Addressing the crisis: whistle-blower murders and the need for legal reform

While 'hitmen' involved in the killing of whistle-blowers may occasionally face charges, the architects of these crimes evade accountability, said Dr Nora Saneka.

WHILE whistle-blowers are at the frontline in the war against corruption, organisations and activists do not believe enough is being done to protect them and to bring the "masterminds" behind some of their murders to book.
The killings of many whistle-blowers, including Babita Deokaran, Pamela Mabini, Cloete Murray and his son, Thomas, over the last few years has sparked an outcry for the government and law enforcement agencies to be more proactive.
This includes tabling of the Whistleblower Protection Bill and implementing recommendations made during the Commission of Inquiry into State Capture (Zondo Commission).
Dr Nora Saneka, chairperson of the Active Citizens Movement (ACM), said despite many promises, concrete action remained absent.
'In President Ramaphosa's 2021 commitment to the Zondo Commission he said: 'We need to give whistle-blowers better protection, both in law and in practice. Without whistle-blowers, we will not be able to tackle corruption effectively', yet nothing has been done. Whistle-blowers continue to face lethal threats, job loss, and institutional hostility.
'The delay in tabling of the bill and ignoring the need to implement interim measures demonstrates alarming inertia. Platitudes have not translated into legal safeguards, financial support, or psychological protection,' she said.

'The unsolved murder of Babita Deokaran, exposes systemic failure. Law enforcement and the National Prosecuting Authority (NPA) lack proactive strategies to target orchestrators, perpetuating a culture of impunity. Without high-level prosecutions, whistle-blowers remain vulnerable."
Saneka said the ACM submitted comprehensive proposals to the Zondo Commission in 2021, and directly to President Cyril Ramaphosa in January this year.
'We detailed five interim measures in our letter to the president, Department of Justice (DoJ) and National Anti-Corruption Advisory Council (NACAC). Despite follow-ups, no substantive feedback has been provided to ACM or to the citizens of South Africa. Neither has any action been taken as far as we are aware. In addition, NACAC's advisories to the president remain confidential, undermining public accountability
'We also ask that the DoJ fast track the Whistleblower Protection Bill and propose that the National Director of Public Prosecutions is directly accountable to Parliament. Parliament has final responsibility for all matters concerning the administration of justice, including the budget for the prosecuting authority.
'South Africa's anti-corruption efforts hinge on protecting those who risk everything. Delays betray whistle-blowers and embolden criminals. We appeal to President Ramaphosa to act now because lives and democracy hang in the balance,' she said.
Ben Theron, chief executive officer of The Whistleblower House, said the government's response to protecting whistle-blowers, had been 'fragmented, disjointed, and poorly coordinated'.
'Existing mechanisms are ineffective, and the way they are managed is neither structured or trusted by those who need protection. The system lacks credibility and urgency. In addition to threats to their lives, whistle-blowers often face workplace retaliation or dismissal without proper recourse, meaning job security is virtually nonexistent.'
Theron said they had submitted detailed proposals aimed at strengthening whistle-blower legislation, particularly reforms to the Protected Disclosures Act (PDA) of 2000.
Stefanie Fick, executive director of the accountability division at Organisation Undoing Tax Abuse (OUTA), said: 'Too many whistle-blowers are on suspension awaiting disciplinary hearings because they decided to stand up against corrupt activities and government departments litigate with taxpayers' money against whistle-blowers. Whistle-blowers also do not receive emotional or financial support and are often ostracised.'
Fick added she did not believe the South African Police Service (SAPS) and the NPA had the resources or expertise to tackle the killing of whistle-blowers.
Devoshum Moodley-Veera, an integrity activist, said: 'Retaliation against whistle-blowers has become commonplace due to the government's failure to adequately safeguard these individuals. Daily, I encounter situations requiring urgent assistance for whistle-blowers, whether through providing safety houses or offering legal support as they face disciplinary actions.
'A critical, yet untapped, resource is the Criminal Assets Recovery Account (CARA) fund, managed by the NPA. This fund, derived from the proceeds of crime, is intended to compensate victims of economic crimes. These funds could effectively support whistle-blowers by covering legal fees, safety accommodation, and psychological assistance. However, this has not yet been implemented by the government."
Moodley-Veera, who is a PhD student specialising in ethics, anti-corruption, whistle-blowing protection and law at the Stellenbosch University, said there was a significant over-reliance on the Special Investigations Unit (SIU) for probing whistle-blower complaints.
