The Centre on Wednesday drew a parallel between the Hindu Code Bill and the Waqf Act in an argument for the latter's constitutionality in a Supreme Court hearing.
Responding to the submissions challenging the constitutional validity of the Waqf (Amendment) Act, 2025, Solicitor General Tushar Mehta said that the Waqf law does not contradict Article 25 of the Constitution, which guarantees freedom of religion.
"When the Hindu Code Bill came in 1956, the personal law rights of Hindus, Christians, Sikhs, Buddhists and Jains were taken away. No one said then why only Muslims were left and why others were not?' he told the apex court, NDTV reported.
Mehta also argued in front of the bench composed of Chief Justice B R Gavai and Justice Augustine George Masih that nobody can claim a right over government land, and that the government is legally empowered to reclaim properties that are declared waqf by using the waqf by user principle.
'Nobody has the right over government land. There is a Supreme Court judgment which says the government can save the property if it belongs to the government and has been declared as waqf,' PTI quoted Mehta as saying.
Waqf by user refers to a concept where a property is recognised as waqf based on its long-term use for religious or charitable purposes, even without formal documentation.
The bench sought a response from the Centre on the petitioners' pleas that an officer above the rank of the district collector can decide the claim over waqf properties because they are of the government.
'This is not just misleading but a false argument,' the law officer said.
The Waqf (Amendment) Act 2025, which received presidential assent on April 5 after being passed by both the Houses of Parliament earlier, makes sweeping changes to the governance and recognition of Islamic charitable endowments, or waqfs.
The Centre has defended the amendments as necessary to curb corruption, enhance transparency and ensure better regulatory oversight. But several political parties, religious organisations and civil society groups have mounted a strong push back, calling the law a direct infringement on religious autonomy and an unconstitutional imposition on the Muslim community.
The petitions, filed under Article 32 of the Constitution, challenge the law on multiple grounds, alleging that it undermines the fundamental rights of Muslims and erodes age-old waqf traditions. Petitioners have particularly targeted provisions such as the removal of 'waqf by user' — a principle that historically allowed recognition of religious endowments created through usage or oral tradition — and the invalidation of oral waqfs unless backed by formal deeds. These changes, critics say, jeopardise the status of mosques, graveyards and dargahs that have existed for centuries without written documentation.

The Union Ministry of Home Affairs has informed the Jammu and Kashmir High Court that the Union Territory's Lieutenant-Governor can nominate five members to the J&K Legislative Assembly without the government's 'aid and advice'. It said the office of the Lieutenant-Governor was not an extension of the government. The Ministry said that the nominations were 'outside the realm of the business of the elected government of J&K'. 'Once the Parliament bylaw recognises the Lieutenant-Governor as a distinct authority from the government of Union Territory under Parliamentary enactment, it necessarily follows that when a power is conferred upon the Lieutenant-Governor, then the same must be exercised as a statutory function and not as an extension of his duties as the head of the UT Government.... there can be no manner of doubt that it is the Lieutenant-Governor who has to exercise this statutory duty in his discretion, as a statutory functionary and not as an extension of the government, thus, without aid and advice,' the MHA's affidavit in court said. The powers to nominate three members -- two Kashmiri migrants, including a woman, and one member from the Pakistan-occupied-J&K (PoJK) community -- to the Assembly was inserted in 2023 with an amendment to the J&K Reorganisation Act, 2019 by the Parliament. The 2019 Act also provided for nomination of two women to the Assembly if in the opinion of the Lieutenant-Governor, women are not adequately represented in the Assembly. The amendment was challenged through a public interest litigation (PIL) filed by Congress leader Ravinder Kumar Sharma. While hearing the petition, the High Court on October 21, 2024 had sought a reply from the Union government on the changes to the 2019 Act. 'Whether Sections, 15, 15-A and 15-b of the J&K Reorganisation Act, 2019, making provision for nominating the members of Legislative Assembly over and above the sanctioned strength of the Legislative Assembly, and which have the potential of converting the minority government into a majority government and vice versa, is ultra vires the Constitution being in violation of basic structure of the Constitution?' it had asked. The 2023 amendment had increased the total number of seats to 119 from the existing 114. The government had kept 24 seats vacant for the PoJK areas. In the affidavit filed on July 24, the MHA said the 'present writ petition has become academic as the scenario contemplated did not arise'. It said that 'the interpretation of Section 12 of the Union Territories Act, 1963 would pari materia apply to Sections 15, 15A and 15B of the J&K Reorganisation Act and accordingly, the nominations so made, would be made without the aid and advice of the Council of Ministers, being outside the realm of the business of the elected government of J&K.' The MHA said that the petitioner had failed to substantiate the claim that the nominations made under the J&K Reorganisation Act, 2019 exceed the sanctioned strength of the Legislative Assembly, while those under the Government of Union Territories Act, 1963, do not. 'The Petitioner has not provided any cogent legal basis or statutory interpretation to support such a distinction, and the submissions in this regard remain misconceived and unsustainable in law,' the MHA said. It added that Section 14(3) of the 2019 Act 'does not provide the total strength of the Legislative Assembly; but merely provides the number of directly elected members to such Legislative Assembly'. 'The sanctioned strength of the Assembly, therefore, is not 114, but 114 + all members nominated in terms of Sections 15, 15A and 15B,' the MHA said. It further said that the fallacious statutory interpretation of the petitioner was to be cross-applied to the Union Territory of Puducherry, then as per such reading, the total strength of the Assembly of Puducherry under Section 3(2) of the 1963 Act would be 30. 'Whereas, as per his own case, the sanctioned strength of the Legislative Assembly for the UT of Puducherry has been stated to be 33, i.e. 30 +3,' MHA said. The case is scheduled for hearing on August 14. The election to the 90-seat J&K Assembly was held in September-October 2024 and the results were declared on October 8, with the National Conference-Congress alliance sweeping the polls.

