AG separation of powers hoped to be finalised before GE16, says Azalina
KUALA LUMPUR: A decision on the separation of powers of the Attorney General and the Public Prosecutor may be reached before the 16th General Election, says Datuk Seri Azalina Othman Said.
However, the minister in the Prime Minister's Department (Law and Institutional Reform) said that her ministry was still conducting the study on the separation of powers.
'I hope that before the next general election, we can make a decision,' she said in her speech while launching the AI Legal Justice Roadmap 2025–2026 and the Institutional Reform Map Microsite (PetaRI) at Universiti Malaya here on Thursday (May 22).
She said the Madani government intended for the separation of powers to define the Public Prosecutor's role as the prosecutor and the AG's role as the advisor to the government
Azalina added that her office was considering several elements, including defining the AG's advisory powers to the government.
She added that the separation of powers involving the AG and public prosecutor needs to be examined as a whole, considering that Sabah and Sarawak have their own prosecution powers.
She said that the Parliament Select Committee would scrutinise the technicalities while the study goes on.
'I hope the government can make a decision once we are ready to present (the outcome),' she said.
In March this year, Azalina said a delegation had conducted an empirical study in the United Kingdom on the proposed separation of the roles of Attorney General and Public Prosecutor.
Azalina said the visit marks the final phase of the study, following trips to Canada and Australia last year to examine in greater detail the models implemented in those countries as references for best practices and to identify a suitable framework for Malaysia.

This came about as Malaysiakini broke the news citing party election committee chairperson Datuk Seri Dr Zaliha Mustafa as having announced that Nurul Izzah has toppled the Economy Minister with 9,803 votes. Sarcasm of sorts filled the news portal's comments section with the most popular being 'hopefully later, Nurul Izzah's other sisters will contest for the party's vice-presidency'. Another insinuated that her younger siblings may even vie for head of PKR's youth wing or even PMX's son-in-law (Nurul Izzah's husband) as a member of the party's Central Leadership Council (MPP). On a more serious note, many anticipated the party to languish from nepotism, hence wanting to disassociate themselves from PKR come the 16th General Election (GE16). Boycotting the party or abstain from voting in GE16 which means turning their back to the PKR-led Pakatan Harapan (PH) coalition would point to PMX being a one-term premier, insinuated one disgruntled grassroot member. One commenter expressed disbelief at how PMX used to hit out at twice former premier Tun Dr Mahathir Mohamad for promoting his son Datuk Seri Mukhriz Mahathir as his successor yet he (PMX) himself is doing the exact same thing now. IF ever PKR president Datuk Seri Anwar Ibrahim wishes to restore his party's image following the recent controversial deputy president contest, Nurul Izzah Anwar should relinquish her position to silent the opposition's accusations of nepotism until the 16th General Election (GE16). Claim that Malay language is under threat merely political rhetoric, say analysts
EXPERTS have described the allegation that the Malay language is being sidelined under the MADANI Government as unfounded and contradictory to the administration's ongoing efforts to strengthen the national language's status. Universiti Malaya socio-political analyst Professor Datuk Dr Awang Azman Awang Pawi views the MADANI Government as more progressive and consistent in promoting Malay as the primary medium of administration and national discourse, as enshrined in the Federal Constitution. 'The claim that the Malay language is losing its role is merely a political strategy,' he said, commenting on a statement made yesterday by former prime minister Tun Dr Mahathir Mohamad who alleged that the Malay language and the position of the Malays are facing mounting threats under the current government. According to Awang Azman, the statement is also inconsistent with Dr Mahathir's administrative history, notably when he introduced the Teaching and Learning of Science and Mathematics in English (PPSMI) policy in 2003. 'The policy provoked an intense backlash, as many parties, including the Movement to Abolish PPSMI, criticised it for diminishing the Malay language as a medium of knowledge and education,' he said. Awang Azman stated that calls to unite the Malays must be accompanied by concrete actions that are consistent with the principles of justice, inclusivity and respect for Malaysia's cultural and linguistic diversity. Echoing this view, National Professors Council Fellow Prof Dr Azmi Hassan pointed out that this is not the first time Dr Mahathir has used the 'Malay issue' to advance his political objectives. 'There is no such thing as the Malay language being under threat. It is only a small minority who view Malay as unintellectual, but in reality, it is they who lack intelligence. 'The current situation is much more stable compared to when the ICERD issue (International Convention on the Elimination of All Forms of Racial Discrimination) and the recognition of the Rome Statute of the International Criminal Court arose in 2018 duringDr Mahathir's administration, which at that time sparked concern among the Malay community,' he said. Meanwhile, a lecturer at the Ahmad Ibrahim Kulliyyah of Law, International Islamic University Malaysia, Associate Professor Datuk Dr Shamrahayu A. Aziz, emphasised that the rights of the Malays, including the status of the Malay language as the official language, are enshrined in the Federal Constitution. 'The King and the ruling government are responsible for implementing the relevant provisions. If anyone claims that the government is failing to uphold these provisions, they must present clear evidence. 'This issue concerning the rights of the Malays has long been used as a political argument by various parties, but its status remains steadfastly protected within the framework of the Constitution,' he said.
