
Sabah to boost income with Sales Tax law update, says state AG

KOTA KINABALU: Amendments to the Sabah State Sales Tax Enactment 1998 are expected to strengthen the implementation and collection of the state's sales tax.
State Attorney-General Datuk Brenndon Keith Soh said the current law brings in nearly half of Sabah's yearly income, and the changes would boost the collection.
'This is an important step to give Sabah more control over its own development, in line with the rights we have under the Malaysia Agreement 1963 (MA63),' he said after meeting with Yang DiPertua Negeri Tun Musa Aman at Istana Seri Kinabalu on Wednesday (May 14).
He said his department is also working on a new law to improve how Native Courts are run and another law to protect Sabah's carbon rights as part of climate change efforts.
During the meeting, they also discussed the need to update and align state laws related to land, the environment, and governance to support sustainable development.
Soh also shared the achievements of his department, including drafting state laws, advising government agencies, and ensuring all government policies follow the law.
'As legal advisers to the state, we are committed to making sure every decision made respects the law and benefits the people of Sabah,' he said.
Several senior officers from the Attorney-General's Chambers also attended the meeting.

A-GC: Anwar's royal pardon followed proper constitutional process
KUALA LUMPUR: The Attorney-General's Chambers (A-GC) has refuted claims by Tun Dr Mahathir Mohamad that the royal pardon granted to Prime Minister Datuk Seri Anwar Ibrahim in 2018 was invalid. In a statement today, the A-GC said it took serious note of Dr Mahathir's remarks, in which the former prime minister alleged that the pardon did not go through the proper process, namely a meeting of the Pardons Board. "The A-GC emphasises that the 51st Meeting of the Pardons Board for the Federal Territories of Kuala Lumpur, Labuan and Putrajaya was held on Wednesday, May 16, 2018, at 11am at Istana Negara, Kuala Lumpur. "The meeting was chaired by the 15th king of Malaysia, Sultan Muhammad V, and attended by Dr Mahathir himself in his capacity as prime minister at the time." As such, the A-GC said, based on the advice of the Pardons Board, His Majesty consented to grant a full royal pardon to Anwar and ordered his immediate release, effective from the date of the board meeting. It also said that the then attorney-general had provided a written legal opinion for the board's consideration in accordance with Clause (9), Article 42 of the Federal Constitution. "The A-GC views this matter seriously as it involves constitutional and institutional interests. Any statement that may mislead the public regarding the Pardons Board's decision is wholly inappropriate," it said.

Anwar's constitutional question to federal court not aimed at absolute immunity
KUALA LUMPUR: The application by Prime Minister Datuk Seri Anwar Ibrahim to refer several constitutional questions to the Federal Court, under Article 128(2) of the Federal Constitution and Section 84 of the Courts of Judicature Act 1964, is not intended to create absolute immunity for any individual. According to the Attorney-General's Chambers (A-GC), these questions raise new and unprecedented constitutional issues, particularly concerning the relationship between civil litigation and the ability of a sitting prime minister to effectively perform executive functions. The A-GC said that the eight questions include, among others, whether civil actions related to pre-office conduct can proceed if they undermine the prime minister's ability to govern. "Whether the Constitution implicitly requires judicial threshold review in such cases, and whether Articles 5(1), 8(1), 39, 40, and 43 of the Constitution support procedural protection to safeguard the separation of powers and institutional stability," the A-GC said in a statement released today. The A-GC clarified that these questions are structural in nature regarding constitutional governance, not about personal immunity. The AG-C added that the constitutional reference process was established to enable the High Court and Federal Court to make conclusive determinations on such issues. The A-GC respects the integrity of this constitutional mechanism and will evaluate any request for intervention based on legal merit and public interest, rather than politically charged sentiments. Furthermore, the A-GC stressed that any decision regarding the effect of constitutional provisions rests solely within the jurisdiction of the Federal Court under Article 128(2) of the Constitution. On May 27, the Prime Minister applied to refer eight legal questions to the Federal Court for decision. This application includes the question of whether he possesses immunity from a civil suit filed by his former researcher, Yusoff Rawther, four years ago. Anwar also requested the court to consider whether the lawsuit impacts his ability to carry out executive duties and undermines the principle of separation of powers guaranteed by the constitution.

KL residents say local plan ignores their concerns
THE soon-to-be gazetted Kuala Lumpur Local Plan 2040 (KLLP2040) continues to draw criticism from stakeholders who say it does not address their concerns. KLLP2040 will come into force on June 11, according to the Federal Government Gazette dated May 28 published by the Attorney General's Chambers. It contains written statements detailing objectives and proposals for developments, land use, socioeconomic planning and traffic management in the capital. Kuala Lumpur Residents Action for Sustainable Development Association chairman Tan Booi Charn said the group was concerned about land previously meant for community use turning into development zones. Tan: Land designated for community use has been turned into development zones. She pointed to Lot 481440 in Taman Danau Desa, previously reserved for a playground. 'The community submitted 1,000 objections to Kuala Lumpur City Hall (DBKL) but their pleas fell on deaf ears. 'Following enquiries, they were informed that the land title had changed and the plan must be adjusted accordingly,' she said. She added that some city lots had their plot ratios increased to accommodate potential future redevelopments. Another point of contention was flood retention ponds in Taman Desa, Taman Wahyu and Kampung Bohol turned into development land, said Tan. She said this contravened principles outlined in Kuala Lumpur Structure Plan 2040 that retention ponds should remain untouched. Tan estimated that only 13% of public objections were taken into account in the final draft of KLLP2040. 'We are disappointed because the public spent lots of time and effort preparing presentations and submitting objections.' Save Kuala Lumpur chairman Datuk M. Ali called for another round of engagements for DBKL to explain why feedback was not heeded. 'There have been severe shortfalls in the overall process of KLLP2040, which warrants rectifications,' he said. Ali said KLLP2040 failed to provide adequate safeguards for the capital's 52 water retention ponds. 'This is despite a directive from Prime Minister Datuk Seri Anwar Ibrahim for the ponds to be restored to their original status,' he said. Naidu: KLLP2040 seems to side with developers and landowners rather than communities. Brickfields Rukun Tetangga chairman SKK Naidu said many suggestions raised during engagements with DBKL were not implemented, especially with regard to green areas and development density. 'The final KLLP2040 seems to side with developers and landowners rather than communities,' he noted. KLLP2040 was adopted in accordance with Sections 16 and 17 of Federal Territory (Planning) Act 1982 (Act 267).
