
All depts asked to ensure women safety at workplace
Chief Secretary Manoj Ahuja wrote to all government departments to ensure compliance with the Provisions of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 by all institutions or organisations. In the letter, the Chief Secretary said that the implementation of the Prevention of Sexual Harassment (PoSH) Act in workplaces and institutions is essential to ensure a safe, respectful and inclusive environment for all, particularly women.
He has also directed the department heads and authorities that the compliance report on the action points be submitted to the Department of Women and Child Development within 15 days.
'Sexual harassment not only violates an individual's dignity and rights but also undermines productivity, morale and equal opportunities,' he said. Ahuja also mentioned in the letter that by enforcing the POSH Act, organisations fulfil their legal and ethical responsibility to prevent, prohibit and redress instances of harassment. He said it fosters a culture of accountability, encourages reporting without fear and builds trust among employees or members, ultimately contributing to a healthier and more equitable work or institutional space.
Ahuja has also advised all the department authorities to go for the constitution of Internal Committee (IC), capacity building and sensitisation, time-bound inquiry and redressal mechanism, annual reporting and transparency and responsibility of management.
'The head of the institution shall be held personally responsible for ensuring effective implementation of the POSH Act, as well as for any lapses in safeguarding complainants and preventing retaliation,' Ahuja said.
The Chief Secretary also asked all administrative heads to constitute or revalidate IC and ensure meeting of IC once in a month for the next six months to create awareness and build momentum for the campaign against sexual harassment in educational institutions.
Thereafter, the ICs should meet in each quarter as per the Act.
He asked the authorities to ensure the grievance redressal mechanism, such as the She-Box portal, along with details of the IC, is prominently displayed in multiple locations in all institutions, mandate periodic awareness and capacity-building sessions for all staff and students, monitor and enforce compliance through regular inspections and require all institutions to submit status reports.
The college and school authorities are also told to regularly visit educational institutions and interact with students, the Chief Secretary said.
The second-year B.Ed student of Fakir Mohan (Autonomous) College in Balasore died at AIIMS-Bhubaneswar on Monday night. She had set herself on fire on the college campus on July 12 over inaction against a professor who allegedly sexually harassed her. Stating that the State government is committed to ensuring the safety, dignity and empowerment of women in all educational and professional environments, Ahuja said district administrations are therefore expected to act with urgency and diligence to create a safe environment for girls and women and uphold the provisions of the law in both letter and spirit.

A 27-year-old Dalit IT professional was allegedly murdered by the family of a woman he was in a relationship with in a suspected case of hate crime in Tamil Nadu's Tirunelveli district, police said on Monday, adding that they have detained the 24-year-old accused. The accused, Surjit, is Subhashini's brother and son of sub-inspectors — Saravanan and Krishnakumari — who are attached to a battalion in Manimuthar in Tirunelveli . According to police, Subhashini's family belongs to the dominant Maravar community in southern Tamil Nadu, while Ganesh belongs to the Devendra Kula Vellalar community — a sub-caste of Dalits. 'The victim and the accused's sister were schoolmates and had known each other for a long time... The woman's family had objected to their relationship,' said a police officer aware of the matter, requesting anonymity. On Sunday evening, Subhashini's brother Surjit met Ganesh outside the clinic, where an argument broke out between the two following which Surjit allegedly hacked Ganesh to death with a sickle. Ganesh's body was later recovered just 200 metres away from the clinic. The post mortem was completed at the Tirunelveli government hospital on Monday. In a complaint lodged with police, Ganesh's mother S Tamilselvi has accused Subhashini's parents of issuing repeated threats to her son to stop seeing their daughter. Victim's father Chandrashekar said: 'My son is an innocent person. The woman asked my son to come to the hospital. The accused took my son out, threw chilli powder on his face and pulled out a machete to kill him... The government should immediately expel his mother and father from service. We will protest and not take my son's body unless action is taken against them.' Based on the parents' complaint, Surjit and his parents have been booked under various sections of the SC/ST (Prevention of Atrocities) Act and the BNS. 'The prime accused has been arrested. HC upholds DU prof's removal after findings in assault case
New Delhi: Delhi High Court has upheld the removal of a Delhi University professor who challenged the adverse findings of an internal complaints committee (ICC) that found multiple allegations of sexual harassment against him. The ICC had also highlighted that virtual interactions between a teacher and students on messaging apps or social media sites fall within the definition of "workplace" under the POSH Act, 2013. "Teachers shape the careers of young aspiring students for a better future. Cash recovery alone not ground for impeachment, Kapil Sibal argues in SC, in defence of Justice Yashwant Varma
New Delhi, July 28 (UNI) The Supreme Court today heard arguments in a sensitive case involving a sitting High Court judge, with Senior Advocate Kapil Sibal asserting that the recovery of unaccounted cash from the outhouse of a judge cannot, by itself, constitute 'misconduct' or 'proved incapacity', the only grounds for removal under Article 124(4) of the Constitution. A Bench comprising Justice Dipankar Datta and Justice A.G. Masih was hearing a writ petition filed by Justice Yashwant Varma, who has challenged the findings of an in-house inquiry committee that indicted him, as well as a recommendation made by then Chief Justice of India Sanjiv Khanna to the President and Prime Minister, seeking initiation of impeachment proceedings. Sibal, appearing on behalf of Justice Varma, questioned the legal basis of the recommendation. 'The Judges (Inquiry) Act governs the procedure for removal of judges. "A mere finding of cash in the outhouse, without a clear link to misconduct or incapacity, cannot justify impeachment,' he submitted. He added, 'If cash is found in the outhouse, what specific behaviour of the judge is being impugned? There is no allegation of misconduct, much less 'proved misbehaviour' as required by the Constitution.' Justice Datta, however, pointed out that such conduct could amount to 'misbehaviour' under the Bangalore Principles of Judicial Conduct. Sibal acknowledged the possibility but countered that even then, it may not rise to the level necessary to warrant removal from office. The Bench also noted that Justice Varma had not disputed the incident of fire at the premises or the subsequent cash recovery. In response, Sibal stressed that no investigative body or the in-house panel could conclusively determine the ownership of the cash, and no inference should be drawn against the judge without substantive proof. At the core of Sibal's argument was the contention that the Chief Justice of India has no constitutional authority to initiate or recommend impeachment proceedings. 'It is for the Members of Parliament to move such a motion if they are convinced that a judge's conduct warrants removal,' he said. 'The President and Prime Minister are completely alien to this process,' he emphasized. When Justice Datta pointed out that the committee's findings are not considered as formal 'evidence' under law, Sibal replied, 'Yet those findings became the basis for the CJI's communication recommending removal. Once that happens, what is Parliament expected to do other than follow it?' Justice Datta clarified that any removal must follow the due process laid out under the Judges (Inquiry) Act, which requires an inquiry by a three-judge committee before any motion in Parliament. The Court has scheduled the next hearing in the matter for Wednesday, indicating that it will continue to examine both procedural and constitutional aspects of the case. UNI SNG RN
