
Corrupt ex-judge to serve six-month jail term after Court of Appeal reinstates sentence
A three-judge panel, chaired by Justice Datuk Mohd Nazlan Mohd Ghazali, upheld the Sessions Court's sentence after allowing the public prosecutor's final appeal to overturn the Shah Alam High Court's decision on July 31, 2023, which had reduced the sentence to one day's imprisonment and a RM12,000 fine.
In a unanimous decision, Justice Mohd Nazlan said corruption was a serious offence that undermined economic growth and denied the people their right to efficient services.
'What is even more serious in this case is that the offence was committed by a civil servant who was serving as a Sessions Court judge and entrusted with judicial responsibilities.
'This certainly betrays the trust of responsibility, erodes public confidence in the integrity of the judicial institution, and undermines the country's justice system,' he said.
The panel included Justices Datuk Mohamed Zaini Mazlan and Datuk Wan Ahmad Farid Wan Salleh.
Justice Mohd Nazlan said that after reviewing the appeal record, the court found that the Sessions Court judge had given due consideration to both the mitigating and aggravating factors, as well as the relevant sentencing principles, before handing down the sentence.
'There was an error in the High Court's reasoning in replacing the six-month jail sentence with one day, which did not justify interfering with the Sessions Court's ruling,' he said.
He said the sentence imposed by the Sessions Court judge was proportionate, fair, reasonable and not excessive.
'Therefore, the court allows the prosecution's appeal. The sentence imposed by the High Court is set aside, and the Sessions Court's sentence of six months' imprisonment and a RM25,000 fine, in default of six months' jail, is upheld.
'The court also orders a committal warrant to be issued and the respondent (Azmil Muntapha) to be detained immediately,' said Justice Mohd Nazlan.
It is understood that Azmil Muntapha will be taken to Kajang Prison. — Bernama

KUALA LUMPUR: A lorry driver pleaded not guilty in the Sessions Court here today to a charge of attempting to kill a policeman by running him over with a four-wheel drive vehicle, causing him to suffer injuries. Muhammad Farhan Baharudin, 34, was charged with committing the offence against Corporal Mohamad Sallehin Ab Rahman, 35, causing the victim to suffer an 'abrasion wound over right knee and right elbow bruising over right lower chest wall', injuries which could have been fatal. The offence was allegedly committed at the Ampang-Kuala Lumpur Elevated Expressway (AKLEH) exit to Jalan Tun Razak at 9.05am on Aug 8 this year. The charge, under Section 307 of the Penal Code, provides a maximum sentence of 10 years' imprisonment and a fine or imprisonment for a maximum of 20 years if injury is caused upon conviction. Judge Izralizam Sanusi allowed him bail of RM8,000 with one surety and also ordered him to report to a nearby police station once a month. The court set Oct 6 for mention. Deputy public prosecutor Faizah Khalilah Zaberi appeared for the prosecution, while lawyer Mohd Fikah Sanusi represented the accused.

Siti Bainun to serve 12 years for abusing Bella after court rejects appeal
PUTRAJAYA: Rumah Bonda founder Siti Bainun Ahd Razali will remain serving a 12‑year sentence, after the Court of Appeal today dismissed her final bid to overturn her conviction and sentence of abusing a teenager with Down's Syndrome, known as Bella. Appearing in the dock wearing a yellow outfit and face mask, Siti Bainun, 33, looked visibly distressed as the three-member bench, led by Datuk Azman Abdullah, and comprising Datuk Azmi Ariffin and Datuk Hayatul Akmal Abdul Aziz, delivered its decision. She stood beside a prison warder during the proceedings, while her family members watched from the public gallery.

PUTRAJAYA: Rumah Bonda founder Siti Bainun Ahd Razali has failed in her final appeal to overturn her conviction for neglecting and abusing a teenager with Down Syndrome known as Bella. A three-member Court of Appeal bench led by Justice Azman Abdullah today unanimously dismissed her bid to set aside the conviction and 12-year jail sentence imposed by the sessions court on May 3, 2023. 'We find that the prosecution has proven its case against the appellant beyond reasonable doubt. 'Accordingly, the conviction is safe to uphold and the appeal is dismissed,' Azman said. Justices Azmi Ariffin and Hayatul Akmal Abdul Aziz also heard the appeal. The court upheld the 12-year sentence imposed by the lower court, with Azman remarking that 'even animals would not think of inflicting such injuries as those seen on Bella'. Azman said there was no denying that the injuries sustained by Bella, who was 13 when the offence took place in 2021, were non-accidental and not self-inflicted, as supported by witness testimony. He said photographs tendered in court showed wounds on her arms, old injuries on her head, face, neck and back, as well as burn marks. The sessions court had sentenced Siti Bainun, 33, to 10 years' jail for neglecting the girl and 12 years for abusing her, with both sentences to run immediately and concurrently. Siti Bainun was also ordered to sign a RM5,000 good behaviour bond for five years with one surety, and to perform 200 hours of community service within six months of her release. On May 2 last year, the High Court upheld both conviction and sentence. Siti Bainun was represented by Haijan Omar, Nurul Hafidzah Hassan, Nur Aminatul Mardhiah Nor, Tun Laila Tun Rafaee, Asyraaf Abu Bakar Hamzah and Putri Ainaa Amiera Megat Mustaffa Al-Bakri.