'Law enforcement agencies haven't yet released statistics on the number of whistle-blower cases they have received, making it difficult to assess their effectiveness in handling these matters. Additionally, there's an excessive dependency on civil society organisations and journalists to bring these cases to light. The country also suffers from poor consequence management for wrongdoers.
'In many instances, individuals facing disciplinary proceedings are allowed to resign before any action can be taken against them. This loophole enables them to evade accountability and potentially move to other organisations, perpetuating the same problematic behaviours. Furthermore, the use of non-disclosure agreements (NDAs) effectively silences whistle-blowers,' she said.
Koogan Pillay, a governance and human rights advocate, said it appeared that there was no political will or commitment to ethical governance and accountability.
'There is too much talk and very little action. During the Zondo Commission, I made a submission to the commission, as a collective effort of the ACM. This included a compilation of many whistle-blower complaints, together with a human rights report, on what needs to be addressed as a matter of urgency, to counter the existential threat posed by grand corruption to South Africa's young democracy.
'Sadly, it has been three years since former Chief Justice (Raymond) Zondo submitted his report to President Ramaphosa and parliament. He recently conveyed his dismay at the lack of progress in implementing his report, hence putting at risk South Africa's constitutional democracy from any further potential capture, should it happen,' he said.
Pillay added if nothing was done to protect whistle-blowers, corruption would worsen to the point of rendering South Africa a failed state.
'This could lead to the reality and nightmare of a 'mafia' state. Sadly more pressure rests on resourced strapped organisations and citizens at large. Ultimately, the results at the polls will also tell, as we have seen during the elections last year which led to a Government of National Unity.'

Image: Timothy Bernard / Independent Newspapers THE Competition Commission has hauled some of the country's top banks to the apex court over allegations that they conspired with each other to manipulate the foreign exchange rate in respect of the US Dollar and the Rand. The commission turned to the Constitutional Court for leave to appeal the Competition Appeal Court (CAC) judgment handed down in January last year in which it upheld the appeal by the majority of the respondent banks accused of price-fixing. The Constitutional Court is due to hear legal arguments over four days. In June 2020, the Commission had referred the case regarding the alleged rand fixing against 28 local and foreign banks to the Competition Tribunal. The banks were ordered by the Tribunal in March 2023 to file their answering affidavits in response to the Commission's complaint referral, but objected to the Tribunal order and appealed it to the CAC. The CAC, in its judgment last year, released 17 banks from the complaint referral before they answered the allegations against them and restricted the Commission's case to only the four respondent banks. Advertisement Next Stay Close ✕ In its current application for leave to appeal, the Commission is appealing the CAC order to the Constitutional Court against 13 banks. These banks include Standard Bank of South Africa, Nedbank Limited and FirstRand Bank Limited, while the bulk are foreign banks. The Commission said this appeal will provide the Constitutional Court with an opportunity to pronounce on whether the South African competition authorities have jurisdiction to investigate and prosecute firms that are based outside of the Republic whose anti-competitive conduct affects the South African economy. In April 2015, the Commission initiated a complaint against various financial entities centred on allegations of price-fixing and market division in the trading of the USD/ZAR currency pair. The anti-competitive practices are alleged to have taken place between September 2007 to at least September 2013. According to the Commission, the general terms of the conspiracy included that the banks' traders would participate, actively and passively, in frequent and regular communication and contact with one or more traders employed by or representing competing banks when engaging in trading the USD/ZAR currency pair. The Commission subsequently referred the complaint to the Tribunal in February 2017. The banks took exception to the original referral. Those objections were adjudicated by the Tribunal in 2019 and considered again on appeal before the CAC in 2020, which ordered that the Commission file a new referral affidavit to substitute for and replace all the complaint referral affidavits. In accordance with the 2020 CAC order, the Commission filed its complaint referral anew in June 2020.

