
EXCLUSIVE Inside the Labor Party's bold push to increase taxes on property investors: 'Government now has a mandate to rectify inequity'
Former Labor leader Bill Shorten lost the 2016 and 2019 elections with a plan to halve the 50 per cent capital gains tax discount to 25 per cent.
Albanese ruled out tinkering with capital gains taxes after taking over as Labor leader and went on to win the 2022 election from Opposition and was resoundingly re-elected in May.
But now a grassroots organisation within the Prime Minister's own party – Labor for Housing – wants the 50 per cent capital gains tax discount scrapped entirely, not just diluted.
That means someone who made a $100,000 capital gain on their investment property they rented out would be taxed on the entire increase, not just $50,000 of it.
Labor for Housing co-convener Julijana Todorovic told Daily Mail Australia the 50 per cent capital gains tax discount introduced in September 1999 needed to be dismantled for residential properties.
'We think it should be removed entirely, so not immediately,' she said/
'Property should not be an investment for which you can claim the discount.'
Ms Todorovic, a land rights lawyer, said the Albanese Government needed to scrap the 50 per cent capital gains tax discount during this term of Parliament without taking the policy to the next election.
'Our view is that the Labor government now has a mandate to rectify inequity in Australian society,' she said.
'While it's clear from the election results that we can't be too radical, we must do something to stem the flow of generational inequity.'
She argued the 50 per cent capital gains tax discount should be grandfathered for existing investors as the policy is scrapped for future purchases - a position the Greens took to the May election.
'We are proposing that residential property is removed as a category for which the discount can be claimed,' Ms Todorovic said.
'But we're proposing that this change is grandfathered to a certain date – so if people have structured their finances based on the discount, then they will have time to restructure – they won't be left high and dry.'
Labor for Housing argued that scrapping the 50 per cent capital gains tax discount would encourage investors to invest in technology instead of speculating on real estate, and driving up house prices.
'Australia's capital resources have become landlocked by a CGT discount on property,' it said in a submission to the government's August Economic Reform Roundtable.
'As Australia electrifies, transitions to renewables and increases our data capacity, businesses are struggling to find adequate capital.
'By incentivising investment in the productive powers of the market, the government can increase the circular flow of capital in the economy, creating jobs and additional economic activity.'
The Greens went to the last election with a plan to scrap the 50 per cent capital gains tax discount for future purchases of investment properties, and grandfather it to one property for those who already owned an investment property.
While Labor has a landslide majority in the House of Representatives, it needs the Greens in the Senate to get its legislation passed.
The Labor-aligned McKell Institute has called for the federal government to dilute the 50 per cent capital gain tax discount to 35 per cent for existing investment houses with a backyard.
This means $65,000 of a $100,000 capital gain would be taxed, up from $50,000 now.
But it has also called for the 50 per cent capital gains tax discount to be increased to 70 per cent for newly-built apartments, arguing this kind of policy would boost housing supply and encourage more off-the-plan unit developments.
That means only $30,000 of a $100,000 capital gain would be taxed.
The McKell Institute's Harnessing Aspiration report argued the existing 50 per cent capital gains tax discount encouraged investor speculators to buy up houses.
'There is a unique incentive for investors to speculate on existing detached houses rather than non-existing off the plan attached dwellings or established attached dwellings,' he said.
'The blanket tax treatment of each of these asset types means an investor is much more attracted to high-growth existing detached dwellings than moderate-growth attached dwellings, especially new builds.'
The average, full-time worker earning $102,742 a year is priced out of buying the median-priced house in every state and territory capital city except Darwin.
Ms Todorovic said Labor for Housing's call to scrap the 50 per cent capital gains tax discount wasn't about stopping property speculators.
'It won't – this isn't the tool to correct speculation, this is about removing incentives which preference land above other more productive investments,' she said.

Writers festival requires ‘complete self-censorship' over Gaza war, academic says, as speakers withdraw in protest
A number of authors and academics have withdrawn from this weekend's Bendigo Writers festival over a speaker code that one says requires 'complete self-censorship' over Israel's war in Gaza. Academic and author Dr Randa Abdel-Fattah, First Nations poet Dr Evelyn Araluen and Wiradjuri writer and poet Jeanine Leane are among those who have withdrawn from the festival over the code. Prof Clare Wright, a guest curator at the festival and Latrobe University academic, has also withdrawn for personal and professional reasons which include the code, a source told Guardian Australia. Author Kate Mildenhall, who was due to moderate a festival session, said she was not sent the code of conduct but has since become aware of it. 'In solidarity with the other writers who are withdrawing and also because of my own personal beliefs about the ideas of censorship I felt I was unable to continue with my participation in the writers festival,' she said. The festival's code, viewed by Guardian Australia, says speakers should uphold respectful engagements which involves avoiding language or topics that 'could be considered inflammatory, divisive, or disrespectful'. A source told Guardian Australia Bendigo Writers festival (BWF) sent some speakers the code of conduct on Wednesday – two days before the opening day. The code says that for 'La Trobe Presents panels', speakers must comply with the principles espoused in La Trobe University's Anti-Racism Plan, including the plan's definitions of antisemitism and Islamophobia. Dr Abdel-Fattah, a Macquarie University academic, said she could not appear at the festival 'as a Palestinian'. 