Federal Court grants Najib leave to seek review on purported house arrest order

PUTRAJAYA, Aug 13 — Former prime minister Datuk Seri Najib Razak is now cleared to pursue his legal challenge over an addendum or 'supplementary order' issued by a former King permitting him to serve the remainder of his reduced sentence under house arrest.
This follows the Federal Court's three-member bench unanimous decision to dismiss the Attorney General's Chambers' (AGC) appeal against a lower court decision to grant Najib leave to proceed with his court case seeking house arrest.
The Federal Court said the addendum order's existence has been previously confirmed following concessions made by the Attorney General in previous hearings despite its validity being inconclusive at this stage.
"Its status vis-a-vis its validity or whether its true needs to be ascertained at the substantive judicial review hearing which we do not consider it right or fair for us to express any view on this point at this stage.
"It is a point for further investigation on a full interparty basis with all such evidence as is necessary on the facts and all such arguments as is necessary on the law.
"Consequently we remit the case to the High Court for the hearing of substantive judicial review proceedings before a new judge," Federal Court judge Datuk Zabariah Mohd Yusof said in delivering the panel's decision.
The three-member Federal Court bench was led by Chief Judge of Malaya Tan Sri Hasnah Mohammed Hashim and included Zabariah as well as Datuk Hanipah Farikullah.
In a 2-1 majority decision on January 6, a three-member appellate court bench remitted the case on Najib's claim of the existence of an additional document — purportedly allowing him to serve the remainder of his six-year prison sentence under house arrest — to the High Court to be heard on its merits.

KOTA KINABALU, Aug 15 — Home Minister Datuk Seri Saifuddin Nasution Ismail will address the case regarding the death of Form One student Zara Qairina Mahathir in Parliament on Monday. He said it was essential to clarify the issue as members of the lower house of Parliament had widely raised the matter. 'I have chosen Monday (to deliver the minister's statement) in Parliament on this issue,' he told reporters after chairing the Main Committee for the Management of Foreigners in Sabah (JKPWAS-INDUK) 2022 meeting and the Sabah State Special Committee on Citizenship Status (JKKSK) meeting here yesterday. Zara Qairina was confirmed dead at the Queen Elizabeth Hospital in Kota Kinabalu, Sabah, on July 17 after being admitted to the hospital when found unconscious in a drain near the dormitory of SMKA Tun Datu Mustapha, Papar, at 4am on July 16. Yesterday, Bukit Aman Criminal Investigation Department director Datuk M. Kumar said the investigation into the death, previously classified as a sudden death, will now focus on potential criminal elements, including bullying. The Attorney General's Chambers will also conduct an inquest into the student's death after reviewing the investigation report submitted by the Royal Malaysia Police. Meanwhile, with regards to the case involving Pandan MP Datuk Seri Rafizi Ramli's son, the home minister said the police would make every effort to track down the perpetrator of the incident. He said the matter was not about whose child was involved but about the police's responsibility in ensuring public order, safety and the protection of all citizens, especially children. 'I leave it to the wisdom and swiftness of the police to handle this, and I pray that his son and wife recover quickly from the trauma,' he also said. It was reported yesterday that the former economy minister Rafizi's son was dragged out of their family car by two individuals dressed in black, with full-face helmets, and stabbed with a syringe at a shopping mall in Putrajaya at about 2pm. — Bernama

KUALA LUMPUR, Aug 15 — Ampang MP Rodziah Ismail has reportedly urged PKR not to 'sacrifice' the constituency, following the entry of former Umno leader Datuk Seri Tengku Zafrul Abd Aziz to the division. Rodziah said she believes there is a certain 'intention' behind Tengku Zafrul leaving Umno to join Ampang PKR — alluding to the potential of a triggering a by-election in the federal seat. 'My advice is that whatever the decision, wait until the current term is over. Don't make Ampang a seat to be sacrificed. 'If it's simply to give way or early passage to someone, and to ask any MP or assemblyman to make way, I think that's inappropriate,' she was quoted telling Utusan Malaysia. However, she said she would abide by the party's decision should it decide to field Tengku Zafrul in the constituency in the next general election. 'I have never been someone who clings to any seat. Even the Batu Tiga seat was once given away, and I accepted it. 'But my advice is that the party should not repeat moves that actually harm it,' she reportedly said. Umno Supreme Council member and Kota Raja Umno chief Datuk Seri Tengku Zafrul Abdul Aziz announced his resignation from Umno and expressed his intention to join PKR on May 30. Tengku Zafrul said last week his application to join PKR has since been approved and he is now a member of the Ampang division. On Wednesday, Umno said it will submit protest notes against any of its allies in the government who have allowed or planning to take its members to join their ranks.

BACHOK, Aug 15 — Police are seeking public assistance to locate a 15-year-old girl who went missing from Kampung Surau Budi, Jalan Tawang, last Tuesday. Bachok district police chief DSP Mohd Azrie Sulaiman said the teenager, Tuan Nurul Ain Najihah Tuan Perang, was reported missing by her father, Tuan Perang Raja Husin, after he noticed at 6 am that she was not in her bedroom. 'The victim was last seen at 11.30pm on Monday at her home,' he said in a statement yesterday. Mohd Azrie said the teenager, who had not been attending school since Form One, did not own a mobile phone and was found leaving home with her wallet and identity card.
