
The silent thief: AI exploits creators under the guise of innovation
As artificial intelligence (AI) continues to astonish the world with its capabilities, from writing articles and generating images to composing music and producing reports, there is an urgent, overlooked reality that demands our attention — the silent, systematic exploitation of intellectual property by AI systems.
While society celebrates innovation, many creators remain muted, their voices drowned out by the roar of technological progress. Their books, music, artwork and more are being used to train machine learning models; the data informs the patterns the algorithms learn, often without the creators' consent, credit or compensation.
Behind the promise of technological advancement is a quiet but pervasive form of abuse: AI masquerades as innovation. The legal, ethical and cultural implications of AI unchecked require urgent policy responses.
Generative AI systems, such as large language models (LLMs) and image generators, rely on data, much of which is derived from human-created books, articles and artworks. Most of these systems are trained on large datasets containing copyright content scraped from the internet, including subscription-based platforms and pirated sources. Although this is done under the legal doctrine of 'fair use',
which is peculiar to the United States, the fairness of that usage is indeed questionable. When a creator's life work is repurposed to drive a billion dollar AI enterprise without their awareness or permission, this raises serious concerns of intellectual property (copyright) infringement.
Recent legal battles in the US have brought this issue to the forefront. Authors, including David Baldacci and John Grisham, have acted against OpenAI for using their books in training datasets. The plaintiffs allege that OpenAI copied their works wholesale, without permission. As of now, the case remains unresolved, but it has already sparked global debate about ownership, consent, and compensation in the AI era.
It is commendable that countries in the European Union have resorted to making use of the 'Opt-in' system. The European Union's General Data Protection Regulation, or GDPR, is a prime example of the opt-in consent regime. The DPR requires a data subject's consent to be freely given, specific, informed and unambiguous. It is a framework that contrasts sharply with the 'opt-out' model, which treats silence as consent (European Commission, 2023). The EU's approach affirms the creator's right to decide how their work is used. This model offers a compelling blueprint that African countries should seriously consider adopting.
Africa's creative industries, from our musicians and poets to fashion designers and filmmakers are unique and increasingly recognised on the global stage. Yet, they remain underprotected. We lack comprehensive AI policies, and enforcement of our copyright laws is weak. If we do not act now, our artists' voices may be digitised, globalised and monetised without them ever knowing or benefiting.
We must demand and get involved in making sure that AI systems trained on African content ensure transparency, compensation and consent. Our lawmakers should champion an 'opt-in' regime that aligns with ethical standards being proposed in other parts of the world. If African creativity is valuable enough to train billion-dollar platforms, then it is valuable enough to protect.
This issue is not only legal, it is ethical. Creativity is not merely data. Every poem, painting or photograph represents hours of human thought, feeling and labour. To treat such expressions as mere raw material for machines, without recognition or reward, is to devalue the soul of human creativity.
Africa, often excluded from global intellectual property conversations, must not remain silent. Our policymakers must strengthen copyright laws, create ethical frameworks for AI development and prevent the exploitation of African content by international tech firms.
To strike a balance between AI innovation and intellectual property protection, clear legal frameworks that promote responsible AI development while safeguarding creators' rights must be developed. This includes transparent licencing systems such as opt-in or opt-out mechanisms for the use of copyrighted content in training datasets; mandating disclosure of data sources; and creating fair compensation models for creators.
Yes, AI can empower us but only if it respects the very people who make creativity possible. As we ride the wave of technological advancement, we must ensure that innovation does not come at the cost of exploitation.