The National Dialogue at least has us debating whether a debate is needed

The National Dialogue has certainly elicited a dialogue, at the very least between those who consider the entire initiative to be a significant waste of taxpayers' money and those who argue that there is a need for a societal engagement regarding the socioeconomic problems vexing South Africa and in which the political process has so lamentably failed the country. Stephen Grootes contends that in the light of the failure of the established political process, if a National Dialogue 'can bring people back into formal structures first through the convention process, then into politics (through voting), then it would have succeeded'. Pierre de Vos writes that it is difficult not to conclude that the National Dialogue is 'an idiotic and self-indulgent scheme cooked up by decadent elites untethered from reality or greedy to share in the spoils of the lucrative consultancy work no doubt being generated by the jamboree'. At least there is a debate in the country about whether to have a debate. There is, however, a core question that the National Dialogue, arguably through the Eminent Persons Group, which has been appointed to pilot the National Dialogue, needs to answer, and urgently. Government failure Critics like De Vos are correct to point to the almost complete failure of the government over a long period (certainly from the moment Jacob Zuma assumed the presidency). There has been a sustained lack of delivery by government to deliver basic services to those most in need. There has been a marked increase in corruption, for example as documented in the Zondo Commission reports. There has been a failure to hold key participants in the series of nefarious activities that engulfed the country and stole crucial national resources to be held accountable to the law. The economic policy of government has produced no more than tepid GDP growth, as a result of which the country struggles to grow at more than 1% per annum. Unemployment constitutes, on the official figures, a third of the population who can work. Key institutions, save for Sars and the SA Reserve Bank, are generally dysfunctional. A National Dialogue takes place in circumstances where, in the very week that it commenced, an e-hailing driver was murdered and others brutally attacked at Maponya Mall, with very little likelihood that those who committed these crimes will be found and successfully prosecuted. The Chief of the South African National Defence Force toddles off to Iran to proclaim our friendship with that country in the very week when the Department of Trade and Industry is desperately trying the persuade the American government to reduce the tariffs which it has imposed on South Africa and which will have disastrous effects on our economy and hence employment. And the Minister of Defence, heroically reproducing her record as Education Minister, supports this trip. Corruption is of so gross a kind that the CEO of the Independent Development Trust can brazenly offer a journalist R60,000 in cash so that he will not publish an adverse article about her. The leaders of the National Dialogue need to tell the South African population how this dialogue will ensure that e-hailing drivers are not murdered, that those who perpetrate these murders are held accountable by the law, and that chief executive officers of important institutions behave with probity as opposed to brazen displays of corruption. How will a dialogue reverse the failure to deliver basic goods and services to those most in need? In short, how will the more than R500-million to be spent on this project ensure that the National Dialogue will transport us into a place that we have never been since the first few promising years of democracy dawned after 1994? There has been much talk about the precedent of the Congress of the People, which produced the Freedom Charter in 1955. But the Congress of the People at Kliptown took place after considerable political work had been done and in circumstances where the entire enterprise was designed to construct an alternative vision for a society which was then living under the horrors of apartheid. It produced a road map called the Freedom Charter, which continued to influence progressive politics for decades to come. By contrast, we now have a Constitution which sets out a framework for the development of a society based on freedom, equality and dignity for all. It demands accountable and transparent government which fulfils its obligations to provide basic social and economic goods to the population. If that was not enough, there is a National Development Plan collecting dust and a comprehensive report from the Harvard Growth Lab, which clearly indicates what is required to ensure that South Africa vindicates the vision which was initially articulated in the Constitution. In short, what is the National Dialogue going to tell us that we do not already know? Will it ensure that Cabinet ministers like Thembi Simelane, the Minister of Human Settlements (a not unimportant portfolio), are finally held to account for a whole series of damning allegations which require proper public ventilation? Will the National Dialogue ensure that the Chief of the SANDF cannot simply, on his own frolic, seek to undermine delicate negotiations taking place to save the economy? Will the national dialogue produce more reliable water supplies for the Johannesburg Municipality, collapsing as it is under decades of municipal incompetence? Will it reduce the appalling levels of sexual violence in our country? The short answer is that there is a welter of considered research which indicates the direction that the country should take in order, for example, that inclusive economic growth can be generated to benefit the entire population. Do we need a National Dialogue to know that if the national government ensures that land it owns could be used for dealing with the urban housing crisis, we can begin to change the demographic character of our cities? Take, for example, Cape Town: the mayor of Cape Town has complained often that if the military properties at Wingfield and Ysterplaat could be handed