Former Muda sec-gen acquitted over #ManaKapalLCS protest

KUALA LUMPUR Former Muda secretary-general Amir Hariri Abd Hadi was acquitted of a charge of failing to notify the authorities about the recent #ManaKapalLCS protest held here.
Magistrate Farah Nabihah Muhamad Dan made the ruling after the prosecution decided to retract the charge on Tuesday.
Deputy Public Prosecutor Anis Wahidah Mohamad's application to withdraw the case against Amir Hariri came after the Federal Court decision that Section 9(5) of the Peaceful Assembly Act 2012 (PAA) is unconstitutional.
"After reviewing arguments from both sides and the Federal Court's ruling, and since the prosecution has no instructions to file new charges, I order the accused to be discharged and acquitted, with the bail money fully refunded," said Farah Nabihah.
On July 1, the Federal Court ruled that the provision in Section 9(5) of the PAA, which prescribes penalties for organisers who fail to give the police five days' advance notice before holding an assembly, is unconstitutional.
Former chief justice Tun Tengku Maimun Tuan Mat, who chaired the five-judge panel, said Section 9(5) of the PAA is unconstitutional because it is inconsistent with Article 10(2)(b) read together with Article 8(1) of the Federal Constitution. The court subsequently ordered Amir Hariri's case to be remitted to the High Court to be resolved fairly and expeditiously.
Amir Hariri, who is the executive director of the youth activist group, Mandiri, had earlier pleaded not guilty when he was charged under Article 9(1) of the Peaceful Assembly Act 2012, three years ago. The offence carries a maximum RM10,000 fine upon conviction.
Article 9(1) of the Peaceful Assembly Act 2012 states that organisers must notify the authorities in advance before holding a public assembly.
Amir was alleged to have been involved in organising a protest in front of the Sogo departmental store in Dang Wangi, about 2pm on Aug 14.
However, he, as the organiser, was alleged to have failed to notify police about the protest five days before the event took place.
The protest was held following the Parliamentary Public Accounts Committee report which disclosed that the Royal Malaysian Navy's first state-of-the-art littoral combat ship (LCS) was not yet completed when it was launched in 2017 and that it was less than 44 per cent completed at the time of the launch.
Amir Hariri was represented by lawyer Rajsurian Pillai.

SEREMBAN: A property management firm and its two board directors have claimed trial in the Sessions Court here to two counts of failing to pay service tax on Thursday (Aug 14). Mat Sham Ahmad, who also represented another director Md Samlan Ahmad and the company Tanjung Tuan Properties Sdn Bhd, pleaded not guilty after the charges were read to them before judge Mohamad Kamil Nizam. For the first charge, the company and the duo were charged with failing to pay service tax for the taxable period from May 1 to June 30, 2024 as required under Section 26(4) of the Service Tax Act 2018. This was an offence under Section 26(8), read together with Section 78 (1) of the same legislation, which carries a penalty of up to RM50,000 fine or a jail term not exceeding three years or both upon conviction. For the second charge, they had allegedly failed to do the same for the taxable period from July 1 till Aug 31, 2024. Both offences were allegedly committed on July 31, 2024 at the Customs office in Port Dickson. Customs prosecuting officer Nur Nadia Mohd Rais then asked the court for a mention date for the submission of documents. The accused were unrepresented. Judge Mohamad Kamil fixed Oct 16 for mention.

DSP Muhamad Rizal Alias MUKAH (Aug 14): Police here have sent out a warning to the public on unknown callers and online sellers after two men lost a total of RM17,851.10 in separate cases reported on Aug 11. Mukah police chief DSP Muhamad Rizal Alias said in the first incident, an 18-year-old student lost RM7,100 after receiving a call from an unknown person claiming to be an insurance agent. 'The caller alleged that the victim's insurance policy was about to expire and needed renewal, or else a payment was required to cancel it to avoid automatic deductions from his bank account. 'Fearing the deductions, the victim made two separate transfers to bank accounts provided by the suspect but later realised he had been deceived after reviewing the transaction details,' Muhamad Rizal said in a statement. In the second case, a 40-year-old civil servant lost RM10,751.10 after attempting to buy a repossessed car advertised on Facebook. The victim communicated with the suspect through Facebook and WhatsApp and made three payments to three different bank accounts as instructed. 'The scam became clear when the suspect continued demanding additional payments without making any arrangements for the vehicle's delivery. The victim subsequently lodged a police report,' said Muhamad Rizal. He said both cases are being investigated under Section 420 of the Penal Code for cheating. He reminded the public to stay alert and verify all information before making any financial transactions. 'Do not panic or be intimidated by unknown callers, especially those claiming to represent financial or insurance institutions. 'Always confirm with the relevant agencies before transferring money. Be wary of offers that seem too good to be true on social media, particularly in vehicle purchases, as they may be scams,' he said.
