
Kerala HC decides to frame guidelines for expert panel reviewing medical negligence allegations
Kochi: High court has decided to frame guidelines governing the functioning of expert committees constituted to review allegations of medical negligence against doctors.
The bench of Justice V G Arun appointed Advocate S Akash as amicus curiae to assist the court in formulating the guidelines.
The court was hearing two petitions filed by doctors challenging the criminal proceedings initiated against them in their respective trial courts.
The petitioners are facing prosecution under Section 304A of the IPC, alleging that patients under their care had died due to medical negligence. They contended that they were neither heard by the expert committee nor provided a copy of its report. In response, the additional director general of prosecution (ADGP) submitted that no procedural guidelines currently exist regarding the functioning of such expert committees.
HC observed that the absence of clear guidelines could adversely affect the right to a fair trial of the accused. It stressed that it is essential for the committee to consider the doctor's explanation before finalising its report and to furnish a copy of the report to the concerned doctor, thereby enabling them to challenge or appeal it, if necessary. The bench also requested the ADGP to submit suggestions regarding the structure and content of the proposed guidelines and adjourned the matter to July 17.

Lucknow: The Economic Offences Wing (EOW) on Sunday arrested former block development officer (BDO) Dayaram Vishwakarma in connection with the Ballia foodgrain scam that occurred between 2002 and 2005. He will be produced before a competent court in Varanasi for further legal proceedings. Vishwakarma, who retired in 2022 as district development officer in Sultanpur and had been absconding for years, is accused of misappropriating over Rs 27 lakh in collusion with co-accused individuals by using forged documents and fraudulent practices during his tenure as BDO. Following directives from the director general of police (EOW), a dedicated team led by SP (EOW), Varanasi, was formed to trace and apprehend him. According to the EOW, forged muster rolls were prepared, and foodgrain meant for labourers was not distributed as mandated. A total of 13 people were found to be involved in the case. The accused was booked under multiple FIRs—Case No. 65B/2006 at Bansdih police station and Case No. 57B/2006 at Rewati police station—under IPC sections 409, 420, 467, 468, 471, 120B, 34, among others, and Section 13(2) of the Prevention of Corruption Act.

2 judo coaches sent to prison for sexual assault on minor trainees, including national-level judoka
Meerut/Bareilly: Courts in Meerut and Moradabad sentenced two judo coaches to prison for sexually assaulting minor trainees, including a national-level judoka, in separate incidents that took place in 2017 and 2023. Manish alias Max, 26, received a life sentence for raping a 10-year-old national judo player in Meerut, special public prosecutor Kuldeep Mohan said. The additional district judge Sangeeta, who goes by her first name, also imposed a fine of Rs 50,000 on him. Special public prosecutor Avkash Jain told TOI, "The convict violated the girl in the guard room while her brother and fellow players were asked to practise. After the crime, the minor bled profusely, and Max, in a cynical attempt to conceal his crime, staged a drama; he told the minor's parents that she sustained a severe injury during practice." He added, "Believing the convict's theory, the minor was rushed to a medical facility and underwent treatment in three different hospitals, and after eight days, she secretly wrote her ordeal on a paper, which somehow reached her father. Upon this, an FIR was lodged at Kankar Khera police station under relevant sections of IPC and Pocso Act in June 2023." Additional district govt counsel Manoj Gupta said, "The incident occurred on Sept 9, 2017, when the boy was in his school where the convict was appointed as judo coach. Mohd Qasim took the boy to the forest on the pretext of judo training, where he forcefully sodomised him. The boy narrated his ordeal to his family about the incident upon returning home. Subsequently, an FIR against the convict was registered at Katghar police station under the sections of sodomy and the Pocso Act. " He added, "The submitted medical examination report to the court confirmed the assault. Additionally, the statement of the survivor and the circumstantial evidence helped in nailing the accused." The chargesheet was submitted in court, and the judge expedited the trial. After hearing arguments from both sides, the court found Ali guilty and ordered his immediate custody.

One death penalty, five life imprisonments awarded in Palnadu district in May: SP
Courts in Palnadu district pronounced one death penalty and five life imprisonments within a couple of weeks in May. Narasaraopet XIII Additional District and Sessions Judge N. Satya Sri awarded capital punishment to Thanneru Ankamma Rao, a serial killer who committed three murders within three days in 2023. Convicted in all three murders, Ankamma Rao was also sentenced of life imprisonment and a sentence of ten years in jail, apart from imposing a total fine of ₹15,000. The sentences were also pronounced within a week of the trial. Ankamma Rao had targeted three homeless women on three consecutive nights. Palnadu District Superintendent of Police Kanchi Srinivasa Rao, in an interview with The Hindu on Tuesday, said: 'Ankamma Rao's case stands out as a precedent on how digital forensics can fast-track convictions.' About the victims the SP said: 'The victims in this case were mentally unstable homeless women, and he killed them by smashing their heads with cement bricks, when they were sleeping on the roadside.' The police established the identity of one victim, by matching her DNA with her relatives. The department also produced CCTV footage as evidence, which played a crucial role in the investigation and in the trial. Ankamma Rao was given capital punishment for this murder. He also said the judgement should send a strong message to the criminals. 'The Court highlighted the heightened criminality of preying on the vulnerable'. The SP said that Ankamma Rao was found guilty under IPC sections 302 (murder) and 394 (robbery) in this case. Further, Mr. Srinivasa Rao said the effective court monitoring system adopted by the district police ensured a total of five life imprisonments and one death sentence in difference cases within a couple of weeks in May. The other persons punished with life imprisonment include Vadithye Nageswara Rao Naik of Vemavaram village, Ballikurava mandal in Bapatla district in a case from 2019; Sk. Peda Baji and Sk. Beebi Fathima of Muppalla mandal in Palandu district in a case from 2021; Boggavarapu Nagaraju of Piduguralla town in a 2023 case; and Nasana Peda Kondaiah of Kunchainapalli village in Ipuru Mandal in a case from 2019.
