seri Alam district police chief, Assistant Commissioner Mohd Sohaimi, Ishak said the accident occurred after the victim ran a red light, leaving the bus driver unable to stop in time. The case is being investigated under Section 43(1) of the Road Transport Act 1987. "The accident involved a Hino bus driven by a 54-year-old man and a Honda EX5 motorcycle ridden by a 20-year-old man, who works as a part-time e-hailing rider. "Investigations revealed that the incident occurred at around 6pm when the bus was heading straight through a green light from the direction of Kong Kong towards Masai. "Suddenly, the motorcyclist emerged from the left junction at Jalan Berlian 12 when the traffic light was red, entering the path of the oncoming bus. "The driver was unable to brake in time and collided with the victim, who was thrown onto the road and dragged for approximately 15 metres before the bus came to a stop," he said in a statement. Mohd Sohaimi said the rider, who sustained serious injuries, was taken by ambulance to Sultan Ismail Hospital, where he is being treated in the red zone and remains unconscious. The bus driver was uninjured. He also advised road users to remain patient, and to obey traffic rules and regulations at all times. "Anyone with information or who witnessed the incident is urged to contact the police at 07-3864222 to assist in the investigation," he added.

KOTA SAMARAHAN (June 12): A 27-year-old man was killed in a road accident this afternoon after the motorcycle he was riding collided with a four-wheel-drive (4WD) vehicle at KM8 Jalan Kota Samarahan–Sadong Jaya in Asajaya. Kota Samarahan District Police Chief Superintendent Damataries Lautin said the incident occurred at around 3.05pm, when the victim was believed to have lost control of his motorcycle and veered into the opposite lane. The motorcycle collided head-on with a 4WD travelling from Asajaya towards Kuching. 'The victim was pronounced dead at the scene at 3.55pm by medical personnel. His body has been sent to the Sarawak General Hospital Forensic Unit for a post-mortem,' Damataries said in a statement. At the time of the crash, the weather was clear, the road was dry, and the two-way dual carriageway was in normal condition. The driver of the 4WD sustained only minor injuries, with bruises on his left arm. His vehicle suffered front-end damage, while the motorcycle was severely damaged. The case is being investigated under Section 41(1) of the Road Transport Act 1987 for reckless driving causing death. IPOH: The bus driver who was involved in an accident that claimed the lives of 15 students of Universiti Pendidikan Sultan Idris (UPSI) in Gerik, last Monday (June 9), has been arrested by the police. Perak Police Chief Datuk Noor Hisam Nordin said the 39-year-old man was arrested at around 5.45pm after being discharged from the hospital, reported Sinar Harian. According to him, the suspect would be taken to the Gerik District Police Headquarters (IPD) to assist in the investigation under Section 41(1) of the Road Transport Act 1987. "We are waiting for further instructions from the State Prosecution Director on whether the bus driver can be charged in court tomorrow or otherwise," he said on Thursday (June 12). The driver, a local man, had previously received treatment at Taiping Hospital after injuring his hand on the first day of the accident. On the morning of June 9, KM53, Jalan Raya Timur-Barat (JRTB) Gerik-Jeli near Tasik Banding, a bus carrying 42 passengers was said to have lost control before hitting an MPV carrying a family of four. The incident happened when the specially chartered tour bus was on its way from Jertih, Terengganu, to the UPSI campus in Tanjung Malim after the Hari Raya Aidiladha holiday.
