Delhi court convicts man in attempt to commit culpable homicide case
Additional sessions judge Hem Raj convicted Bijender Singh under Section 308 (attempt to commit culpable homicide) of IPC.
The police had booked him under Section 307 (attempt to murder) of IPC.
His wife Sangeeta alleged that he tried to strangulate her in an inebriated state using her chunni or scarf on September 22, 2021.
On July 16, the court said Sangeeta specifically deposed that she felt severe pain in her neck due to strangulation.
'It is not the prosecution's case that any vital internal part of the body of the injured sustained any injury which may result in her death. Even the doctor who examined the injured in the present case specifically deposed that the patient was hemodynamically normal," the court said.
When a patient was hemodynamically stable, the court said, it meant their blood pressure and heart rate were stable, indicating good blood circulation.
Noting the evidence before it, the court said though it was proved that Singh tried to strangulate his wife, his act was not under the ambit of IPC Section 307.
'When a person is charged with an offence consisting of several particulars and a combination of only some of the particulars constituting a minor offence is proved, then he can be convicted of the minor offence with which he may not have been charged," the order said.

During verification, the woman was called by the officers of the Golf Green Police Station and at that time, she failed to produce her birth certificate and also could give proper answers regarding her family members," he said. Suspecting something "fishy", a complaint was lodged at the Park Street Police Station by the Anti Rowdy Section of Kolkata Police after they got the report from the Golf Green Police Station. Eventually a raid was conducted by the ARS section of the city police this Monday when they seized several documents including Bangladeshi passports issued in her name, an employee ID of Regent Airways , an admit card of Dhaka's education board, he said. Probe into mega mephedrone haul nets Rs 43.80 cr worth of contraband from Powai
Mumbai, Jul 31 (PTI) The probe into the mega Rs 390 crore mephedrone haul by Mumbai police led to seizure of another consignment of the contraband worth Rs 43.97 crore from Powai in the central-eastern part of the metropolis on Thursday, an official said. Mumbai police had seized more than 187 kilograms mephedrone worth Rs 382 crore following a raid in Mysuru in neighbouring Karnataka last week. The The probe into the case began in April this year after a man was held with 52 grams of mephedrone in Sakinaka in western Mumbai, and his interrogation led police to three more persons, from whom 4.53 kilogram mephedrone worth Rs 8 crore was recovered. Eight persons have been arrested in the case so far. 'Based on the interrogation of the arrested accused, a further consignment of 21.9 kilograms of mephedrone worth Rs 43.80 crore was seized from Powai along with chemicals worth Rs 16 lakh used in manufacturing the contraband," the official said. The total haul in the case now stands at more than 210 kilograms of mephedrone worth almost Rs 435 crore, the official informed. Further probe into the Narcotic Drugs and Psychotropic Substances (NDPS) Act case is underway to unravel the peddling network as well as the supply chain of items used to manufacture mephedrone, he added.
