Jaipur: Two men caught drunk in public in Kota were sentenced to community service instead of jail under the new Bharatiya Nagarik Suraksha Sanhita (BNSS).
SP (Kota) Tejaswani Gautam said that due to the efforts of Railway Colony and Bhorkheda police stations, the district's first, and possibly Rajasthan's first, case was ordered by the court to be punished with community service.

Gautam said both men were booked under Section 355 of the BNS for misconduct in public under the influence of alcohol.
In the first case, she said that Mukesh Kumar was stopped during a police drive after a breath analyser showed his alcohol level far above the permissible limit. He was booked under Section 355 of the BNS. On Monday, the court sentenced him to two days of community service at Government Mahatma Gandhi Higher Secondary School in Sogariya.
He will carry out cleaning and plant maintenance on Aug 25 and 26, beginning at 7.30am.
The school principal has been directed to monitor his attendance and submit a compliance report to the court.
In the second case, Gautam said, accused Imran was found with a high level of alcohol. Since it was his first offence, the court Tuesday sentenced him to community service at Government Satellite Hospital, Rampura. He will assist with cleaning, patient care, and other social work at the hospital on Aug 25 and 26.
The medical officer has been instructed to provide proof of his attendance to the court.
Gautam said the BNSS includes community service as an innovative punishment for minor crimes. Section 23 defines it as work ordered by a court for the benefit of the community, without remuneration. "This approach emphasises restorative justice and aims to reform offenders rather than simply incarcerating them," she said.

A 30-year-old factory worker was arrested for allegedly raping a 10-year-old girl and threatening her in an abandoned building in Narela Industrial Area, outer Delhi, on Wednesday night. The case was registered at the Narela Industrial Area (NIA) police station. Deputy commissioner of police (outer-north) Hareshwar V Swami confirmed that the NIA police station received information about the rape of a minor girl and the apprehension of the suspect late Wednesday night. A police team reached the spot and took the suspect into custody. According to a police officer who asked not to be named, the girl was playing in the lane outside her house in Narela Industrial Area when the suspect, a neighbour, allegedly lured her to a ruined and abandoned building. He then raped her after threatening her with dire consequences if she raised an alarm or informed anyone about the crime. 'When the family members started looking for the girl, someone from the neighbourhood informed them that she was last seen with the 30-year-old neighbour. The family members and some locals caught the neighbour raping the minor girl in the abandoned building. Enraged, they thrashed him and then informed the police. The girl was admitted to a nearby government hospital for medical attention,' the officer said. The girl's father is also a factory worker while her mother died a few years ago, according to the police officer.

Rajgad police on Thursday arrested three men and detained three minors in connection with the murder of an IT professional. According to Pune rural police, 28-year-old IT engineer Saurabh Swami Athawale, whose body was found on a secluded hill near the Katraj Tunnel on August 19, had been reported missing from August 18. Athawale was an employee of a multinational firm. Athawale lived in the same building as a girl who he considered as his sister. One of the juvenile accused was in a relationship with her. Athawale came to know about it and informed the girl's parents. (REPRESENTATIVE PHOTO) The case came to light when a commuter noticed the abandoned body and alerted police. Investigators scanned CCTV footage, formed four teams, and tracked down the suspects within two days. The arrested accused have been identified as Sangam Kshirsagar (19), Shrimant Gujje (21) and Nitin Trimbak (18). According to rural superintendent of police Sandeep Singh Gill, the motive was personal enmity. Athawale lived in the same building as a girl who he considered as his sister. One of the juvenile accused was in a relationship with her. Athawale came to know about it and informed the girl's parents. 'When Athawale informed the girl's parents, the juvenile accused was forced to move out of his residence in Mangdewadi to Wadgaon Maval. This created resentment and, ultimately, led to the murder,' said Gill. On August 18, the accused intercepted Athawale while he was waiting near a school to meet the girl. Pretending they wanted to talk, they took him on a two-wheeler to an isolated spot on the hill and hacked him to death with sharp weapons, informed Ravindra Singh Gaur, additional superintendent of police. Initially, the suspects were booked under Section 103 of the Bharatiya Nyaya Sanhita (BNS) but later, charges under Sections 61(1), 61(2), 238 of the BNS and relevant provisions of the Arms Act were added. Police have sought the custody of the accused till August 28 for further investigation.

A Delhi court has dismissed a plea that sought an FIR against an art gallery in the Capital for displaying two paintings by late artist and Padma awardee M F Husain, which allegedly hurt religious sentiments, during an exhibition last year. 'The court does not find any illegality in the impugned order passed by the Ld. Magistrate, wherein the Ld. Magistrate has passed a reasoned order, while observing that the paintings as well as CCTV footage have already been seized and as such, no further investigation and collection of evidence is required at this stage, as the evidence is in the possession of the complainant as well as on record,' said Additional Sessions Judge Saurabh Pratap Singh Laler of Patiala House in his order dated August 19. 'In conclusion, the Impugned Order reflects a reasoned application of mind, aligning with statutory provisions and judicial precedents. No police investigation is required at this stage, as evidence is accessible,' the ASJ added. 'She (the complainant) approached the police and nothing happened…The learned magistrate judge didn't consider the facts of the case,' Adkar had earlier argued. 'Hundreds of cases were filed against Husain. Instead of facing law, he fled the country,' he had added. In January, Judicial Magistrate First Class Sahil Monga of Patiala House Court refused to order an FIR against DAG. However, the court had earlier ordered a seizure of the 'offensive' paintings. Till date, the paintings are kept at a malkhana (police store house). Sachdeva had alleged in a post on X that she clicked photos of 'offensive paintings displayed at DAG World' on December 4, 2024, and filed a police complaint on December 9 'after researching past FIRs against M F Husain'. 'However, during a visit with the IO (investigating officer) on 10.12.2024, the paintings were removed and (it was) falsely claimed they were never displayed,' she had stated. The counsel of the art gallery had argued, 'The Magistrate didn't commit any error. If you consciously go to a place, it can be an offence. If you're placing something that is aimed at art lovers at an exhibition, it can't be an offence. There needs to be a deliberate and malicious intent. Is it the lawyer who is posting these paintings or are we promoting it? We have never put it on social media.' 'The sketches were there for 30 days during the exhibition. Thousands of people saw the painting. No one except the complainant (Sachdeva) objected. Their concerns can't be seen as the concerns of the whole community,' the counsel had said. Adkar, on the other hand, had said that a case of Section 299 (deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs) under the Bharatiya Nyaya Sanhita (BNS) was made out. 'Our gods have been insulted… They have been shown holding nude women. The complainant is the eyewitness, she herself took photos,' Adkar had said. 'Husain had earlier also made nude goddesses. There were multiple complaints against him… There was not even an apology. This is not the way to deal with Sanatan Dharma,' he had argued before the court. 'Any obscene painting can be made and put in my bag. But the moment it leaves my bag, it becomes public. That's where the problem lies… I'm just saying 'spare my gods (Hindu gods)'.'