over to the municipality, thousands of houses could be constructed and significant dents could be made in the challenge to redress homelessness, as well as recrafting the character of our cities. If the National Dialogue promotes the possibility of improved political awareness and an impetus to change the nature of our present political system, in which political parties have failed the country, then it may well serve a purpose. But if the hope is that somehow this dialogue is going to persuade the government to do that which has been known for decades and in which there has only been failure, then it is truly a waste of time and of taxpayers' money. Last weekend, Daily Maverick published the views of its readers as to what is required from government. It covered all the key challenges that government has consistently failed to address. How will a National Dialogue, even as it is led by a group of most distinguished South Africans, ensure that government suddenly converts itself into serving 60 million South Africans and addresses these challenges which are common cause? There is an ironic feature to all of this. The national dialogue has been called by the President. The President's record shows that he has been meticulous in his failure to engage the country in a dialogue other than by way of his family meetings, in which no questions are put to him. The President never subjects himself to radio and television interviews in which journalists, on behalf of the country, can put a range of difficult questions to him to ensure that the public gains a grasp of whether he can provide coherent reasons for government's failures. He is, in short, the very model of a 'non-dialogue' President. Yet he wants us to believe that this National Dialogue will turbocharge fundamental economic and political change in South Africa. On Monday, 18 August, the Y20 South Africa Summit will begin and continue until Friday, 22 August 2025, under the theme 'Youth for Global Progress: Uniting for Solidarity, Championing Equality, Driving Sustainability '. The Y20 is the official youth engagement group for the G20 and will engage in dialogue, collaboration and action, ensuring that young voices contribute meaningfully to global decision-making. Y20 South Africa 2025 aims to empower young leaders to shape global policies that reflect the priorities of youth. Venue: Birchwood Hotel, Ekurhuleni Tuesday, 19 August marks World Humanitarian Day, which the United Nations says is a time to honour those who step into crises to help others. This year's message is that the humanitarian system is stretched to its limits — underfunded, overwhelmed and under attack. 'In 2024 alone, over 380 humanitarian workers were killed. Some in the line of duty, others in their homes. Hundreds more have been injured, kidnapped or detained, and there is reason to fear 2025 could be worse. Too often, the world looks away, even when these attacks violate international law. The laws meant to protect aid workers are ignored. Those responsible walk free. This silence and lack of accountability cannot continue,' The UN said. In light of this, the UN will relaunch the #ActForHumanity campaign this World Humanitarian Day to demand protection, accountability and action for aid workers. The UN wants world leaders to: Protect humanitarian workers and the civilians they serve. Uphold international humanitarian law. Fund the lifelines we claim to support. On Tuesday, 19 August at 6pm, Youth Capital will host an online discussion called Community Talks — Invisible Threads 'This Women's Month, we're pulling back the curtain on the unseen work that keeps our communities alive. From ending gender-based violence to reimagining budgets and valuing care work, we'll explore how women, often without recognition or support, are holding it all together,' the organisation said. ​The following topics will be covered during the discussion: Shifting Power, Shifting Culture — What does it take to end gender-based violence beyond awareness and hashtags? On Thursday, 21 August at 9am, Lawyers for Human Rights will be running a school admissions help desk for parents for the 2026 school year. The law says that no child can be denied basic education just because they do not have a birth certificate or ID. Through the help desk, Lawyers for Human Rights will advise parents and assist them with their children's admission to a public school, especially Grade 12, even if they do not have an ID or a birth certificate. Guest experts and speakers include attorney Charl du Plessis, economic and organised crime researcher Dr Ugljesa Radulovic (University of Johannesburg), and award-winning journalist Jeff Wicks. Register for this webinar here. On Friday, 22 August at 9am, the Ahmed Kathrada Foundation will host a symposium to honour the life and sacrifices of Babita Deokaran. The symposium is titled Corruption in Gauteng Health — can it be stopped? It will include discussions and reflections on how to act to protect lives and restore integrity in our health system. Also happening on Friday, 22 August and Saturday, 23 August, several civil society organisations will host the third Urban Land Justice Gathering. The event is co-hosted by the Housing Development Agency, the Socio-Economic Rights Institute of South Africa, the Institute for Poverty, Land and Agrarian Studies at the University of the Western Cape, A City Occupied collective, and Ndifuna Ukwazi. 'South Africa's spatial apartheid endures; townships and informal settlements remain scars of displacement, while prime urban land sits vacant or hoarded. Even landmark legal victories like the Bromwell Street ruling haven't dismantled this entrenched injustice, exposing the gulf between courtroom wins and material change. Significantly, the urban land crisis disproportionately affects women, who sustain most households yet face systemic barriers to ownership. While managing survival in informal settlements, they remain locked out of their land rights,' The organisations said. The two-day gathering will address the urgent need for land redistribution in light of South Africa's largely failed land reform programme, three decades into democracy.
