PUTRAJAYA: The Court of Appeal today allowed former attorney-general Tommy Thomas's appeal to reinstate his recusal application against Judge Roz Mawar Rozain from hearing Tan Sri Shahrir Samad's malicious prosecution suit against him.
A three-member bench led by Datuk Supang Lian made the decision on the grounds that a superior court would be better positioned to decide on the allegation of bias, as it was not involved in the trial proceedings.
The other members of the panel were appellate court judges Datuk Faizah Jamaludin and Datuk Ahmad Fairuz Zainol Abidin.
Faizah, when delivering the ruling, said the court agreed there was a real danger of bias if Judge Roz Mawar were to preside over the case, even if the bias was unintentional.
She said the court found that the High Court judge's findings were not based on the book authored by the appellant (Thomas) or on the pleadings (defence) filed by the respondent (Shahrir).
She said the court found that the judge's remarks were formed from her own personal opinion and not based on the merits, and that the judge's findings in the application to strike out the suit were unnecessary.
"As informed and fair-minded observers, based on the facts and circumstances of this case, we are of the view that the findings and observations raise a real risk of bias on the part of the judge.
"If this court finds that a real risk of bias exists, even if the lower court held otherwise, this appeal ought to be allowed.
"The judge in question should have recused herself from hearing any proceedings related to this case," she said.
The court also awarded RM30,000 in costs to Thomas.
Roz Mawar had dismissed Thomas's recusal application in January this year, ruling that it lacked merit.
This followed her decision in July 2024 to also reject Thomas' application to strike out Shahrir's suit.
She ruled that the former Johor Baru member of Parliament's claim did not amount to an abuse of court process and should be heard in full.
Shahrir filed the suit against Thomas, former Malaysian Anti-Corruption Commission (MACC) chief commissioner Latheefa Koya, the MACC and the government, citing malicious prosecution, malicious investigation, and wrongful arrest.
He alleged that Thomas had prematurely authorised his prosecution before the investigation was complete, particularly in relation to a charge for allegedly failing to declare RM1 million received from former prime minister Datuk Seri Najib Razak to the Inland Revenue Board.
Shahrir was fully acquitted in January 2023 after the prosecution withdrew the case.

The programme began with three concurrent knowledge-sharing sessions, each tailored to students, educators, and community leaders. The first session, held in the school hall and conducted by MACC senior superintendent Maini William, focused on instilling integrity values among youths while emphasising their role in cultivating a corruption-free culture from a young age. The second session, conducted by MACC Sarawak deputy director (prevention) Wan Ahmad Nidzam on the first floor of the public library, targeted teachers from SMK Bario and SK Bario. The session highlighted the responsibility of educators as agents of change in shaping a culture of integrity within schools and the wider community. Simultaneously, the third session was held on the ground floor of the public library for local community leaders and government department heads. Led by MACC Sarawak director Hasbilah Mohamad Salleh, the discussion centred on strengthening clean, ethical, and corruption-free governance at the community and departmental levels. The event continued with speeches from SMK Bario principal Robin Amir, BSSAA president Datin Pearl Masna Mohan, and Bario Sub-District administrative officer Richard Usah, representing Deputy Minister in Sarawak Premier's Department (Labour, Immigration and Project Monitoring) and Mulu assemblyman Datuk Gerawat Gala, also an alumnus of SMK Bario. The programme's official launch was performed by Hasbilah, who also officiated at the opening of 'The Lentern Nook', an open reading corner established in SMK Bario. Souvenirs were presented to the school and BSSAA, followed by a Corruption-Free Pledge (Ikrar Bebas Rasuah) led by the community and witnessed by Richard. In the evening, the MACC Sarawak delegation led by Hasbilah visited the Bario Asal Longhouse upon special invitation from the BSSAA. Pearl, hailing from the longhouse community, facilitated the visit. 'The spirit of honesty and cooperation that has long been central to Kelabit culture is in line with the principles of integrity championed by MACC. Home Minister Datuk Seri Saifuddin Nasution Ismail highlighted ESSCOM's commitment to peace, enabling initiatives like the MADANI Adopted Village Programme in Kampung Inderasabah. Saifuddin noted that ESSCOM allocated RM1 million for infrastructure projects in the village, including physical and non-physical upgrades. MELAKA: The Human Resources Ministry is studying the introduction of a dedicated mechanism to facilitate post-retirement employment, says minister Steven Sim. In doing so, the ministry recognised the need to balance opportunities for senior workers with the interests of the younger workforce, he added. Sim said his ministry is reviewing certain provisions within the Employment Act 1955, considered to be 'outdated', to ensure that returning retirees are given fair protection while also safeguarding hiring and promotion prospects for younger employees. 'We are looking at how to support post-retirement employment in a way that benefits both groups. "Senior workers today are healthier, living longer and bringing valuable experience but we must also be fair to young people entering the workforce,' he said after presenting RM50,000 in financial aid to St. John Ambulance at Ayer Keroh on Friday (July 4). Also present were Kota Melaka MP Khoo Poay Tiong, Ayer Keroh assemblyman Kerk Chee Yee and Kota Laksamana rep Low Chee Leong. Sim said that while suggestions had been received from various quarters on how to encourage seniors to re-enter the job market, the government must carefully assess the legal framework to weigh the pros and cons. 'Our labour law is so old that it dates back to an era when our police officers wore short pants. "Some provisions are no longer relevant and must be abolished as part of this reform process,' he said. Sim stressed that any mechanism for hiring retirees must include appropriate protection and safeguards and such measures would be aligned with a broader review of 28 existing labour laws aimed at modernising Malaysia's labour market. 'We are building a framework that focuses on welfare, skills development and productivity. "This is part of our commitment to labour market reform,' he added. Separately, Sim announced that his ministry plans to train 10,000 workers in basic emergency response skills, focusing on those in high-risk sectors. The initiative, he said, aims to reduce workplace fatalities and disabilities and to enhance compliance with national safety standards.