Addressing the valedictory session of a State-level Sahityotsav organised by the Kerala State Sunni Students Federation (SSF) here on Sunday, Mr. Kanthapuram said diplomatic efforts and humanitarian initiatives were leveraged to secure a commutation of Nimisha Priya's death sentence. 'Many compassionate people lent their support to the cause. Some others later sought to take credit for it. But for us, it was just about fulfilling our duty. We do not need praise or acknowledgement,' he said. Allaying fear 'Let us focus on nurturing spiritual growth and educational development in our community. Education is the key to a nation's prosperity and advancement,' he said. Mr. Kanthapuram allayed fears of Muslims being marginalised or forced out, and reassured their rightful place in the country. 'There is no need to worry. No one can force us out simply because we are Muslims. We belong here,' he said. He said no one should force their beliefs on others. 'Instead, let us work together to provide relief, peace and equality for those in need,' he said. In the championship, students from Malappuram West topped with 780 points. Malappuram East and Kozhikode South got the second and third positions. About 2,500 students from across the State took part in the Sahityotsav.

After the arrest of eight Rameswaram fishermen by the Sri Lankan Navy, the Rameswaram All Fishermen's Association, on Sunday, announced a series of protests, culminating in a hunger strike on August 15, India's Independence Day. The fishermen were accused of crossing the International Maritime Boundary Line (IMBL) and were detained along with their boats -- an issue that has plagued the coastal community for years, threatening livelihoods and sparking repeated diplomatic tensions. The association, in an emergency meeting, passed a resolution demanding the immediate release of the arrested fishermen and the seized boats. "These arrests are destroying our lives. Fishing is our only livelihood, and the constant threat from the Sri Lankan Navy has made our existence uncertain," a representative of the association said. Outlining their protest schedule, the association said that an indefinite strike will begin on August 11. This will be followed by a demonstration near the Thangachimadam Valasai Bus Stand on August 13. On August 19, fishermen plan to hold a rail blockade at 3 p.m. to press their demands. The protests are intended to draw national attention to the continuing arrests and seizures in the Palk Bay region. Tamil Nadu Chief Minister M.K. Stalin has also raised the matter with the Centre. In a recent letter to Union External Affairs Minister S. Jaishankar, Chief Minister Stalin urged urgent diplomatic intervention to put an end to the repeated arrests of Tamil Nadu fishermen. He said that on August 6, 14 fishermen from the state, along with their boats, were apprehended by the Sri Lankan Navy. "This was the 17th such incident this year," CM Stalin wrote, noting that 237 boats and 80 fishermen from Tamil Nadu remain in Sri Lankan custody. He stressed that losing boats not only deprives fishermen of their only means of income but also strips them of their right to fish in traditional waters -- a right the fishing community has exercised for generations. Fishermen's associations have long demanded a lasting bilateral solution to the dispute, including measures to prevent arrests, ensure the return of boats, and safeguard traditional fishing rights. Until such an agreement is reached, they say, the community will continue to suffer repeated disruptions to its livelihood.
