Psychologist tries to back-track child abuse admissions
The 59-year-old, who cannot be legally named, is on trial in the NSW District Court for raping and molesting a 15-year-old boy in his office on the state's north coast in mid-2017.
The teen attended two counselling sessions with the clinical psychologist who has been accused of watching pornography on his phone and suggesting the youth attend a nudist beach to relieve stress.
Prosecutors have shown jurors alleged admissions made by the man to sexually abusing eight other patients, attempting to prove he had a tendency to act in a certain way.
However, the 59-year-old claims he was coerced into making the admissions in 2019 by his former lawyers at Sydney-based firm Nyman Gibson Miralis and his former barrister Michael Gleeson.
The court heard evidence on Thursday by former Nyman Gibson Miralis solicitor Penelope Baker about her then client's decision to plead guilty and sign a statement of agreed facts relating to the eight complainants.
The psychologist claimed Mr Gleeson advised that he would get a maximum jail term of eight years with a non-parole period of four-and-a-half years because of the pleas, the jury heard.
A file note from a 2020 conference with Ms Baker revealed the psychologist was "gobsmacked" that estimates for his non-parole period had been expanded to five to seven years instead.
"I was very disappointed," he said, according to the note.
"I'm feeling that he has let me down, I'm doubting everything he's done."
The psychologist was swiftly advised that if he pleaded not guilty and went to trial, he would have a very high risk of losing and receiving 10 years' minimum in prison, the jury was told.
After he requested to reverse his pleas, Ms Baker said this would be a terrible idea.
The psychologist told his lawyer he had been put into a "bad position".
"I don't appreciate being misled," he said.
After changing his legal team, he told his new barrister Nancy Mikhaiel the day before a 2020 sentence hearing that he had been "seriously misled," jurors were told.
"I can't do 10 years, it's not in me," he said, according to a legal note read to the court.
Ms Mikhaiel testified under questioning by defence barrister Anita Betts that a non-parole period of under five years was not realistic because of the admissions and number of complainants.
She said the sentence hearing was postponed and she withdrew as his counsel due to the concerns raised about the integrity of his plea.
The trial continues on Friday.

Soccer agent Jonathan Barnett accused of rape, torture and trafficking in U.S. lawsuit
Soccer agent Jonathan Barnett has been accused of rape, torture and trafficking in a U.S. lawsuit. The civil complaint was made against Barnett, 75, in a California district court by a woman referred to only as Jane Doe earlier this week. The complaint claims that Barnett raped the woman more than 39 times after she was 'trafficked' from Australia, of which she is a citizen, to the United Kingdom in 2017. Advertisement The lawsuit says the Brit then 'tortured' her over a six-year period until 2023 while keeping her as a 'sex slave'. Barnett's former employer, Creative Artists Agency (CAA), is also named in the lawsuit. The court documents claim Barnett met the woman in the 1990s through a connection with a professional athlete. It is alleged they reconnected in 2017 online and then in person, before 'Barnett lured Ms. Doe into his scheme of sex trafficking and forced labor under the auspices of hiring her to work for his sports agency, CAA Stellar.' A CAA Spokesperson told The Athletic: 'While the complaint attempts to connect these allegations to CAA's business, Ms. Doe has never been an employee, consultant, or contractor of CAA, ICM, or Stellar, nor has she ever had any business connection to CAA, ICM, or Stellar. Mr. Barnett exited Stellar in February 2024.' The complaint goes on to claim that the woman moved to London that year with her teenage children and that Barnett had covered the expenses, saying that it was part of the employment package, before Barnett allegedly raped her in a hotel room upon her arrival, saying that he 'owned' her and threatened to kill her if she spoke out. The woman says she was forced to obey rules set by Barnett, including referring to him as 'master'. Further details of the alleged abuse include being tied up overnight and denied food and water, repeated physical violence and being made to perform degrading acts. The filing alleges that the woman was 'trafficked, threatened, tortured' and held 'in bondage at numerous places throughout the world, including Los Angeles.' It also says that she was made to 'hunt for additional slaves' after being forced to return to L.A. 'This is a case about institutional abuse at the highest level,' the complaint states. 'This case is about how one of the world's most powerful men in sports openly kept a sex slave for years, with the assistance of his employees, accountants, emissaries, and family members, and used his money and power to maintain coercive control over her and keep her in fear for her life and the lives of her children.' Advertisement Barnett enjoyed a successful career in soccer as one of the highest-profile agents in the sport before retiring last year. He founded the Stellar Group before it was purchased by ICM Partners and later taken over by CAA, and helped broker Gareth Bale's then world-record transfer from Tottenham Hotspur to Real Madrid in 2013. He also represented players such as Jack Grealish, Jordan Pickford and Ashley Cole, while one of Barnett's first clients outside of football was legendary West Indian cricketer Brian Lara. CAA Stellar's current clients in soccer include Premier League players Omar Marmoush, Morgan Gibbs-White, Liam Delap and Kobbie Mainoo, per Transfermarkt. Additional reporting: James Horncastle

Here's What Jurors From The Diddy Trial Have To Say After Their Acquittals Sparked Fierce Backlash
Earlier this week, many were left shocked when Sean 'Diddy" Combs was acquitted of the more serious charges of racketeering conspiracy, and sex trafficking by force, fraud, or coercion in his high-profile federal trial. The 55-year-old star, who had pleaded 'not guilty' to all charges, was found guilty on two federal counts of transportation for purposes of prostitution, and now faces up to 20 years in prison. It came after weeks of testimony involving 34 witnesses, which included associates of Diddy's and two alleged victims: Diddy's ex-girlfriend Cassie Ventura, and another ex-girlfriend who testified under the pseudonym "Jane.' Related: And ever since news of the mixed verdict broke on July 2, the jury involved in the case has faced intense scrutiny from the general public. In addition to people criticizing the male-majority jury of eight men and four women, questions have been raised over whether the jurors were influenced by Diddy's celebrity status. Now, one of the jurors, who requested to remain anonymous, has hit back at the 'highly insulting' discourse in an interview with ABC News. Related: The individual opted to speak out after they heard a legal pundit imply that Diddy's fame may have played a role in the verdict, telling ABC that this line of thinking is 'highly insulting and belittling to the jury and the deliberation process." Related: "We spent over two days deliberating. Our decision was based solely on the evidence presented and how the law is stated," they added. "We would have treated any defendant in the same manner regardless of who they are. I have nothing else to say.' The juror's comments come after another person who served on the jury, George, spoke to both CNN and the New York Times to defend the verdict. As George was one of six alternates on the case, he was not present for the jury's two days of deliberations, but was present for the entirety of the seven-week trial. "Reading all my notes and looking back at the evidence, I probably would have reached the same conclusion as the other jurors," George told CNN of the racketeering charge. "I think there was always a little bit of doubt in people's minds. I think it was a tough case to prove, especially the first [charge of racketeering]. There was always a little bit of doubt there, even from the beginning." George added that he was impressed by Diddy's defense team in court, and said that the music mogul was 'fighting for himself' despite opting against taking the stand. After the jury delivered their verdict, Judge Subramanian denied Diddy's bail, and his sentencing is tentatively set for October 3, though his defense is pushing for an earlier date.
