SC allows Delhi govt to withdraw AAP-era cases against Centre, LG
The Supreme Court on Friday permitted the Rekha Gupta-led Delhi government to withdraw several cases initiated by the previous AAP administration against the Centre and the Lieutenant Governor (LG), primarily concerning control over administrative services.
The AAP government had moved the top court over multiple issues involving control and governance in Delhi. The cases contested the LG's authority over various administrative and regulatory matters, including the management of waste, the cleaning of the Yamuna River, and the validity of certain legislations and ordinances.
Representing the Delhi government, Additional Solicitor General Aishwarya Bhati said, 'These matters should not trouble this court anymore,' signalling a closure to the long-standing legal dispute between the LG and the former AAP administration.
Background of the disputes
In July 2023, the apex court had issued a notice to the Centre following a plea from the AAP-led government challenging the Government of National Capital Territory of Delhi (Amendment) Act, 2023. The legislation, which replaced an earlier ordinance, established an authority to oversee the posting and transfer of Group-A officers in Delhi. It was enacted shortly after the Supreme Court had ruled in favour of the elected government's control over services, excluding matters related to police, land, and public order.
One of the withdrawn cases involved a stay granted by the top court in July 2023 against a National Green Tribunal (NGT) order. The NGT had, in January 2023, directed the LG to head a high-level committee tasked with rejuvenating the Yamuna River.
Another petition pertained to the alleged withholding of funds sanctioned for the Delhi Jal Board by the Finance Department of the Delhi government for 2023-25.

Additional cases included a plea reasserting that the LG is constitutionally required to act on the aid and advice of the GNCTD's council of ministers, and another seeking directives regarding the appointment of the chairperson of the Delhi Electricity Regulatory Commission (DERC).
The Delhi government has also decided to drop its challenge to the Ministry of Home Affairs (MHA) and LG orders concerning the release of payments to government-appointed lawyers, and the process for appointing advocates-on-record and other legal representatives in the Supreme Court and the Delhi High Court.

Assam Chief Minister Himanta Biswa Sarma on Saturday said that the state government is exploring the possibility of 'pushing back' suspected foreigners into Bangladesh without going through the existing process of identification via Foreigners Tribunals. To support this, he cited a 1950 law, which was issued before the institution of Foreigners Tribunals in the state. He stated that the Supreme Court, while hearing the question of the validity of Clause 6A of the Citizenship Act, had stated that this law is still in force. 'When the Supreme Court had taken up the matter of Clause 6A of the Citizenship Act, that was under a Constitutional Bench. The Bench had mentioned that… that the Assam government does not have to keep approaching the judiciary in the matter of identifying foreigners. There is an old law called the Immigrants Expulsion Order. The Supreme Court has said that this law is still in force. According to this law, the DC has the authority to issue an order for immediate pushback. For whatever reason, this had not been brought to our notice by our lawyers, and we were not aware of it either. In the past few days, this has come to our attention. So we will discuss this,' he told reporters on the sidelines of an event. Last week, Sarma had confirmed that the state is carrying out 'push backs' of people who had been declared foreigners by the state's Foreigners Tribunals by invoking a February 4 Supreme Court order. The top court had pulled up the state for not initiating the process of deporting declared foreigners lodged in the Matia detention centre. Civil groups as well as sections of opposition parties have argued that these 'push backs' violate the procedures of deportation. On Saturday, Sarma said, 'Pushbacks will continue and the process of identifying foreigners, which had been paused because of the NRC (National Register of Citizens), will be sped up again. And this time, if someone is identified as a foreigner, we won't send them to a tribunal; we will just keep pushing them back. Preparations for this are going on.' Foreigners Tribunals are quasi-judicial bodies which determine whether a person presented before them, usually referred by the border police or those listed as 'D-voters' in electoral rolls, is a 'foreigner' or an Indian citizen. Those declared foreigners by these tribunals have the option to appeal against the order by approaching the Gauahti High Court and the Supreme Court.

