A New York judge has called for convicted sex offender Harvey Weinstein to face a retrial before the end of this year over allegations he raped actress Jessica Mann.
In June a mistrial was declared in the case after a jury failed to reach a verdict amid chaotic scenes that saw the foreperson refuse to continue deliberating following what they alleged were threats from a fellow juror. Weinstein denies any wrongdoing in the case.
Newsweek contacted Weinstein's attorney for comment on Thursday via email outside of regular office hours.
Why It Matters
In 2017 a series of sexual assault allegations were made against Weinstein, a celebrated film producer, sparking the global #MeToo movement, which saw a number of prominent men accused of sexual abuse.
Weinstein was convicted of rape by a New York court in 2020 and ordered to serve 23 years in prison. However in 2024 New York's highest court overturned the conviction after concluding the judge prejudiced the jury by allowing women who had made assault allegations against Weinstein that were not included in the case to testify.
What To Know
On Wednesday New York Judge Curtis Farber, who is presiding over the Mann case, said he wants a retrial to take place before the end of this year according to NBC News.
In June a jury found Weinstein guilty of sexually assaulting Miriam Haley, a former Project Runway production assistant, but he was acquitted on similar charges against former Polish model Kaja Sokola.

However a mistrial was declared on a charge related to Mann after the jury struggled to reach a verdict, with the foreman telling the court a fellow juror had appeared to threaten him by commenting "you know me, you are going to see me outside."
Judge Farber has said he doesn't want to sentence Weinstein over the Haley case until a retrial is held over the Mann accusations.
Weinstein denied the assault allegations against Mann, Haley and Sokola stating sexual interactions with his accusers had been "consensual" and "transactional."
Separately in December 2022 Weinstein was found guilty of rape in California and sentenced to 16 years in prison. He denied any wrongdoing in the case and is currently appealing.
Weinstein is being held in New York's Rikers Island prison, which he has described as a "hell hole." In September 2024 he underwent heart surgery and spent time in a secure hospital unit.
What People Are Saying
Weinstein's attorney Arthur Aidala has urged prosecutors to drop the Mann case commenting: "In the big picture, even if Mr. Weinstein got convicted of Jessica Mann, there would probably be very little effect on what his ultimate sentence would be."
Aidala said Weinstein would plead not guilty in a retrial as he "doesn't want the word rape associated with him in any way, shape or form."
Speaking to a judge in January Weinstein said: "I can't hold on anymore. I'm holding on because I want justice for myself and I want this to be over with."
What Happens Next?
Judge Farber has yet to announce a date for the retrial. Weinstein is not expected to be sentenced over the Miriam Haley case until this has taken place.

Neighbor Leaves Garage Cracked Open, Who's Peering Underneath Goes Viral
Based on facts, either observed and verified firsthand by the reporter, or reported and verified from knowledgeable sources. Newsweek AI is in beta. Translations may contain inaccuracies—please refer to the original content. A recent TikTok video has captivated thousands, all thanks to a small act of kindness from a dog owner. The clip shows a garage door cracked open just enough for a dog to squeeze a flattened body underneath. The adorable moment reveals the pup splayed out on the ground, peeking under the door with a fixed gaze. Since the video was posted, it has received over 467,000 likes. The video's caption says the creator's neighbors "always crack their garage open so their dog can people watch." Stock image: A person opens their garage door. The comments section of the video filled with users expressing their delight. "If not pancake, then why pancake shaped?" one person wrote, while another user added: "I love how it's not [open] enough that he can get out." "President of the neighborhood watch committee," a third wrote. The dog's commitment to its hobby resonated with other pet owners. One user shared a similar experience. "My dogs used to do that under the fence at my old house, just peeking up at people throwing their trash," they wrote. Many viewers also expressed their desire to join the dog in its pastime. "Ooh and in the shade too! The way I'd be lying down and talking to them like they were my shrink," a commenter posted. Another added: "You'd catch me laying on the ground petting him kicking my little feet having the time of my life." Dogs Love People Watching This isn't the first time that a dog's love for people-watching has gone viral. Newsweek previously reported on a black Labrador retriever who also loved to socialize from his yard. In that instance, the owner went so far as to carve a lookout hole into her fence, demonstrating the lengths owners will go to accommodate their curious pups. While the most-recent viral video captures a heartwarming moment of a dog enjoying a low-key hobby, experts say it is important for pet owners to keep their animals active. An August 2022 study published in PLOS One highlighted the importance of a balanced routine for pet health. "Dogs who exercise less frequently or less intensely are more likely to be overweight," the study said, concluding that "a more holistic approach to changing both dietary and exercise routine needs to be made" to treat obesity in canines. The dog in the garage video serves as a sweet reminder of the love between dogs and their owners, and the small ways that humans cater to their pets' unique personalities—all while reinforcing the importance of keeping furry friends happy and healthy. Puppy Lives Near Farm, Owner Obsessed With Who She Befriends: 'Happy Tail'
Based on facts, either observed and verified firsthand by the reporter, or reported and verified from knowledgeable sources. Newsweek AI is in beta. Translations may contain inaccuracies—please refer to the original content. A Staffordshire bull terrier has delighted the internet with her unexpected friendship—not with another dog, but rather, a herd of cows. Dog owner Skye Campbell, 29, loves seeing her 18-month-old puppy Luna making new friends and being so sociable with everyone she meets. But she isn't only excited about meeting new people and other dogs, because as it turns out, she can't get enough of the cows in the neighboring field. Campbell, from Scotland, told Newsweek that the herd of cows have become Luna's "best friends" and she runs up to the fence between the fields at every opportunity she gets. Luna spends so much of her day sitting by the fence, waiting for her cow friends to come out, and then proceeds to lick their noses when they arrive. "She is the happiest, sweetest girl and I always say that she believes every living thing is on this earth just for her," Campbell said. "She wants to be best friends with everything. Anything that moves, she wants to play with. Luna approaching the fence to see the cows in the field. Luna approaching the fence to see the cows in the field. @skyecampbell96 / TikTok "Every time they are near, she will run up and down the fence with happiness, almost like she can't pick which cow to go up to first. She then likes to lick their noses and faces, and they will lick her back," she continued. Seeing the connection between Luna and the cows melts Campbell's heart every time. Luna couldn't be any cuter when she runs up to the fence to say hello to her besties, before running back to her owner with "happy tail wags." "She looks out for them, and they watch out for her. They will lie along the fence in our back garden and wait on her coming out," Campbell said. Videos of Luna and the cows together have been shared on TikTok (@skyecampbell96) and internet users can't get enough. Many of the clips have gone viral, with one showing Luna running back and forth to the fence generating over 914,600 views and 120,100 likes on TikTok at the time of writing. The social media response is beyond anything Campbell expected, but she's so happy to see her sweet pup receiving so much love and appreciation. Campbell told Newsweek: "I am utterly overwhelmed but so blessed. Luna brings so much joy to us, so it's only fair we share that with the world. And the comments from people saying that we made their day means everything to us. "Luna is my soul dog and my best friend, and she truly deserves to be shared with people because she is just the best." Internet users have been full of praise for Luna's adorable friendliness, leading to over 1,000 comments on the viral video so far. One comment reads: "My heart cannot handle the cuteness. That smile... the zoomies... the tail wag!" Another TikTok user wrote: "I think you need to talk to your neighbors about a play date." While another person joked: "Cows are just bigger puppies."
