Former CEO facing legal action from company over allegedly misusing funds

THE CANADIAN PRESS/John Woods A Winnipeg-based business that helps nonprofits fundraise with online raffles has filed a lawsuit against its co-founder, alleging he misused funds being held in trust for charities and other organizations. Nicholas Tenszen, who served as the CEO and president of Funding Change from June 1, 2021, to July 8, 2024, is facing legal action for an unspecified amount, including punitive damages, according to a statement of claim filed in Manitoba's Court of King's Bench earlier this month. The lawsuit alleges that Tenszen, 'who had complete access and control over Funding Change's finances and operations, including control over the trust funds and payroll,' processed payments directly to himself without the knowledge or consent of its board of directors from August 2022 to July 2024. The court filing says Tenszen used the trust funds to pay operational expenses of Funding Change, breaching the company's trust obligations and the terms and conditions of its licence issued by the Liquor, Gaming and Cannabis Authority of Manitoba (LGCA). This resulted in 'Funding Change being unable to pay charities raffle proceeds in a timely matter, or at all,' according to the lawsuit. The lawsuit claims that Tenszen also used funds belonging to Funding Change to pay for personal expenses and failed to pay company liabilities to the Canada Revenue Agency. A Winnipeg Police Service spokesperson said that no criminal investigation is ongoing and that no report has been received regarding the incident. The lawsuit says that after Funding Change discovered 'significant financial and other improprieties,' it disclosed the findings to the LGCA which prompted 'emergency financing in order to maintain the integrity of its obligations to charities and liquidity of its operations.' The company also revoked Tenszen's signing authority and he was removed as a director of Funding Change, according to the lawsuit. The court filing says he later resigned as its CEO and president. The lawsuit says the LGCA conducted an investigation into Funding Change from July 2024 to November 2024, concluding that the company made 'inaccurate and untimely payments of the trust funds' during the period in which the finances and operations were controlled by Tenszen. Funding Change's licence with LGCA was ultimately renewed, though it included 'special terms and conditions, including that (Tenszen) could not be responsible for financial decisions or for the management or operation of Funding Change's business,' per the statement of claim. '(Tenszen's) foregoing conduct was malicious, deliberate, in bad faith, for improper purposes, and was in wanton disregard of (Funding Change)'s rights and ought to offend the community's sense of fair play,' says the lawsuit. Tenszen could not be reached for comment. Funding Change's website said it has completed over 2,300 raffles with a wide range of organizations—such as sports teams, schools, parent councils, festivals and health foundations—with total raffle sales over $19 million. 'Funding Change is stronger than ever': chair In a statement obtained through the company's lawyer, Funding Change chair David Asper said the company is 'stronger than ever' following changes to its leadership and finances. 'We moved quickly to refinance the business so that no partner would be negatively affected, and we immediately resolved outstanding matters with the CRA and other creditors,' said Asper. Asper said Funding Change has also engaged with an accounting firm to complete a thorough and independent audit. Jamie Gowryluk has been appointed as the company's new president and chief operating officer. No statement of defence has been filed and the allegations have not been proven in court.

'Devastating end to an amazing love story': Popular B.C. YouTubers die in off-road accident
A Nanaimo influencer couple, who documented their off-road adventures on YouTube, died last week in an accident in the Kaslo backcountry. Article content Stacey Tourout and Matthew Yeomans spearheaded videos for Toyota World Runners, a channel with more than 200,000 subscribers. They also had nearly 74,000 followers on Instagram. Article content Article content On their website, they documented how they fixed up Land Cruisers and other vehicles and wrote of their extensive travels across North and South America. Article content Article content Last year, they got engaged. But their love story met a tragic end last Thursday while off roading in the mountainous region of the West Kootenay. Article content Article content They were traversing in steep terrain in what Mark Jennings-Bates, the manager of Kaslo Search and Rescue, described as an expertly modified off-road vehicle. Article content Jennings-Bates said it's believed the driver may have lost control. The vehicle rolled 200 metres down a steep embankment. Article content He said despite the difficult terrain, it is a popular spot for off roading. The occupants of a similar vehicle in the area drove to nearby Trout Lake Village and called 911, said Jennings-Bates. Article content The call was sent to Kaslo Search and Rescue, which went to the sire of the rollover near Silver Cup Ridge in the Purcell mountain range at about 6:30 p.m. Article content A helicopter aided the ground teams in a search for the vehicle. The search and rescue crew found one person with no vital signs and another person a short distance from the crash site with serious injuries. That person later died in hospital. Article content Tourout's mother, Colleen Tourout, posted an announcement of the couple's fatal accident on Facebook. Article content 'With unimaginable heartache, the families of Matthew Peter Yeomans and Stacey Tourout would like to advise that we lost them both tragically succumbing to injuries in an off-road accident on Aug. 7, 2025, in the beautiful mountains of British Columbia that they loved so much,' the post reads. Article content 'Please keep us and them in your thoughts and prayers as we navigate this devastating end to an amazing love story. They are together forever as we knew they would always be.' Article content Article content On their blog website, the pair says Toyota World Runners began with a truck, 'and the two of us making adventure videos and telling stories.' Article content 'What it's become is a community. We are two adventurous souls that intend to live life to the fullest. And to us that is a radical adventure all over the world,' they wrote. 'From humble beginnings, we want to inspire those who can believe in themselves and take action that you can do what you dream. Dreamers can be do-ers, too.' Article content In a heartfelt social media post announcing their engagement last year, Yeomans said he knew right away he wanted to be with her forever. Article content Article content 'After our first date, I knew I could spend my life with this girl. Driving the length of the Americas in a rig that we built has made us into a remarkable team,' he wrote. Article content They were on the road and he'd left the ring in Canada so he drew one on her finger with a Sharpie, figuring it would be a good story to tell their future children. Article content Tributes poured in on social media for the pair this week, with dozens of posts describing them as an extraordinary couple who inspired thousands. SIU called in after fatal shooting near Turkey Point marina

In a social media post at 7:14 p.m. Tuesday the SIU said they were investigating a shooting in the area of MacDonald Turkey Point Marina in Norfolk County. OPP Sgt. Ed Sanchuk posted a video regarding the incident on X, the social media platform formerly known as Twitter. He said members of the OPP Marine unit attempted to stop a boater who had entered the marina before running off. The canine unit was called in to find the person. 'During the interaction, police discharged a firearm,' Sgt. Sanchuk said. 'The individual was pronounced deceased.' The SIU is called in to investigate all incidents involving police where there has been death, serious injury, discharge of a firearm at a person or allegations of sexual assault.