Initiatives in last 11 years helped boost farmers' incomes: PM Modi
Several initiatives of the BJP-led NDA government during the last 11 years have boosted the prosperity of farmers and ensured the transformation of agriculture, Prime Minister Narendra Modi said on Saturday, underlined the far-reaching impact of his government's 'pro-farmer' programmes. The Centre also showcased flagship initiatives — such as the PM Kisan Samman Nidhi, under which ₹3.68 lakh crore has been transferred to the bank accounts of 110 million farmers, and the Kisan Fasal Bima Yojana, under which ₹1.75 lakh crore has been disbursed to 230 million farmers — as important steps taken for the welfare of farmers. 'It's our privilege to serve our hardworking farmers. For the past 11 years, our various initiatives have boosted prosperity for farmers and also ensured an overall transformation of the agriculture sector,' Modi said in a post on X. 'We have focussed on issues like soil health and irrigation, which have been greatly beneficial. Our efforts towards farmer welfare will continue with greater vigour in the times to come.' The PM further said farmers were earlier forced to take loans for meeting small needs, but their lives have been made easier by his government. 'Reflecting on the last 11 years, the government's initiatives have not only enhanced prosperity among farmers but have also contributed to an overall transformation of the agriculture sector. Due to the continuous increase in the Minimum Support Price (MSP), the country's food producers are receiving fair prices for their crops and experiencing a rise in their income,' Modi was quoted as saying in a PIB release. Punjab's land pooling policy to benefit of Kejriwal's ‘Delhi friends', alleges Sirsa
Bharatiya Janata Party (BJP) leader and Delhi minister Manjinder Singh Sirsa launched a blistering attack on Aam Aadmi Party (AAP) national convener and former Delhi chief minister Arvind Kejriwal, accusing him of trying to seize the land of Punjab farmers under the guise of newly launched land pooling policy by the AAP government in the state. Sirsa, who was in Ludhiana to campaign for BJP's Ludhiana West bypoll candidate Jiwan Gupta, alleged that Kejriwal is plotting to seize land from Punjab's farmers 'and hand it over to his 'Delhi' friends'. 'Just as Kejriwal had pressured Punjab chief minister Bhagwant Mann to appoint his loyalists to powerful posts in the state administration, he is now engineering a systematic land grab. This land acquisition policy is not meant for Punjab's development but to transfer the land of hardworking Punjabi farmers to Kejriwal's associates from Delhi, who will profit from it,' Sirsa alleged. 'This is the same playbook used by former Haryana CM Bhupinder Singh Hooda, whose similar policy is now under a CBI probe,' the minister added. He further claimed that the AAP-led Punjab government is blindly replicating controversial and failed Delhi policies. Referring to the excise policy that led to the infamous liquor scam in Delhi, Sirsa said that under Kejriwal's and Manish Sisodia's pressure, the same model has been pushed into Punjab. 'When the probe began in Delhi, they were quick to scrap the policy there, but instead of discarding it altogether, they exported the same blueprint to Punjab,' Sirsa alleged. Sirsa accused Kejriwal of shifting his power base to Punjab after losing political traction in Delhi. 'Today, Kejriwal uses Punjab's official cars, helicopters, and even police protection and is barely seen in Delhi. Even his staff, including his secretary, driver, and peon, are being maintained through Punjab's treasury,' Sirsa claimed. Sirsa said that Punjab's youth are being sidelined, with Kejriwal giving preference to his Delhi cronies. 'It is disgraceful that people from outside are being prioritised in a state where the youth are struggling for employment,' he said. Sirsa said under AAP-rule Punjab's fiscal health was worsening. 'In 2022, Punjab's debt stood at ₹2.83 lakh crore, a burden that took 50 years to accumulate. In just two years under AAP, an additional ₹1 lakh crore has been added. Punjab is now the second most indebted state in the country, with a total debt of ₹3.83 lakh crore,' he pointed out. Reacting to Sirsa's accusations, AAP spokesperson Neel Garg stated that before 2007 no one heard about the word 'Chitta' and it was under the SAD-BJP alliance regime that the influx of drugs ruined the youth of Punjab. 'The land pooling policy is for the welfare of farmers, but the parties who support land mafia are opposing the policy,' Garg said.