'The actual wording of [the speaker code and La Trobe policy] requires me to engage in complete self-censorship, so, such as a profound act of gaslighting,' she said. La Trobe's 2025-2030 plan adopts University Australia's antisemitism definition. The adoption of a sector-wide definition earlier this year emerged as a key recommendation of a report on antisemitism on Australian university campuses, which found there was an 'urgent need for reform' to ensure the safety of Jewish students and staff. The definition states that antisemitism is: 'discrimination, prejudice, harassment, exclusion, vilification, intimidation or violence that impedes Jews' ability to participate as equals in educational, political, religious, cultural, economic or social life'. It states that criticism of the policies and practices of the Israeli government or state is 'not in and of itself antisemitic' but further reads: 'Criticism of Israel can be antisemitic when it is grounded in harmful tropes, stereotypes or assumptions and when it calls for the elimination of the State of Israel or all Jews or when it holds Jewish individuals or communities responsible for Israel's actions …' Some academics at Australian universities have warned the definition could have a 'chilling' effect and limit the scope of what can be taught on the Middle East. Abdel-Fattah said La Trobe's anti-racism plan makes no mention of anti-Palestinian racism. It includes a definition of Islamophobia – discrimination that may be racial, religious or cultural in nature and is defined as an irrational fear, hatred or prejudice of Islam, Muslims, Islamic traditions and practices, and those who appear to be Muslim. Abdel-Fattah said her new novel, Discipline, is centred on the story of a Palestinian author and journalist. 'The book is all about how their voices are repressed and censored and how their voices are managed through the language of policies, through the language of civility and politeness and not offending others,' she said. La Trobe University is one of the festival's partners. Wright was a guest curator of the festival's 'La Trobe Presents panels'. Araluen, a Goorie and Koori poet, said she hoped audiences would reconsider whether they wanted to attend a festival that has made it impossible for people to speak openly about their work, experiences or perspectives. 'It's really important to make sure that the art sector is not divorced from law and from policy and from morality,' she said. 'You can't place this form of censorship on artists and writers when we're being told to discuss things like First Nations, languages and the history of political representation of Aboriginal people, as is the event that I was programmed to speak on.' The programme of the two-day festival in regional Victoria says it includes events featuring 80 writers and speakers. The Bendigo Writers festival and La Trobe University have been contacted for comment.

Albanese says ‘Hamas will engage in propaganda' amid confusion over statements on Palestinian statehood
Anthony Albanese has warned media about Hamas propaganda, amid confusion regarding statements reportedly made by the terrorist group in relation to Australia's pledge to recognise a Palestinian state. Nine newspapers reported on Wednesday that the Hamas co-founder and senior official Sheikh Hassan Yousef had welcomed the decision, praising Australia's 'political courage' and calling on other countries to follow its example. But the group later said Yousef was in jail and not able to communicate with media outlets. Nine clarified on Thursday that the statement was from Yousef's office not the man himself. Australian Associated Press reported that Hamas's foreign relations chief, Istanbul-based Dr Basem Naim, had poured cold water on the veracity of the Yousef statement. 'Sheikh Yousef is in an Israeli jail for years now. I'm very surprised ... I doubt it's true,' he said referring to the statement attributed to Yousef. Guardian Australia reported the government's response to Nine's Wednesday report and the quotes attributed to Yousef. Critics of the Albanese government, including the federal Coalition and conservative media commentators, seized on the statement attributed to Yousef when attacking Labor's decision to recognise Palestine. The opposition's foreign affairs spokesperson, Michaelia Cash, claimed Albanese should 'hang his head in shame after being praised today by the terrorist group Hamas'. The opposition leader, Sussan Ley, pointed to 'the Hamas co-founder praising our prime minister for this decision'. Nine clarified on Thursday the statement had been issued by Yousef's political office in the West Bank, which it said 'issues statements on his behalf', and that Yousef was in prison. A statement on an English-language Telegram channel, purportedly run by Hamas, stated that Yousef was 'being held in poor conditions and is cut off from the outside world, with no means of communication with local or international press outlets'. It denied he had made any statement on Australia's recognition of a Palestinian state. AAP reported Naim referred to the Telegram statement, confirming its veracity. Albanese on Thursday said: 'Hamas do not want a two-state solution.' 'What they want is one state,' the prime minister said. 'And I noticed in the [Telegram] statement that's made today, they say that the alleged statement from the person yesterday is someone who's been in prison in Israel since October 2023 and has no means of communication. 'What that should be is a warning to the media, of being very careful about the fact that Hamas will engage in propaganda. Because what is happening is the international community is united about isolating Hamas, about supporting a peaceful way forward.' Ley on Thursday again claimed the terrorist group had given 'full-throated praise of the prime minister'. The government on Wednesday cautioned against legitimising the statement attributed to Yousef, with a spokesperson claiming Hamas 'always tries to manipulate facts for their own propaganda'. 'Media have a responsibility to make professional judgments to not promote propaganda of terrorist organisations to get cynical headlines,' they said. Nine on Thursday said the earlier statement attributed to Yousef had been provided by his political office in the occupied West Bank 'which issues statements on his behalf'. Nine said Yousef's office 'confirmed it had released the statement and that Youssef was still in jail'. Nine on Wednesday initially reported: 'Yousef, one of Hamas' most senior leaders in the occupied West Bank, said in a statement to this masthead.' Nine later added a clarification noting 'this story has been updated to clarify the statement was issued by Sheikh Hassan Yousef's office and that he is held in prison. A subsequent statement issued via a Telegram channel in Hamas's name has also been added to the story'. Nine declined to comment further. The ABC on Wednesday reported on a statement attributed to the Hamas media director, Ismail Al-Thawabta, that Australia's move to recognise a Palestinian state 'reflects a growing global awareness of the necessity to end the injustice suffered by our people for decades'. 'We call on the Australian government to translate this recognition into concrete actions — by exerting diplomatic pressure to end the Israeli occupation,' the ABC reported Al-Thawabta as saying.
