Comelec faces complaint for ‘system interference' in 2025 polls
Among the 16 complainants were lawyer Alex Lacson, San Carlos Bishop Gerardo Alminaza, Kidapawan Bishop Jose Colin Bagaforo, former Comelec Commissioner Augusto Lagman, former Financial Executives Institute of the Philippines president Franklin Ysaac, and Isabela Vice Mayor Harold Respicio.
Aside from Garcia, six Comelec commissioners and three other people were named respondents.
They face 110,000 counts of system interference, representing the 110,000 ACMs used in the 2025 elections.
They were also charged with another 55,874,700 counts of system interference, representing the 55,874,700 votes they consolidated in Data Center 3.
The complainants said the respondents allegedly violated Paragraph 4, Section 4 of the Cybercrime Prevention Act.
This states that system interference is the 'intentional alteration or reckless hindering or interference with the functioning of a computer or computer network, by inputting, transmitting, deleting, deteriorating, altering, or suppressing computer data or program, electronic document, or electronic data message, without right or authority.'
The complaint filed before the National Bureau of Investigation alleged that Comelec substituted the certified and audited software program in the Automated Counting Machines (ACMs) used in the 2025 polls from version 3.4.0 to version 3.5.0.
The respondents also allegedly allowed the election results to pass through Data Center 3, which the complainants noted as an 'illegal, unauthorized server.'
The complaint also flagged Comelec's move to delete around 5 million votes of vote discrepancy without the participation of the five transparency groups, namely: Parish Pastoral Council for Responsible Voting, National Citizens' Movement for Free Elections, the media, the dominant majority political party, and the dominant minority political party.
In a statement, Garcia said Comelec is open to any investigation surrounding the 2025 polls, noting that the agency observed an orderly, honest, transparent, peaceful, and credible election.
'Pinagkakatiwalaan po ng sambayanan ang NBI at ganun din po kami sa Komisyon. Lahat po ng mga binabanggit nila ay matagal at paulit-ulit na po naming nasagot at pinabulaanan,' Garcia said.
'Ang mga ganitong hindi pagsang-ayon o salungat ng paninindigan ay atin pong inaasahan bilang isang larawan ng malusog na demokrasya,' he added.
(The public trusts the NBI, and we at the Commission do as well. All the issues they've raised have long been addressed and repeatedly denied. We expect these kinds of disagreements or opposing views as a reflection of a healthy democracy.)
The national and local elections were held on May 12, 2025.—LDF, GMA Integrated News

Pampanga mayor arrested amid P80-M extortion allegations
Authorities have arrested the mayor of San Simon, Pampanga after he was accused of extorting P80 million from a steel manufacturing company. According to John Consulta's report on 24 Oras, the operation stemmed from the complaint filed by the company with the National Bureau of Investigation. The company alleged that San Simon Mayor Abundio Punsalan Jr. was extorting money from them in exchange for being allowed to continue their operations in San Simon. 'Nakareceive nga kami ng reklamo na itong mayor ng San Simon, Pampanga humihingi ng pera para pahintulutan silang mag-manufacture ng steel doon sa lugar niya,' NBI Director Jaime Santiago said. (We did receive a complaint that the mayor of San Simon, Pampanga is asking for money in exchange for allowing them to manufacture steel in his area.) 'Pero ang laki ng hinihingi P80 million. P30 million muna paunang bayad. Kapag lumabas na 'yung resolution ay saka babayaran 'yung kakulangan. Nung tinanggap na ni mayor, ayun, inaresto na siya ng ating mga operatiba,' he added. (But the amount being asked for was huge, P80 million. An initial payment of P30 million first. Once the resolution is released, the remaining balance would be paid. When the mayor accepted it, that's when our operatives arrested him.) NBI agents arrested Punsalan in Clark, Pampanga. The agents recovered the P30 million marked money used during the meeting. Meanwhile, they also arrested the mayor's five bodyguards, including one who is a member of the Armed Forces of the Philippines, and a doctor who allegedly acted as the middleman. When brought to the Department of Justice for inquest, Punsalan did not comment on the allegations against him. As of Thursday, Santiago said that all subjects are now under the custody of the NBI at their facility in Bureau of Corrections in Muntinlupa City. —Joahna Lei Casilao/AOL, GMA Integrated News

Hontiveros names instances when SC overturned its rulings
Senator Risa Hontiveros on Wednesday named two instances when the Supreme Court (SC) overturned its rulings as senators debated on whether to abide by the high court's decision that declared unconstitutional the Articles of Impeachment against Vice President Sara Duterte. 'The SC has reversed a unanimous decision in a lot of instances before,' Hontiveros said. One of these was the case of the League of Cities of the Philippines vs. the Commission on Elections (Comelec), where the SC En Banc granted a motion for reconsideration and declared 16 Cityhood Laws as constitutional in 2010. In 2008, the SC initially declared unconstitutional the creation of 16 new cities and ordered the Comelec against the holding of a plebiscite pursuant to cityhood laws in these municipalities. The SC in December 2009 reversed the 2008 decision and ruled that the towns can be declared as cities. However, in 2010, it made a second reversal and reinstated its 2008 decision. In its ruling in February 2011, the SC denied with finality that the 16 towns can be declared as cities. Hontiveros also mentioned the case of the International Service for the Acquisition of Agri-Biotech Applications Inc. and others vs. Greenpeace Southeast Asia of the Philippines. 'Original decision, unanimous, December 8, 2015. Reversed unanimously on MR too, July 26, 2016,' Hontiveros said. 'Hindi lang po tulad nung sinabi ni minority leader na there's always a first time. It has happened before. So 'yung ganitong klaseng milagro na hinahanap, posibleng mangyari din po dito sa kasong pinag uusapan natin,' she added. (It's not just like what the minority leader said, that there's always a first time. It has happened before. So this kind of miracle being sought is also possible in the case we are discussing.) This came after Senator Rodante Marcoleta questioned whether even Supreme Court justice would overturn the ruling, considering that it was unanimous. The SC had ruled unanimously that the Articles of Impeachment against Duterte are barred by the one-year rule under Article XI, Section 3(5) of the Constitution. Meanwhile, with 19 votes, the Senate voted to transfer to the archives the Articles of Impeachment against Duterte.—LDF, GMA Integrated News

DILG warns vs. misleading post on alleged P8,000 ayuda
The Department of the Interior and Local Government (DILG) on Wednesday tagged as "false" and "misleading" a social media post on alleged assistance of P5,000 to P8,000 for those who comply with supposed requirements. In a statement, the DILG called out a post falsely claiming that residents may receive the financial aid by filling out a barangay form and contacting unverified mobile numbers. "This information is false and misleading. No such directive has been issued by the DILG. The mobile numbers listed in the post are not official and are not connected to any legitimate government program," the department said. The DILG stressed that the Social Amelioration Program (SAP) is implemented solely by the Department of Social Welfare and Development (DSWD) through official and validated channels. According to the DILG, its department is only assisting in local monitoring. "No such program is currently active," the DILG noted. The DILG advised the public to be vigilant and not to provide personal information or sign documents based on social media posts that are unverified. "Those who deliberately spread fake information or misuse the name of the DILG for fraudulent purposes will be subject to legal action under the Cybercrime Prevention Act and other applicable laws," the DILG said. For legitimate concerns, the DILG encourages the public to contact its Public Assistance Center at (02) 8876-3454 local 6700. — VDV, GMA Integrated News
