Andhra Pradesh Cabinet amends labour laws; approves 10-hour workday for labourers

The State Cabinet, in its recent meeting, approved proposals to amend several provisions in the Factories Act of 1948 — Sections 54, 55, 56, 59, 64, 65, and 66 — related to labour, factories, boilers, and insurance medical services.
It also approved amendments to Sections 9, 10, 16, 17, and 73 of the Andhra Pradesh Shops and Establishments Act (1988).
Information and Public Relations (I&PR) Minister Kolusu Parathasarathy said these amendments were being made to be more favourable to investors as part of the Ease of Doing Business reforms.
He also said the decision to allow women to work in night shifts was part of removing gender discrimination in the industrial sector and promoting empowerment.
The working hours for labourers were increased, he said. While the practical workday had already shifted from eight hours to nine, the Cabinet decision increased it further to 10 hours.
Currently, workers are entitled to a 30-minute break after every five hours of work. Under the new rule, they will have to work six hours to earn a break. Previously, workers were allowed to work 50 to 75 hours of overtime per quarter. Now that limit has been extended to 144 hours. In reality, overtime is supposed to be voluntary extra work. But in practice, it has long become a compulsory burden dictated by employers. With the new decision, the pressure of overtime on workers will only increase.
The State government has also made night shifts mandatory for women. The Cabinet recommended that corporations provide facilities such as CCTV cameras, lighting, and security to enable women to work at night. However, no mention was made regarding arrangements for women with children. The Cabinet also failed to clarify whether night work would be compulsory or voluntary for women.

The move comes weeks after the gruesome murder of Indore-based businessman Raja Raghuvanshi, who was killed during a honeymoon trip to Sohra, in a plot orchestrated by his wife and her lover. "The cabinet today decided to revisit the Meghalaya Resident Safety and Security Act , 2016, an existing state legislation, to add more teeth to this Act to minimise the possibility of criminal elements entering Meghalaya in the guise of tourists," Cabinet spokesperson Paul Lyngdoh said after the cabinet meeting here. "The government will soon come up with a formal proposal to further strengthen the MRSSA," he said. The 2016 Act was originally introduced to enhance the security of Meghalaya residents through the vetting of tenants and tourists. It allows for identity verification through a tourism-specific app and has provisions similar to those under the Inner Line Permit system, which the state has long been seeking from the Centre. According to Lyngdoh, the Assembly had adopted a resolution demanding implementation of the Inner Line Permit in Meghalaya. "The matter is pending before the Union Ministry of Home Affairs. There were several queries from the Ministry which the state government had addressed," he said, adding that the Union Ministry had expressed concern since Meghalaya is a transit state to other parts of the North East. The Cabinet minister also informed that the MRSSA is already a very effective legislation, which will need a little bit of "upscale" as of now. The urgency to revisit the Act was triggered by the case involving Sonam, the wife of murdered businessman Raja. She had allegedly conspired to kill her husband along with her lover and his friends, and entered Meghalaya under the guise of a tourist. According to Lyngdoh, the Cabinet placed on record its gratitude to the entire police department for cracking this case in record time and arresting all the accused, saving the state from a "bad name".

BENGALURU: Chief Minister Siddaramaiah on Thursday declared that a fresh Socio-Economic and Educational Survey (SES) survey (caste census) will be conducted to address the concerns of all communities, including that of Veerashaiva Lingayaths and Vokkaligas. The decision was taken in a special Cabinet meeting, following the Congress high command's advice when the Chief Minister and Deputy Chief minister DK Shivakumar met the party leadership in New Delhi on Tuesday. Speaking to media persons after the Cabinet meeting, Siddaramaiah cited the lapse of 10 years since SES-2015 as the reason for going for the fresh survey. The CM said the survey report will not be valid after 10 years as per Section 11 of the Backward Classes Act as there will be changes in population, educational, and social developments. Responding to a question about the assurance given in the manifesto about the implementation of the report, the CM said that in the backdrop of changing social conditions and the guidance of the party high command, it has been decided to review it in the special Cabinet meeting. 'Given the lapse of 10 years since the SES-2015 was conducted, the Cabinet has decided to conduct a fresh survey as per Section 11 (2) of the Karnataka State Backward Classes Commission Act, 1995', he said. Ten years have passed since the Kantharaju-led commission conducted the survey and section 11 (1) states that a fresh survey should be conducted after 10 years, the CM said. He said the report and its recommendations were not finalised when he was Chief Minister from 2013-2018. But in 2018, the report was finalised and the Kantharaju Commission had approached the then backward classes minister Puttarangashetty to accept the report, Siddaramaiah said. 'But HD Kumaraswamy exerted pressure on Puttarangashetty that he should not receive the report, so he did not receive the report. After Kantharaju's term ended, the BJP government appointed Jayaprakash Hegde as the Chairman of the Commission. The members were also from the BJP. Hegde made recommendations based on the survey data. The recommendations were submitted to the government on February 29, 2024,' he said.