Developing young people for a connected world
Every year for almost twenty years now, the Mail & Guardian has selected 200 top young South Africans and featured their stories of resilience, hope and perseverance, and creative and innovative thinking. By all accounts, getting down to just 200 is an arduous task, as there are many exceptional entries. What this tells us is that South Africa has no shortage of young talent, but for every featured successful young South African in these pages, there are many more who, while not without talent, lack the opportunity, skills and tools that they need to participate in today's connected world and competitive job market. Africa is an extremely young continent, and it would be a travesty if our ambitious, tech savvy young people were not only unable to participate in the economy of our continent but were denied the opportunity to have a voice in shaping its future. In a world increasingly shaped by technology, connectivity is no longer a luxury, it is the key to opportunity. For young people and for their futures, access to connectivity can mark the difference between realising their potential sometime in the future, or never at all. Telkom recognises the importance of developing young people for a connected world with digital literacy skills that equip them for an economy that is transforming rapidly, with new technologies including AI, the IoT, robotics and soon, quantum computing. Through our various programmes and initiatives, Telkom's business units, subsidiaries and its Foundation are working to ensure that every young person in South Africa is able to create or find a job opportunity for themselves after school in this shifting technological landscape. From urban classrooms to rural communities, Telkom's programmes ensure students aren't just connected but that they are empowered to face their future. The Telkom Foundation has introduced a three-year coding and robotics programme into schools in Mpumalanga and the Free State, and our first graduation ceremonies took place during Youth Month in June. We have also fitted out computer labs and are facilitating teacher training to ensure that these subjects are included in the schools' everyday curriculum and are not just part of a holiday programme. In Limpopo, the Telkom Foundation and the Department of Communications and Digital Technologies launched a new ICT Lab earlier this year, featuring 40 new workstations, 10 laptops, and new-generation digital connectivity – a direct intervention to support digital upskilling for these school learners. There are now over 900 ICT Labs built across the country since 2010. We do this in collaboration with the Department of Communications and Digital Technologies. This initiative forms part of our national vision to ensure that South African youth have access to the tools and training they need to thrive, just like their peers in other countries, where technology is being used to create jobs, drive innovation, and improve everyday life. The growing demand for digital skills is driving the expansion of digital learning hubs like TelkomLearn, which attracted more than 4 000 users in the first quarter of this year alone. Its accessibility, through no-cost courses, and user-friendly design, makes it a compelling choice for those seeking critical digital skills through independent learning. The future won't wait and neither should our youth, and that is why Telkom is nurturing talent from a young age, embedding opportunity within education. Our sponsorships and partnerships with schools, universities and technical colleges help create ecosystems where young minds can thrive. All of our programmes are designed with inclusivity at their heart such as spotlighting young women in STEM and supporting learners in underserved communities. Google creating new opportunities with AI in Action
The event highlighted how the growth of the AI industry is influencing the future of work, education, and commerce across South Africa. Google South Africa says there have been tremendous shifts in users' consumption patterns of news on the web, many of which are applicable to news publishers. This was shared with attendees at the second leg of Google AI in Action held in Johannesburg on Tuesday. AI The event was a showcase of Google's Artificial Intelligence (AI) tools' impact on both the innovation, business and news landscapes within South Africa. It drew a diverse attendance of tech ecosystem stakeholders, business leaders, and media, and served as a strategic platform for Google to reaffirm its commitment to advancing Africa's digital transformation journey through the adoption of Artificial Intelligence. News shift Marianne Erasmus, news partner leader at Google, said there is a shift in the way people consume news, despite the advancement in technology. The most recent Reuters Institute Digital News Report highlights that consumers are increasingly discovering news on social media, which we know is a very noisy information environment, and it can be very difficult for news brands to stand out. Consumers want context, they want perspectives, news that is actionable and solution-oriented, and that connects them with others. They want visual format, particularly short-form video and other formats that meet them where they really are,' Erasmus said. ALSO READ: Google launches cloud region in Johannesburg [VIDEO] Unique opportunities Erasmus added that this shift by consumers creates unique opportunities. 'Consumers are really struggling to trust traditional news organisations and are turning to creators and personalities to fulfil their news needs. 'When we look at all this together, it tells us that we got a shared and unique opportunity to take this technological reflection point and create experiences that engage, that inform, that inspire. In light of this, our products need to evolve to adapt to remain competitive to keep driving traffic to the open web,' Erasmus said. Leveraging AI Under the theme 'AI is Now,' Google also used the opportunity to demonstrate how businesses, developers, and communities in South Africa can responsibly leverage AI to significantly enhance productivity, drive innovation, and effectively address real-world challenges. This year's event aimed at highlighting how the growth of the AI industry is influencing the future of work, education, and commerce across South Africa. Through practical demonstrations, attendees gained insights into adopting AI solutions to unlock new opportunities, significantly improve operational efficiency, and maintain competitiveness within the rapidly evolving global digital economy. Ask a Question During the same event, IDInsight's 'Ask-A-Question', developed in partnership with Reach Digital Health, was unveiled. This solution, which benefits from support, is a natural language chatbot that dramatically reduces barriers to critical health information for new and expectant mothers. Leveraging Google Cloud and a fine-tuned Gemma model, 'Ask-A-Question' is already making a tangible difference, answering an astonishing 40,000 to 60,000 questions per month on the MomConnect platform in South Africa. This highlights the profound real-world impact of AI in delivering essential support where it's needed most. Other announcements Google also announced that AI-powered research and summarisation tool, NotebookLM, is now available in local South African languages, including isiZulu and Afrikaans. The tool enables students to summarise study materials in their own language or a small business owner to review market insights in Afrikaans, bridging language and understanding gaps to ensure AI works for South Africa's diverse linguistic communities. This marks a significant step forward in fostering inclusive local content creation and consumption. SynthID Detector Another announcement at the event was the launch of the SynthID Detector, a public tool that helps users identify content that has been watermarked with SynthID. With more than 10 billion pieces of content already watermarked, this tool offers a new layer of transparency and trust, especially for journalists, researchers, and anyone navigating the fast-evolving digital information landscape.
