
Publishing name in ‘CBI list' may breach rights
NEW DELHI: The Delhi HC has observed that inclusion of an individual's name in an intelligence agency's list of 'Undesirable Contact Men' (UCM) and its publication in newspapers and on an official website prima facie violates 'human rights' under Section 24(1) of the Right to Information (RTI) Act.
While Section 24(1) exempts intelligence and security agencies listed in the Second Schedule from RTI obligations, the provision to the section allows for disclosure of information involving corruption or human rights violations.
Justice Sachin Datta was hearing a Chartered Accountant's plea against the Central Information Commission's (CIC) dismissal of his RTI application. The petitioner's name had appeared in a UCM list circulated by the CBI, with news clippings—bearing the agency's emblem, published both in print and online. These reports cautioned government officials against associating with or accepting hospitality from those named.
Seeking clarity, the petitioner filed an RTI application with the Central Public Information Officer (CPIO) to know the reasons behind his inclusion and the process followed. The application was rejected by the Assistant Inspector General of Police (Policy Division), who serves as the CPIO, citing a 2011 government notification that exempted the CBI under Section 24(1). His appeals before the First Appellate Authority and the CIC were both rejected. In his petition before the High Court, the petitioner argued that public naming without due process amounted to professional and social ostracisation, infringing his dignity and fundamental rights. The Court held that while CBI is generally exempt, the provision to Section 24(1) clearly mandates disclosure where allegations of corruption or human rights violations are involved. 'Prima facie, this Court finds merit in the petitioner's argument that the publication of his name, in the manner aforesaid, has resulted in a violation of human rights as the same has harmed his dignity and professional standing,' it noted.
The Court added that the term 'human rights' under the RTI Act must not be interpreted narrowly. However, it observed that the petitioner had not previously raised the issue of human rights violation before the CIC or appellate authority. The Court remanded the matter to the CIC for fresh adjudication, directing it to consider the human rights aspect under the RTI exception clause.

Antwerp court hears Mehul Choksi extradition plea, next hearing in August
An Antwerp court on Friday heard the arguments on Mehul Choksi's extradition to India, with detailed evidence presented by the investigators regarding the fugitive diamantaire's fraudulent activities while his legal team sought his release, according to people familiar with the development. Choksi is accused of siphoning off ₹6,097 crore from the Punjab National Bank and five other similar bank frauds before fleeing from India in January 2018and was arrested by Antwerp police on April 11, based on an extradition request sent by the Central Bureau of Investigation (CBI). He has already spent two months behind the bar there. On Friday, the court did not give any relief to him and the matter will now be heard in late August. As reported by HT last month, Indian investigators have submitted documentary evidence to the prosecutors in Belgium against Choksi in six bank frauds committed by him between 2018 and 2022 involving amounts totalling nearly ₹13,000 crore and court is already convinced that there is prima facie fear of him fleeing. An officer who didn't want to be named said that 'detailed arguments took place in the court on Friday but the court order was not out till late evening'. India has put forth arguments that Choksi is a habitual offender and jumps extradition proceedings wherever he is found, as seen in the US and Antigua and Barbuda, the officer cited above said. Choksi was tracked by the CBI to Belgium in July last year after which it approached the Belgian government with a formal extradition request. The extradition was sought under Indian Penal Code (IPC) sections – 120 B (criminal conspiracy), 201 (destruction of evidence), 409 (criminal breach of trust), 420 (cheating), 477A (falsification of accounts), and sections 7 and 13 (bribery) of the Prevention of Corruption Act. Besides, CBI also invoked the United Nations Convention against Transnational Organized Crime (UNTOC) and United Nations Convention against Corruption (UNCAC) in its extradition request. The Belgium government examined India's request at various levels and approved initiating action in the matter after it was convinced about the 'dual criminality' clause in the 1901 extradition treaty between two countries. Choksi has evaded the CBI and the Enforcement Directorate (ED) — which is conducting a parallel money laundering probe — since 2018. After fleeing from India in January 2018, he acquired the citizenship of Antigua and Barbuda.

West Bengal coal mining case: Delhi HC grants anticipatory bail to accused Anup Majee
New Delhi: The Delhi High Court on Friday granted anticipatory bail to Anup Majee, accused of money laundering in a case linked to the West Bengal coal mining case . The counsel for the petitioner states that Anup Majee is a 47-year-old businessman from Purulia, West Bengal, with strong social roots. In this case, there are allegations of Money laundering of Rs. 2700 crore. Justice Tejas Karia granted anticipatory bail to Anup Majee, with the condition of furnishing a bail bond of Rs 10 lakh in the event of arrest. He is directed to surrender his passport. Senior advocate N Hariharan, alongwith advocates Siddharth S Yadav and Shadaman Ahmed Siddique appeared for Anup Majee. The trial court dismissed his plea on May 22, 2025. The court said that the grant of anticipatory bail at this stage would frustrate the investigation, hamper meaningful interrogation of the applicant, and cause hindrance in collecting useful information, including material that might have been concealed. Having regard to the material collected by DoE, at this stage of the investigation, no case is made out for granting the anticipatory bail, the trial court had said. On the basis of an FIR lodged by the CBI, the Enforcement Directorate (ED) had lodged a case in 2020 for the investigation of alleged money laundering. The proceeding(s) under the PMLA were initiated by the ED on 28.11.2020, over 53 months ago, and Prosecution complaint (charge sheet) has already been filed before the special CBI judge at Rouse Avenue on May 13, 2021. It is contended that the ED has embarked on a witch-hunt against the Majee that has spanned almost 4.5 years in an attempt to implicate him in the proceeding(s) emanating from the Subject ECIR solely as a mean(s) to settle political scores. It was also argued that there is no apprehension of the accused fleeing from justice. He satisfies triple test. The bail plea was opposed by the Enforcement Directorate (ED). It is alleged that Anup Majee alias Lala was running an organised syndicate involved in illegal mining and theft of coal from leasehold areas of Eastern Coalfield Limited (ECL). He is stated to be the ring leader of the syndicate which was carrying out the illegal mining with the help of public servants. On these allegations, the FIR of predicate offences was registered and investigation was taken up. It has been stated that evidence of extensive mining was found during investigation and several machines and vehicles involved in illegal excavation and transportation of the coal were seized. During departmental raids of ECL, a large quantity of stolen coal, including 9.050 MT of coal, was recovered from the railway siding of Pandeshwar Area as well as several other locations. Investigation revealed that the applicant had built an organised gang, which was carrying out illegal coal mining at a very large scale by deploying heavy mining machinery, earth movers, explosives, and this was being done under the protection & patronage of influential persons of the area.
